A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD
AUTHORIZING AN EMPLOYMENT AGREEMENT WITH RAUL GODINEZ AS AN
INTERIM APPOINTED RETIRED ANNUITANT TO THE VACANT POSITION OF
INTERIM PUBLIC WORKS DIRECTOR FOR THE CITY OF LYNWOOD UNDER
GOVERNMENT CODE SECTION 212221(H), EFFECTIVE SEPTEMBER 4, 2019.
WHEREAS, in compliance with Government Code §7522.56, the City Council of
the City of Lynwood may not retain a retired annuitant prior to 180 days from the date of
that employee's retirement date; and,
WHEREAS, Raul Godinez retired from the City of Santa Ana effective February 3,
2019, 213 days prior to the effective date of the Employment Agreement; and,
WHEREAS, the City Council of the City of Lynwood hereby appoints Raul Godinez
as an interim appointed retired annuitant to the vacant position of Interim Public Works
Director for the City of Lynwood pursuant to Government Code §21221 (h), effective
September 4, 2019; and,
WHEREAS, an appointment under Government Code §21221(h) requires an
active, publically posted recruitment for a permanent replacement; and,
WHEREAS, the City of Lynwood posted the recruitment for the Public Works
Director on August 22, 2019, and it is posted on the City's website; and,
WHEREAS, a §21221 (h) appointment may only be made once and therefore, will
last no longer than June 30, 2020; and,
WHEREAS, no matters, issues, terms, or conditions related to this employment
and appointment have been or will be placed on the consent calendar; and,
WHEREAS, the employment shall be limited to 960 hours per fiscal year; and,
WHEREAS, the compensation to be paid to retiree cannot be less than the
minimum, and may not exceed the maximum, monthly base salary paid to other
employees performing comparable duties pursuant to a publically posted pay schedule,
divided by 173.333 to equal the hourly rate; and,
WHEREAS, as of July 1, 2019, the maximum and minimum base salary rate for
this position is $13,886.67 per month and the hourly equivalent is $80.00; and,
WHEREAS, the hourly rate paid to Raul Godinez will be $80.00; and,

WHEREAS, Raul Godinez has not and will not receive any other benefit, incentive,
or compensation in lieu of benefit of other form of compensation in addition to the hourly
pay rate; and,
NOW, THEREFORE, THE LYNWOOD CITY COUNCIL DOES HEREBY
RESOLVE AND DETERMINE AS FOLLOWS:
Section 1. That the City Council of the City of Lynwood certifies the nature of
the appointment of Raul Godinez as described herein and detailed in the attached
employment services agreement.
Section 2. That the appointment is necessary to fill the critically needed position
of Director of Public Works for the City of Lynwood in order to provide continuity of
leadership for the Public Works Department throughout the recruitment and selection
process for a new Director of Public Works, to provide the special skills required by the
position, and to prevent a stoppage of related public business.
Section 3. That the City Council of the City of Lynwood authorizes the Mayor or
designee to execute an employment services agreement with Raul Godinez.
Section 4. That this Resolution is to be given effect upon its adoption by the City
Council of the City of Lynwood and execution of the same by the appropriate parties.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the City Council of the
City of Lynwood, California this 3rd day of September 2019.
