ORDINANCE NO. 64-1992 A SPECIAL ORDINANCE VACATING A PUBLIC WAY LOCATED AT 1600 RICH ROAD AND EXTENDING NORTH 480 FEET WHEREAS Alan H. Elder, general partner of Elder Family Partners, L.P., has petitioned the Common Council of the City of Richmond, Indiana, requesting vacation of a public way located at 1600 Rich Road, lying parallel to and east of Flatley Road, extending 480 feet north from Rich Road, being 30 feet wide, serving petitioner's premises only and abutted on both sides entirely by real estate owned by the petitioner, and WHEREAS the Common Council, pursuant to I.C. 36-7-3-12 conducted a public hearing on said petition September 21, 1992, and WHEREAS a public hearing pursuant to R.C. 155.04(B) was conducted by the Richmond Advisory Plan Commission on September 22, 1992, NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that subject to the preservation of easements for existing utilities, the public way described below is hereby vacated: Being a part of the Northwest Quarter of Section 30, Township 14, Range 1 West, in the City of Richmond, Indiana and being more particularly described as follows: Beginning at an iron rod located a distance of 990 feet south 0 degrees and 45 minutes west and 25 feet south 88 degrees and 59 minutes east from the northwest corner of the Northwest Quarter of Section 30, and running thence from said beginning point, north 0 degrees and 45 minutes east a distance of 480 feet to a point; thence South 88 degrees and 59 minutes east, parallel to the North line of said Northwest Quarter, a distance of 30 feet to a point; thence south 0 degrees and 45 minutes west, parallel to the west line of the Northwest Quarter, a distance of 480 feet to a point; thence north 88 degrees and 59 minutes west, parallel to the north line of said Northwest Quarter, 30 feet to the point of beginning, containing a total area of 0.33 hundredths of an acre, more or less. (an Indiana Limited partnership) is the owner of the industrial tract at 1600 Rich Road (occupied by Cinram, Inc., Elder Davis, Inc. and Elderlite Express, Inc.). The parcel of which vacation (of right of way) is requested extends into Elder Family Partner's tract by 480' of depth. it serves only this parcel and the petitioner owns all sides abutting it.
