ORDINANCE NO. 72 -356
AN ORDINANCE OF THE CITY OF TEMPLE CITY
AMENDING SECTION 9277 OF THE TEMPLE CITY
MUNICIPAL CODE RELATING TO ClUITA4N DISCONTINUED
USES
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES
ORDAIN:
SECTION 1. Based upon the recommendation of the
Planning Commission as set forth in Resolution 72 -452 P.C.,
and after further report thereon from the Planning Commis -
sion as required by the Planning Law of the State of
California, Section 9277 of the Temple City Municipal Code
is hereby amended to read as follows:
Section 9277. Notwithstanding the provisions
of Sections 9273, none of the uses set forth in
this Zoning Code as "Conditional Uses" which were
lawfully in existence as of the effective date of
this Section, shall be deemed nonconforming solely
by reason of the application of such procedural
requirement; provided, however, that whenever any
such pre - existing use (1) has not applied for and
been granted such Conditional Use Permit, and (2)
has been discontinued in usage for any reason
whatsoever for a period of 180 days or more, then
there shall arise a rebuttable presumption that
there has been an intent by the owner or user to
abandon such use; and proceedings shall be commen-
ced by the Planning Commission, based upon such
implied abandonment, to immediately abate such use
as contrary to the Zoning Ordinance; provided, how -
ever, if the Planning Commission determines that
there is sufficient evidence to indicate a lack of
intent upon the part of the owner to abandon, and
finds that good and reasonable cause exists therefor,
_ it may extend such abatement, upon written applica-
tion setting forth the reasons for such extension.
SECTION 2. The City Clerk shall certify to the adoption
of this Ordinance and to its approval by the Mayor and shall
cause the same to be published in the Temple City Times, a
newspaper of general circulation, printed, published and cir-
culated in the City of Temple City.

Ordinance, being Ordinance No. 72 -356 , was introduced at a
regular meeting of the City Council of the City of Temple
City, held on the 6th day of June , 1972, and was
duly passed, approved and adopted by said Council, approved
and signed by the Mayor and attested by the City Clerk at a
regular meeting of the said City Council held on the 20th
day of June , 1972, by the following vote:
