AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING
ORDINANCE NO.2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE
OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF
PROPERTY LOCATED AT 401 SOUTH Q STREET FROM R-3 ONE TO EIGHT
FAMILY RESIDENCE DISTRICT TO M-1 LIGHT INDUSTRIAL DISTRICT.
WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968
designates and describes as R-3 One to Eight Family
Residence District a portion of the property located at 401
South Q Street; and,
WHEREAS, it is the intent and purpose hereof, to change the zoning
classification of said property from R-3 One to Eight Family
Residence District to M-1 Light Industrial District; and,
WHEREAS, a study of this Ordinance was conducted by the Richmond
Advisory Plan Commission the Iov-day of_,-4e�. 1991, at
which time remonstrances were heard from all parties
interested in or affected by this Ordinance; and,
WHEREAS, the vote of the Richmond Advisory Plan Commission was
,? to D in favor of/in opposition to recommending the
passage of Ordinance No. B-1991.
NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of
Richmond, Indiana as follows:
SECTION 1. That the zoning classification of the property described
below, and the same is hereby changed to M-1 Light Industrial
District and that said property be regulated in accordance
with the Zoning Ordinance of the City of Richmond, Indiana
and all amendments thereto.
A part of the southeast quarter of Section 8, Township 13,
Range 1 west: Commencing at a point in the north line of the
southeast quarter of Section 8, Township 13, Range 1 west
five hundred eighty-six and six hundredths (586.06) feet east
of the northwest corner of said quarter section said point
being the northeast corner of Lot No. 28 in Joseph Dickinson's
Addition to the City of Richmond, and running thence south
along the east line of said Lot 28, Seven hundred fifty-two
and four tenths (752.4) feet to the southeast corner thereof;
thence west Three hundred thirty-four and nine hundredths
(334.09) feet to an iron stake, said stake being Eighteen (18)
feet to an iron stake, said stake being eighteen (18) feet east
of the southwest corner of Lot 33 of said Joseph Dickinson's
Addition; thence north Seven hundred fifty-two and four
tenths (752.4) feet to the north line of said section; thence
east Three hundred thirty-three and sixty-four hundredths
(333.64) feet to the place of beginning, containing Five and
seventy-six hundredths (5.76) acres more or less.

SECTION 2. This Ordinance shall be in full force and effect from and
after its passage and approval as by law aquired.

Dear Mrs. Hutton, Members of Common Council and
Mrs. Merchanthouse:
The Richmond Advisory Plan Commission conducted a public hearing on
Tuesday, February 26, 1991, on the petition of Richmond Power and Light,
owner; requesting a rezoning from R-3 One to Eight Family Residence
District to M-1 Light Industrial District; on property located at 401 South
Q Street.
The property in question consists of 6 lots located on the south side of
South Q Street in the 400 block. The lots in question are 752' deep and are
divided by a zoning boundary line running east and west. The first 150'
running from South Q Street is zoned R-3 the last 602' is zoned M-1. The
petition is requesting that the entire property be zoned M-1 to enable the
City of Richmond to establish a new central garage facility. The garage
would house the City Street Department, Police Department and Public
Transit. However, if the rezoning is approved, any use permitted in the M-
1 District could be established on the property.
Twenty seven (27) notices of public hearing were sent to the residents
surrounding the site. One (1) notice was returned to the Plan Department
in favor of the petition. Two (2) notices were returned to the Department
in opposition to the petition. During the public hearing, seven (7) persons

spoke in opposition to the petition citing their concerns about the
potential decrease in property values and the increase in traffic.
Five (5) Plan Commission members abstained from voting on the petition
because of a potential conflict of interest either because of an
association with the City or because membership in lodges that own
adjoining property.
The Commission determined that the property in question is located in an
area of mixed zoning and land use. A unique situation exists with the
property in question and neighboring properties in that they are divided by
a zoning boundary line. The requested rezoning would not be expected to
harm adjacent property values because those properties are either zoned IV
1 or have a portion of the property zoned M-1. The rezoning would be
compatible with other existing land uses in the area and is a logical
extension of the existing M-1 District.
The Plan Commission voted three (3) to zero (0) to recommend to Council
that Ordinance No. 8-1991 be adopted.

Request: rezoning from R-3 to M-1. The City of Richmond is proposing to
purchase property from RP&L to be used to establish a central
maintenance garage. The property in question is zoned M-1 and R-3. The R
3 portion of the property is the frontage adjacent to South Q Street. The
residential zoning does not permit a garage operation and does not permit
a driveway to be constructed to access the industrially zoned property. If
the rezoning is approved, the entire area of the property could be used for
a central garage. However, the change in zoning would allow any use
permitted in the M-1 Zoning District.
