AN ORDINANCE AMENDING SECTION 96 OF THE RICHMOND CITY CODE
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Richmond that
Section 96.10 (D) (1) (c) be amended as follows:
Require the payment of a Twenty -Five Dollar ($25).

Petitioner: Charles and Sheila Focht, Raymond and Minnie McDaniel, Ivora
Bundy and Elmer Russell, owners; Robert Burton, agent.
Request: rezoning from R-2 to C-2. If the rezoning is approved, it is
proposed that a motel, being Fairfield Inn, be constructed on the property.
However, the change in zoning would allow any use permitted in the C-2
Zoning District.

neighborhood concerns about traffic safety, the poor condition of
Mendleson Drive, drainage problems and the encroachment of a commercial
use into a stable residential area. The Plan Commission also received a
letter from the Green Acres Rehabilitation Center Board of Directors
indicating their opposition to the petition, citing concerns about the
safety of group home residents on Mendleson Drive.
The City's Comprehensive Plan has designated the area adjacent to Chester
Boulevard as a special development area because of the area's unique
locational characteristics. These characteristics include access to one of
only four 1-70 interchanges, i.e. a gateway to the City, access off of the
City's principle north -south thoroughfare and the location of existing
developments of significance to the overall community such as IU East and
Reid Hospital. Because the development of the Chester Boulevard area is
significant to the overall community, the Plan Commission has
historically encourage the use of plan unit development as a means to
accomplish growth in this area. The plan unit development approach
requires that a minimum acreage be assembled for a project . PUD also
requires the approval of a development plan based on good engineering,
consideration for traffic safety, consideration for good design and
compatibility with surrounding uses.
The property in question is too small, being approximately 2 acres, to
request a plan unit development. The subject petition is only requesting a
change in zoning so that little opportunity is available for the City to
provide input into the project. Therefore, the Plan Commission voted six
(6) to two (2) to recommend to Council that Ordinance No. 4-1991 be
denied.

T request that the permit fee to dig or make excavation in a city street,
alley or sidewalk be increased. I recommend the increase be to $25.00.
The present cost for a permit is $5.00.
The fee was part of the ordinance as passed in 1961. The current cost to
the city to process and follow-up on these excavations is much more than
$5.00. 1 request that Common Council approve this revision.
