A SPECIAL ORDINANCE AMENDING RESOLUTION NO. 17-1991
AUTHORIZING THE ACQUISITION OF LAND FOR THE CONSTRUCTION OF
SOUTH 37TH STREET
WHEREAS the Common Council of the City of Richmond, Indiana, adopted Resolution
No. 17-1991 authorizing the extension Elks Club Road south of East Main
Street, and
WHEREAS said project is now generally known as the "construction of South 37th
Street" instead of the "extension of Elks Club Road", and
WHEREAS said resolution authorized the Board of Public Works and Safety to appoint
two appraisers to determine the fair market value of the lands and structures
to be acquired and proceed to purchase the same for a price no greater than
the average of the two appraisals, and
WHEREAS the average of the two appraisals of the Town & Country Motel before the
taking was $299,867 and after the taking was $84,959, leaving
compensation due the owner of $214,908, and
WHEREAS the owner obtained an appraisal of the value after the taking as being
$63,750, and
WHEREAS the City Attorney has reviewed the respective appraisal reports and the
contentions of the land owner/contract purchasers and is of the opinion that
the "after taking" appraisal obtained by the land owner/contract purchasers
is more likely to prevail in the course of eminent domain litigation, and
WHEREAS it is advantageous to the City to compromise and reach a settlement of this
matter in order to avoid the expense of litigation and delay to the
construction of South 37th Street,
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana,
that the Board of Public Works and Safety is authorized to purchase that portion of the Town &
Country Motel buildings and land, located at 3643 East Main Street, required for the construction
of South 37th Street for the sum of $236,117.
Passed and adopted this 21 st day of December, 1992, by the Common Council of the City of
Richmond, Indiana.
