AN ORDINANCE AMENDING ORDINANCE NO. 68-267
OF THE CITY OF TEMPLE CITY BY ADOPTING BY
REFERENCE THE LOS ANGELES COUNTY BUILDING
CODE AND AMENDMENTS AS CONTAINED IN THE 1971
EDITION OF THE LOS ANGELES COUNTY BUILDING
LAWS PUBLISHED BY THE BUILDING NEWS INC.
INCLUDING CHAPTERS 68, 69, 98 and 99 OF THE
SUPPLEMENT TO THE SAID LOS ANGELES COUNTY
BUILDING CODE FOR AND INSTEAD OF THE PRESENT
BUILDING CODE AND MAKING OTHER AMENDMENTS.
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN
AS FOLLOWS:
SECTION 1. Ordinance No. 68-267 entitled "Building Code"
adopted July 16, 1968 is hereby amended by adopting by reference,
except as hereinafter provided, that certain Building Code known
and designated as the Los Angeles County Building Code as contained
in the 1971 Edition of the Los Angeles County Building Laws pub-
lished by Building News, Inc., including Chapters 68, 69, 98 and
99 inclusive of the Supplement to said Los Angeles County Building
Code and including pages 1 through 8 of that portion of the said
Los Angeles County Building Laws titled "Amendments to the 1971
County of Los Angeles Buildings Laws," and such code shall be and
become the Building Code of the City of Temple City,
regulating the erection, construction, enlargement, alteration,
repair, moving, removal, demolitlon, conversion, occupancy, use,
height, area, maintenance of all structures and certain equipment
therein specifically regulated and grading within the City of
Temple City, and providing for the issuance of permits and
the collection of fees therefore, providing penalties for
violation off such code, declaring and establishing fire zones.
Three copies of said Los Angeles County Building Laws have
been deposited in the office of the City Clerk of the City of
Temple City, and shall be at all times maintained by said
Clerk for use and examination by the public.
Said edition of the Los Angeles County Building Code,
except as provided hereinafter, is hereby substituted for, and
shall take the place of, the Building Code set forth in said
Section 8100 et. seq. of the Temple City Municipal Code, and
such amending ordinances previously adopted.
SECTION 2. Section 1.01 of said Los Angeles County Building
Code is amended to read:
Section 101. Title. Section 8100 of the Temple City
Municipal Code, shall be known as the "Building
Code," may be cited as such, and will be referred
to herein as "this Code." The provisions of said
Section 8100 applying to dwellings, lodging,
houses, hotels, apartment houses, convents,
monasteries or other uses classified by this
Code as a Group H or I Occupancy and including
Chapters 1, 2, 3, 4 and 98 and 99 is and may be
cited as the "Housing Code."
SECTION 3. Section 207 of said Los Angeles County Building
Code is amended to read:
Section 207. Definitions. Whenever any of the
names or terms defined in this Section are used
in this Code, each such name or term shall be
deemed and construed to have they:

ascribed to it in this Section.

"Board of Appeals" shall mean the Board of Appeals
established by Section 206 of said Los Angeles County
Building Code.
"Building Department" shall mean the "Building and Safety
Division" of the Department of County Engineer.
"Building Official!" shall mean County Engineer of the
County of Los Angeles.
"City" shall mean the City of Temple City except in
Section 103 of said Building Code.
"County ", "County of Los Angeles" or "unincorporated
territory of the County of Los Angeles" shall mean the
City of Temple City.
"County Engineer" shall mean the County Engineer of the
County of Los Angeles.
"Electrical Code" shall mean Section 8200 et. seq. of
the Temple City Municipal Code.
"Fire Code" shall mean Section 3100 et. seq. of the City
of Temple City Municipal Code.
"Fire Zone" shall mean the fire zone adopted by an
ordinance creating and establishing fire zones or
where no such fire zones have been adopted by the
City of Temple City shall be considered to be in
Fire Zone No. 3.
"General Fund" shall mean the City Treasury of the City
of Temple City.
"Health Obde" or "Los Angeles County Health Code" shall
mean Section 5100 et. seq. of the City of Temple City
Municipal Code.
"Health Officer" shall mean the Health Officer of the City
of Temple City.
"Mechanical Code" shall mean Section 8150 et. seq.. of
the City of Temple City Municipal Code.
"Plumbing Code" shall mean Section 8300 et. seq. of the
City of Temple City Municipal Code.
"Special Inspector" shall mean a person holding a valid
Certificate of Registration issued by the County of
Los Angeles as set forth in Section 305 (b) of said
Los Angeles County Building Code.
SECTION 4. Section 208 of the Building Code of the City
of Temple City shall read as follows:
Section 208 (a). Compliance with Code. A person
shall not erect, construct, enlarge, alter, repair,
move, improve, remove, convert, demolish, equip,
use, occupy or maintain any building or structure
or perform any grading in the City, or cause the
same to be done, contrary to, or in violation of
any of the provisions of this Code.

. Section 208 (b). Penalty. Any person, firm or
corporation violating any of the provisions of
this Code shall be deemed guilty of a misdemeanor,
and each such person shall be deemed guilty of a
separate offense for each and every day or portion
thereof during which any violation of any of the
provisions of this Code is committed, continued or
permitteJ, and upon conviction of any such violation,
such person shall be punishable by a fine of not
more than $500, or by imprisonment for not more
than six months, or by both such fine and
imprisonment.
SECTION 5. Said Los Angeles County Building Code is
amended by deleting Section 307 therefrom.
SECTION 6. Section 9906 of said Los Angeles County Building
Code is amended to read:
Section 9906. Building Rehabilitation Appeals
Board. In order to hear appeals provided for in
Chapter 98 and in this chapter, there shall be
and is hereby created a Building Rehabilitation
Appeals Board consisting of five (5) members who
are qualified to pass on matters pertaining to
substandard building and property. The members of
the Board shall be appointed by and hold office
at the pleasure of the City Council of the City of
Temple City and may recommend such new legislation
as deemed necessary. The Board shall adopt
reasonable rules and regulations for conducting
its investigations. The Building Official shall
be an ex- officio nonvoting member and act as
secretary. He shall keep a record of all pro-
ceedings and notify all parties concerned of the
findings and decisions of the Board.
SECTION 7. Section 9925 of said Los Angeles County Building
Code is amended by adding Sections 8103 and 8103.1 to the Temple
City Municipal Code to read as follows:
Section 8103. Appeal. Any person receiving a
copy of the order issued by the Building
Rehabilitation Appeals Board may, within five (5)
days from the date of service, appeal from such
decision by filing a written dated appeal containing:
(a) a brief statement setting forth appellant's
legal interest in the building or land
involved in the notice and order;
(b) a statement in ordinary and concise
language of any finding of fact disputed,
together with material facts supporting
the contentions of the appellant;
(c) a statement in ordinary and concise
language of the specific order protested,
together with any material facts supporting
the contentions of the appellant;
(d) the signature of each appellant and his
official mailing address;
(e) the verification of at least one appellant
as to the truth of the matters stated in
the appeal; and

(f) a fee of $35.00.
If there is no such appeal, then the order of
the Building Rehabilitation Appeals Board shall
be final.
Section 8103.1 Same. Review. Within 21 days
after receiving the written appeal, the City
Council shall review the decision and record
of the Building Rehabilitation Appeals Board,
and on the basis of such review, confirm, modify,
or reverse the decision. The decision of the
City Council upon such review shall be final.
In cases where the City Council confirms or
modifies the decision of the Building Rehabilita-
tion Appeals Board, the City Council shall adopt
a resolution declaring such premises to be a
public nuisance and ordering the abatement thereof
within a period of time not to exceed 30 days by
having such premises, buildings or structures
rehabilitated, repaired or demolished in the
manner and means specifically set forth in said
resolution. A copy of the order shall be served
on the appellants as set forth in Section 9924.

SECTION 8. Section 8102 of the Temple City Municipal
Code is hereby amended to read:

SECTION 9. Section 8102..1 of the Temple City Municipal
Code is hereby amended by substituting Table 3B, as follows:

SECTION 9. The City Clerk shall certify to the adoption of
this Ordinance and to its approval by the Mayor and shall cause
the same to be published in the Temple City Times, a newspaper.
