AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING
ORDINANCE NO.2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE
OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF
PROPERTY LOCATED AT 910,912 AND 914 MENDLESON DRIVE FROM R-2
SINGLE FAMILY RESIDENCE DISTRICT TO C-2 COMMERCIAL DISTRICT.
WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968
designates and describes as R-2 Single Family Residence
District the property located at 910, 912 and 914 Mendleson
Drive; and,
WHEREAS, it is the intent and purpose hereof, to change the zoning
classification of said property from R-2 Single Family
Residence District to C-2 Commercial District; and,
WHEREAS, a study of this Ordinance was_ conducted by the Richmond
Advisory Plan Commission the day of ,1991, at
which time remonstrances were heard from all parties
interested in or affected by this Ordinance; and,
WHEREAS, the vote of the Richmond Advisory Plan Commission was
to in favor of/in opposition to recommending the
passage of Ordinance No. 4-1991.
NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of
Richmond, Indiana as follows:
SECTION 1. That the zoning classification of the property described
below, and the same is hereby changed to C-2 Commercial
District and that said property be regulated in accordance
with the Zoning Ordinance of the City of Richmond, Indiana
and all amendments thereto.
Lots Numbered 4, 5 and 6 in the Highland View Addition.
Also; beginning at the northwest corner of Lot Number 6 in
Highland View Subdivision (a part of the Northeast Quarter of
Section 20, Township 14 North, Range 1 West, said
Subdivision being platted and recorded in Plat Book 7, Page
192, Office of the Wayne County Recorder); and running
thence North 0 degrees 48 minutes East 115.39 feet more or
less to a point in the South right-of-way line of Interstate
Route No. 70 (I.R. 70); thence north 82 degrees 48 minutes
west 129.15 feet more or less to the northeast corner of said
Lot Number 6; thence north 89 degrees 12 minutes west 100
feet to the place of beginning, containing 0.28 acres more or
less.
SECTION 2. This Ordinance shall be in full force and effect from and
after its passage and approval as by law aquired.

Dear Mrs. Hutton, Members of Common Council and
Mrs. Merchanthouse:
The Richmond Advisory Plan Commission conducted a public hearing on
Tuesday, February 26, 1991, on the petition of Charles and Sheila Focht,
Raymond and Minnie McDaniel, Ivora Bundy and Elmer Russell, owners;
Robert Burton, agent; requesting a rezoning from R-2 Single Family
Residence District to C-2 Commercial District, on property located at
910, 912 and 914 Mendleson Drive.
The property in question consists of 3 lots located on the north side of
Mendleson Drive. Each lot adjoins the right-of-way of Interstate 70.
Each lot presently has a single family dwelling located on it. The petition
is requesting a change in zoning from R-2 to C-2 to enable a 63 room
motel to be constructed. However, if the rezoning is approved, any use
permitted in the C-2 District could be established on the property.
Fourteen (14) notices of public hearing were sent to the residents
surrounding the site. One (1) notice was returned to the Plan Department
in favor of the petition and one (1) notice was returned to the Department
oppossed to the petition. During the public hearing, Mr. Ben Kovach of 900
Mendleson Drive spoke in opposition to the petition. Mr. Kovach was the
designated spokesman for all the other residential property owners on
Mendleson Drive who are oppossed to the petition. Mr. Kovach cited
