HomeMy Public PortalAbout012-1991 - REZONING - 2800 BLK OF UNION PIKE ON THE EASTSIDE.pdAMENDED ORDINANCE NO. 12-1991 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO.2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY LOCATED IN THE 2800 BLOCK OF UNION PIKE, ON THE EAST SIDE, FROM R-2 SINGLE FAMILY RESIDENCE AND 0-1 GREENBELT DISTRICT TO M- 2 GENERAL INDUSTRIAL DISTRICT. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as R-2 Single Family Residence District and 0-1 Greenbelt District the property located in the 2800 block of Union Pike, on the east side; and, WHEREAS, it is the intent and purpose hereof, to change the zoning classification of said property from R-2 Single Family Residence District and 0-1 Greenbelt District to M-2 General Industrial District; and, WHEREAS, a study of this Ordinance was conducted by the Richmond Advisory Plan Commission the day of ,1991, at which time remonstrances were heard from all p rties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond Advisory Plan Commission was - to 0, in favor of/in opposition to recommending the passage of Amended Ordinance No. 12-1991. NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to M-2 General Industrial District and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. Being a part of the Northwest Quarter of Section 20, Township 14 North Range 1 West in Wayne Township, Wayne County, Indiana, and being more particularly described as follows: Beginning at a point in the west line of the Northwest Quarter of said Section 20, said point being 325.00 feet north 0 degrees 31 minutes and 00 seconds west of a railroad spike at the southwest corner of said Northwest Quarter, and running thence north 0 degrees, 31 minutes and 00 seconds west, along said west line, 342.71 feet to a point; thence north 89 degrees, 33 minutes and 00 seconds east, 499.58 feet to a point; thence north 0 degrees, 00 minutes and 42.1 seconds west, 776.75 feet to a point on the south right-of-way of Interstate Highway Number 70; thence the following courses and distances along the south right-of-way of said Highway, north 76 degrees, 26 minutes and 07.3 seconds east, 4.46 feet to a point; thence north 78 degrees, 47 minutes and 38.4 Amended Ordinance No. 12-1991 Page 2 seconds east, 297.89 feet to a point; thence north 74 degrees, 37 minutes and 11.9 seconds east, 207.00 feet to a point; thence north 79 degrees, 32 minutes and 18.9 seconds east, 294.96 feet to a point; thence leaving said right-of-way, south 00 degrees, 53 minutes, and 00 seconds east, 1,596.62 feet to a point on the south line of said Northwest Quarter; thence south 89 degrees, 10 minutes and 32.3 seconds west, along said south line, 799.48 feet to a point; thence north 40 degrees, 09 minutes and 43.5 seconds west, 72.99 feet to a point; thence north 3 degrees, 18 minutes and 15 seconds east, 267.99 feet to a point; thence south 89 degrees, 18 minutes and 36.6 seconds west, 473.35 feet to the place of beginning, containing an area of 31.914 acres. SECTION 2. This Ordinance shall be in full force and effect from and after its passage and approval as by law aquired. Mayor ATTEST: City Cle c RICHMOND ADVISORY PLAN COMMISSION RICHMOND, INDIANA June 20, 1991 Mrs. Sally Hutton, President Members of Common Council and Mrs. Mary Merchanthouse, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 12-1991 Plan Commission Case PC-91-9 Dear Mrs. Hutton, Members of Common Council and Mrs. Merchanthouse: The Richmond Avisory Plan Commission conducted public hearing on Tuesday, April 23, 1991 and May 28, 1991 on the petition of Nicholas Delucio, owner; Robert Bever, agent; requesting a rezoning from R-2 Single Family Residence District and 0-1 Greenbelt District to M-2 General Industrial District, on property located in the 2800 block of Union Pike, on the east side. The property in question consists of approximately 31 acres owned Nick Delucio. The property is bounded by 1-70 on the north and Union Pike on the west. The property is presently vacant. The petition indicates the rezoning is requested to enable the location of advertising signs and for future industrial development. The Richmond Sanitary District, the Traffic Division of the Police Department and the Fire Department have reviewed the petition and have not identified any concerns. Twenty-nine (29) notices of public hearing were sent to the residents surrounding the site. Four (4) notices were returned to the Plan Department not oppossed to the petition. During the public hearing, no one spoke in opposition to the petition. Also during the public hearing, the petitioner requested that the petition be amended to reduce the area originally requested to be rezoned. The request was made in order to preserve a larger area of the 0-1 Greenbelt rezoning adjacent to the Whitewater River. Ordinance 12-1991 Page 2 The Plan Commission considered the following: (a) the comprehensive plan indicates that the land use for the property in question should be industrial; (b) the property in question is adjacent to 1-70 which is a locational advantage for many types of industrial land uses; (c) the residential uses located west of the property along Union Pike are already zoned industrial so that a negative impact on property values would not be anticipated; (d) the subject property is a part of the overall northwest area of the City reserved for future industrial growth and existing industrial zoning is located on the south and west. The Plan Commission accepted the petitioner's request to amend the petition. This amendment necessitates an amendment to the legal description presently written in Ordinance 12-1991. The Plan Commission voted seven (7) to two (2) to recommend to Council that Ordinance No.12- 1991 be amended by inserting the correct legal description and that Amended Ordinance No. 12-1991 be adopted.
