AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING
ORDINANCE NO.2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE
OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF
PROPERTY LOCATED AT 906 NORTH I STREET FROM R-3 ONE TO EIGHT
FAMILY RESIDENCE DISTRICT TO C-1 LIMITED COMMERCIAL DISTRICT.
WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968
designates and describes as R-3 One to Eight Family
Residence District the property located at 906 North I Street;
and,
WHEREAS, it is the intent and purpose hereof, to change the zoning
classification of said property from R-3 One to Eight Family
Residence District to C-1 Limited Commercial District; and,
WHEREAS, a study of this Ordinance was conducted by the Richmond
Advisory Plan Commission the 2!2 day of Je-,�r- ,1991, at
which time remonstrances were heard from all parties
interested in or affected by this Ordinance; and,
WHEREAS, the vote of the Richmond Advisory Plan Commission was
F to D in favor of/' ' -fie- recommending the
passage of Ordinance No. 6-1991.
NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of
Richmond, Indiana as follows:
SECTION 1. That the zoning classification of the property described
below, and the same is hereby changed to C-1 Limited
Commercial District and that said property be regulated in
accordance with the Zoning Ordinance of the City of
Richmond, Indiana and all amendments thereto.
Lots Numbered 11 and 12 in the Sarah Sander's Addition.
SECTION 2, This Ordinance shall be in full force and effect from and
after its passage and approval as by law aquired.

Request: rezoning from R-3 to C-1. If the rezoning is approved, the
owner is proposing to build a new building on the property to house Tony's
Pharmacy and a medical office. However, the change in zoning would
allow any use permitted in the C-1 Zoning District.

Mrs. Merchanthouse:
The Richmond Advisory Plan Commission conducted a public hearing on
Tuesday, February 26, 1991, on the petition of Anthony Lukacek, owner;
requesting a rezoning from R-3 One to Eight Family Residence District to C
1 Limited Commercial District, on property located at 906 North I Street.
The property in question consists of 2 vacant lots located at 906 North I
Street. The petition is requesting a change in zoning from R-3 to C-1 to
enable the construction of a building housing a pharmacy and a medical
office. However, if the rezoning is approved, any use permitted in the C-1
District could be established on the property.
Thirty-five (35) notices of public hearing were sent to the residents
surrounding the site. One (1) notice was returned to the Plan Department
in favor of the petition. During the public hearing, no one spoke in
opposition to the petition.
The property in question is adjacent to commercial zoning on the north and
east. The neighborhood surrounding the site is an area of mixed
commercial and residential use. The petition is requesting a rezoning to
the C-1 District which is intended to provide for a range of commercial

uses that can locate adjacent to a residential district without detracting
from the quality of life and property values in the residential area.
Neighbors in the area have signed a petition indicating they have no
objection to the proposed project. The Police Department, Fire
Department and Sanitary District have reveiwed the petition and no
problems have been identified.
The Plan Commission voted eight (8) to zero (0) to recommend to Council
that Ordinance No. 6-1991 be adopted.
