RESOLUTION NO. 73-19
RESOLUTION OF THE DIRECTORS OF THE MIDPENINSULA
REGIONAL PARK DISTRICT IN SUPPORT OF THE PASSAGE
OF AB 921 (CONDEMNATION FOR OPEN SPACE PURPOSES).
WHEREAS, most cities and counties in the State of
California now have open space elements in their general plans
adopted pursuant to the mandate of State law, and
WHEREAS, cities and counties now have the power to
condemn land for parks but, according to some legal authorities,
do not have the power to condemn for "open space," and
WHEREAS, in some cases condemnation is the only way
the public can preserve open space lands, both from the standpoint
of carrying out local plans and in fairness to the property owner,
and
WHEREAS, AB 921 authorizes cities and counties to
condemn lands for open space uses when such lands are designated
as open space on local master plans, and
WHEREAS, AB 921 restricts the ability of cities and
counties to sell or otherwise dispose of open space lands acquired
by exercise of the condemnation power, and
WHEREAS, under AB 921 only privately owned land may
be condemned for open space purposes, and
WHEREAS, AB 921 permits the acquisition of interests
in land less than fee title, permitting lands in appropriate
cases to remain in private ownership and thereby provide a valuable
legal alternative for the enlightened implementation of local open
space plans and policies,
NOW, THEREFORE, THE BOARD OF DIRECTORS OF THE
MIDPENINSULA REGIONAL PARK DISTRICT DOES RESOLVE AS follows:
Section 1. That the Board of Directors most strongly
supports the passage of AB 921 and urges each member of the Senate
and the Assembly and the Governor to support said legislation and
to complete the enactment of same at the earliest possible date.
Section 2. The Secretary of the Park District is
directed to forward a copy of this Resolution to affected individual
legislators as well as appropriate committees thereof.
Passed and adopted by the Board of Directors of the
Midpeninsula Regional Park District on June 13 , 1973, at a
regular meeting thereof, by the following vote:
