April 8, 1959.
The regular meeting of Town Council was held today at 4 P.M. in the Council Room and
was attended by Mayor Brown, who presided, and Councilmen Peters, Hosti, Waters, Meddin
Lovell, Town Attorney Solna, Superintendent Reed, Mr. James N. Carter and Mr. Lorton
Livingston.
Mr. Carter requested permission to erect a Boatel -Motel on Lot 73, Ward 4, on property
owned by his family. He stated that the prospective project would involve about
$200,000.00. -He was asked if plans had been drawn for this proposed development and.
stated that he was not sure. He was requested to furnish a sketch of the proposed
plans and submit it to Council. This area is zoned against any commercial activity.
Mr. Carter was excused.
Mr. Livingston protested against the 1959 assessments placed on property of the Sea -
view Development Company (Hotel Tybee). He stated that the new assessment was
$74,000.00 which he felt was too high. Mr. Livingston was excused. After discussing
the matter it was moved, seconded and passed that the improvements be reduced by
$12,000.00.
The Mayor informed Mr. Reed that he was glad he was back and hoped that he was feeling
much better. He asked if any rock or other material had been put behind the bulk-
head on Mr. Locree's property on the Inlet. Mr. Reed stated that it had as it was
necessary to do this to protect the large storm sewer which runs through Mr. Lucree's
royerty. Mr. W.H. Logan requested that some rip -rap be placed behind his wall.
e Mayon asked Councilman Hosti if he had read the new building code of the Fire -
underwriters and he stated that he had read part of it. Superintendent Reed suggested
n that the small code be used and it was decided to refer this to the net meeting.
Councilman Hosti reported that a bid was received from the Stanley Company to repair
Second Avenue, Center Street, Twelfth Street, Fourteenth Street and Campbell Avenue
for a total of $26,267.00 for a 40 foot widd paving and $24,501.00 for an 18 foot wide
paving. This was the only bid received. It was moved, seconded and passed that
Councilman Hosti be authorized to handle the matter and that he get the lowest bid possi-
ble.
The petition of Mrs. Mary Walker to enlarge on her kindergarten in Venetian Terrace was
on motion made, seconded and passed.
The Mayor informed Council that he had worked out a new arrangement on the installation
of the vapor type street lights in the commercial section and that the Savannah Electric
Company had agreed to install the lights without cost to the Town and the cost would be
$15ano per r for service.
Councilman Lovell wanted to know what happened to the request of the residents.of Estill
Station who wanted the Town to furnish them water. Mr. Reed informed him that Mr. Paul
Hernandez had agreed to get up the petition as soon as he could.
Councilman Waters reported that he had attended a recreational committee meeting recently
and that they had been informed that the County Copmnissi€ners had agreed to build a
ball diamond on some of the school property but that it is necessary that five (5) trees
be removed, the present diamond needs to be reqired and the fence parallelling Jones
Avenue be repaired.
AN ORDINANCE
AN ORDINANCE TO PROVIDE FOR 'rub RATE OF LICENSE TAXES FOR DOING
, BUSINESS AND SELLING IN Y'ti TOWN OF SAVANNAH BEACH, TYBEE ISLAND,
GEORGIA, FOR THE FISCAL YEAR BEGINNING MAY 1, 1959, AND ENDING
APRIL 30, 1960; FIXING PENALTIES FOR THE VIOLATION THEREOF; AND
FOR OTHER PURPOSES.
SECTION I: Be it ordained by the Mayor and Councilmen of the Town
of ,Savannah.Beach, Tybee Island, Georgia, in Council assembled, and it
is hereby ordained by the.authority of the same, that license taxes for
doip.g business and selling in the Town of Savannah Beach, Tybee Island,
for the fiscal year beginning on May 1, 1959, and ending on April 30,
196p, shall be payable by each person, firm or corporation transacting
or offering to transact any of the kinds of businesses hereinafter speci-
fied and scheduled, or practising or offering to practise any of the
professions or callings hereinafter specified or scheduled, whether in
connection with any other business, profession or calling or not, and
shall pay the license tax hereinafter prescribed on or before engaging
in pr practising such profession or calling:

SECTION II: Any person, firm or corporation engaged in or doing
business under such license shall also be required to report to the Clerk
of Council of Savannah Beach, the name and address of each and every
person from whom salvage or junk is purchased, and said report shall
further identify the article purchased as junk or salvage. The said re-
port to the Clerk of Council of this municipality shall be made within
twenty -four (24) hours after the completion of said trade, purchase or
acquisition of said junk or salvage.
SECTION III: In the event any business or calling not specifically
mentioned in the above list set forth shall be established in the Town of
Savannah Beach, Tybee Island, Georgia, the Mayor and Councilmen reserve
the right to establish a license fee for same by ordinance, which fee is
to be.of equal dignity as the license specifically mentioned in the
above section, provided, however, that such license shall not be more
than the sum of Seven Hundred Fifty (750.00) Dollars.
$ECTION IV: This ordinance shall be subject to alteration or re-
peal in whole or in part at any time during the fiscal year beginning

May 1, 1959, should it be deemed advisable, and no such amendment or re-
peal shall be construed to impair the right to Council to assess or levy
tax for the whole of such year whenever made.
SECTION V: Any person, firm or corporation owning or operating any
riding devices, or passenger vehicles for hire, before being issued a
license therefor, shall deposit with the Clerk of Council a policy of
insurance against personal injury and property damage, with a receipt
showing that the premium thereon has been paid for the length of time
covered by the license, in such company and in such amount as may be
approved by the Mayor and Councilmen for the benefit of any person or
persons who may be killed or injured or sustain damage to property by
reason of operation thereof.
SECTION V -a: In lieu of such policy of insurance, any person,
firm or corporation owning or operating passenger vehicles for hire,
before being issued a license therefor, shall deposit with the Clerk of
Council a Surety Bond in the amount of Five Thousand 05,000.00) Dollars
for each vehicle operated by said person, firm or corporation, signed by
surety company acceptable to the Mayor and Councilmen of Savannah Beach,
said Bond guaranteeing the payment of any loss or damage sustained . by
any person or persons by reason of the operation of such vehicle, the
exact form of such bond to be approved by the Mayor and Councilmen of
Savannah Beach.
SECTION V -b: In lieu of such policy of insurance and /or such Surety
Bond, any person, firm or corporation owning or operating a passenger
vehicle for hire, before being issued a license therefor, shall deposit
with the Clerk of Council a Real Estate Bond in the amount of Five
Thousand 05,000.00) Dollars for each vehicle operated by said person,
firm or corporation, signed by an owner of real estate who holds mer-
chantable fee simple title to the same and acceptable to•the Mayor and
Councilmen of Savannah Beach, said Bond guaranteeing the payment of
any loss or damage sustained by any person or persons by reason of
the operation of such vehicle, the exact form of such Bond to be
approved by the Mayor and Councilmen of Savannah Beach. If said Real
Estate Bond is approved by the Mayor and Councilmen, the applicant for
license shall pay the fee for recording of said Bond in the Clerk's
office of the Superior Court of Chatham County, Georgia.
SECTION VI: The Mayor and Councilmen reserve the right to refuse
to issue.to.angone any licenses for any purposes for reasons sufficient
to them.
SECTION VII: Any person procuring a license on or after November 1,
1959, shall .pay, one -half of the fee therefor set forth in this ordin-
ance.
SECTION VIII: Any person, firm or corporation violating any of the
provisions of Section 1 of this ordinance shall, upon conviction before
the Mayor's Court of said Town, be subject to be fined in the sum of
Inot more than One Hundred .06100.00) Dollars or be imprisoned not more
than thirty (30) days, either or both, or any portion of either or
both, in the.discretion of the Court.
SECTION IX: All ordinances or parts of ordinances conflicting with
the provisions of this ordinance are hereby repealed.

AN ORDINANCE +,
TO PROVIDE FOR THE TAXATION OF REAL AND PERSONAL PROPERTY
IN THE TOWN OF SAVANNAH. BEACH,, TYBEE ISLAND, GEORGIA, FOR
THE FISCAL YEAR COMMENCING MAY 1, 1959, AND ENDING APRIL
30, 1960, AND FROM YEAR TO YEAR UNTIL REPEALED; AND FOR
OTHER PURPOSES.
SECTION I. Be it ordained by the Mayor and Councilmen of the
Town of Savannah. Beach, Tybee Island, Georgia, in council assembled,
and it is hereby ordained by the authority of the same, that the rate
of taxation upon real estate. and personal property within the limits of
said Town of Savannah Beach, Tybee Island, Georgia, for the fiscal year
commencing May 1, 1959.,. shall be TWO AND TWENTY -TWO HUNDREDTHS (2.22 %)
percent upon the assessed or returned value of same, the:roalue of real
estate improvements to be ascertained from the returns of. the Committee
on Assessments of said Mayor and Councilmen, and the valuation of pers-
onal property to be ascertained from the returns of the owners thereof,
in pursuance of the scheme and plan contained in Sections I, II, III and
IV of the Ordinance to provide.for the assessment of taxable property
in the Town of Savannah Beach, Tybee Island, Georgia, and the mode of
valuing. such property for taxation. and to carry into effect the provi-
sions of the Act of the General Assembly of the Mate of Georgia, ap-
proved August 19, 1922, Section 21, passed by Council assembled October
13, 1922; and it is further ordained that if any person or persons shall
refuse to pay the taxes hereinabove set forth, within thirty (30). days
after same shall become due, the Clerk of Council, as Ex- Officio Treas-
urer of the Town, shall issue execution therefor, and the. further. sum
of One (1.00) Dollar for costs, and the Chief of Police and Ex- Officio
Tax Collector shall proceed with such execution in the same manner as
now provided by law in such cases of execution lodged with the Sheriff
of Chatham County.
SECTION II. Any tax upon real property assessed and due shall
be payable in semi- annual payments; the first half being due and payable
on or before May 1st of each year; the second half shall be due and pay -
able on or before November let of each year. In the event that any tax
is not paid when the same is payable, the outstanding amount shall be
immediately executed, the fee for execution being $1.00, and in addition
thereto an interest charge of one -half of one percent per month shall
be assessed. The provisions of this Section shall not apply to licen-
ses for doing business in said Town, said licenses being covered under
separate ordinance. The provisions of this Section shall apply, however,
to those persons or companies required by the provisions of Section 92-
5902 of the Code of Georgia to make returns to the Comptroller General
of Georgia.
SECTION III. This ordinance shall continue in effect for each
and every fiscal year hereafter unless and until repealed or changed
by ordinance.
SECTION IV. All ordinances or parts of ordinances conflicting
with the provisions of this ordinance are hereby repealed; provided,
however, that so much and such parts of ordinances passed, as provide,
for the execution of tax assessments, or part thereof, shall continue
and remain in force so as to.authorize the Clerk of Council and Ex- Officio
Treasurer to issue executions, and the Chief of Police and Ex- Officio Tax
Collector to collect same until said taxes or assessments shall be fully
paid.

Councilman Meddin Moved that bills for the month of March for General Government
amounting to $2,105.58 and for the Water Department amounting to $230.00 be paid,
the motion was seconded and passed.
The Mayor informed Council that -Mr. Reed had presented to him hospital and doctor
bills amounting to $235.60 which were incurred during his recent illness. He
stated that Mr. Reed was injured last August while handling a lawn mower which caused
the injury which later caused him to be hospitalized. It was moved, seconded and
passed that bills be paid and that a release be given by Mr. Reed.
Councilman Waters moved that Chief McCutchen's salary be increased by $300.00 per
year. This salary increase to be paid him as driver of the Town's ambulance and
is effective May 1, 1959.
The Tybee P.T.A. petitioned that Fifth Street be made a one-way street from east
to west. This matter was referred to Councilmen Waters and Hosti.
The Mayor called attention to the increase in the number of horses that are being
ridden by riders all over the island. He called attention that there is an
Ordinance prohibiting horses being on the island except in one small area. He
stated that the horses must be kept in a corral or tied up.
Attention was called to the young Parker boy in the Parker cottage on First
Avenue. Council vas informed that the water in this building is cut off. Chief
McCutchen was instructed to check on this and report. Mr. Solms will also handle
the matter.
Councilman Waters suggested making a one -way street of Izlar Avenue. He was re-
quested to handle this with Superintendent Reed.
Mr. Sol Kaminsky - requested the Town to convey or lease to him a small portion of the
Strand south of 18th Street which leads to his property. It was decided to hold this
matter in abeyance until the next meeting.
Attention was called to the new fence which the DeSoto Beach Club is building on
Butler Avenue between Third and Center Streets without a building permit. It was
decided by Council that it is all right.
Mayor Brown reported that it would be necessary to elect a new Councilman to fill
the unexpired term of Mr. Joseph H. Hutton, deceased and asked for nominations.
Councilman Hosti nominated W. James H. Powers. The Mayor asked if there were any
other nominations, there being none, Councilman Hosti moved that Mr. James H. Powers
be elected Councilman to fill the unexpired term of Mr. Joseph H. Hutton, Deceased.
The motion was seconded and passed.
Mr. Thomas M. Reed was elected Building Inspector, Pro- Tempore. It
seconded and passed that Wm. Paul be elected Plumbing Inspector on a
