HomeMy Public PortalAbout009-1991 - ORDINANCE AMENDING CHAP 154 OF THE MUNICIPAL CODE PRORDINANCE NO.9-1991 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO.2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 411 NORTH 10TH STREET FROM M-1 LIGHT INDUSTRIAL DISTRICT TO R-4 MULTI -FAMILY RESIDENCE DISTRICT. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as M-1 Light Industrial District the property located at 411 North 10th Street; and, WHEREAS, it is the intent and purpose hereof, to change the zoning classification of said property from M-1 Light Industrial District to R-4 Multi -Family Residence District; and, WHEREAS, a study of this Ordinance was conducted by the Richmond Advisory Plan Commission the cea-day of ,1991, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond Advisory Plan Commission was 8 to O in favor of/in opposition to recommending the passage of Ordinance No. 9-1991. NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to R-4 Multi -Family Residence District and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. Lots Numbered 304, 305 and 306 in Elizabeth Starr's Addition to the City of Richmond; and also 13.5 feet in width off the entire west side of Lot Number 307 in Elizabeth Starr's Addition to the City of Richmond; and also Lots Number 332, 334, 335, 336, and 337 in Elizabeth Starr's Addition to the City of Richmond, except 40 feet in width off of the entire north end of said Lots. SECTION 2. This Ordinance shall be in full force and effect from and after its passage and approval as by law aquired. Stamper, owner; requesting a rezoning from M-1 Light Industrial District to R-4 Multi - Family Residence District; on property located at 411 North 10th Street. The property in question consists of the former Atlas Underware Building located at North 10th and D Streets and a parking area located north of the building. The owner has a plan to convert the building to an apartment building for the elderly. The present zoning classification precludes residential uses. Forty (40) notices of public hearing were sent to the residents surrounding the site. Four (4) notices were returned to the Plan Department in favor of the petition. One (1) notice was returned to the Department in opposition to the petition. During the public hearing, no one spoke in opposition to the petition. The Commission determined the requested rezoning is compatible with the surrounding land use and zoning. The proposed adapted reuse of the existing building would represent a positive step for the surrounding Ordinance No. 9-1991 Page 2 neighborhood and City in general. The Police Department, Fire Department and Sanitary District reveiwed the petition and no problems have been identified. The Plan Commission voted eight (8) to zero (0) to recommend to Council that Ordinance No. 9-1991 be adopted. Respectfully submitted, S- Daniel S.
