HomeMy Public PortalAbout2015-08-04 ZBA minutes Zoning Board of Appeals August 4, 2015 Chairman Sobkoviak called the Zoning Board of Appeals meeting to order at 7:00 p.m. and led the pledge to the flag. ROLL CALL Commissioners Seggebruch, Renzi, Heinen, Green, Paris and Chairman Sobkoviak were present. Commissioner Kiefer was absent. The Fire, Park, School, and Library Districts were absent. PUBLIC COMMENTS: There was no response. The Zoning Board of Appeals minutes dated July 7, 15 were accepted as presented. DEVELOPMENT REPORT Mr. Garrigan stated the Village Board approved the site plan review for the addition for the Edward South Medical Office Building. NEW BUSINESS Case No. 1692-062915.V 12709 S Shelly Lane – fence variance Mr. Proulx stated this is a public hearing for a fence variance; the appropriate notices have been published in accordance with state statute and local ordinance. The property is located at southeast corner of Shelly Lane and 127th Street backing up to Heggs Road. Mr. Proulx described the location of the proposed black vinyl coated chain link fence in the corner side yard on the inside of the extensive landscaping and berm along 127th. Mr. Proulx reviewed the 4 findings of fact. With regard to a) Staff submits the proposed fencing would be consistent with the purpose and intent of the zoning code and the fence would have limited visibility due to the existing berm and landscaping. With regard to b) Staff submits that the proximity of the home to 127th Street and Heggs Road differentiate this request from others. With regard to c) strict enforcement of the fence regulations would dramatically reduce the area available to be enclosed by the fence. With regard to d) Staff believes the variance will not have any negative impact to the character of the neighborhood and the fence would be placed on the private side of the existing landscaping. Staff is seeking input from the Commissioners on the fence material; and suggests a favorable recommendation. Chairman Sobkoviak swore in Bryan Jenkins, owner of said property. Mr. Jenkins described the proposed type and location of the 5 foot fence; indicated there are 5 lots on Shelly Lane that have the vinyl coated chain link fence; indicated wood fences create a huge maintenance issue. Chairman Sobkoviak asked for public comments. There was no response. Commissioner Heinen asked about jurisdiction of 127th and Heggs Road; asked if additional right of way would be needed in the future. Mr. Proulx stated the jurisdiction of these roads would be Plainfield. Zoning Board of Appeals Minutes August 4, 2015 Page 2 of 2 Mr. Garrigan stated the Village has a grant to improve 127th from Route 30 to Heggs next year to a three lane profile; explained 127th is proposed as a major collector. Commissioner Heinen asked if the fence line would line up with the fence along Shenandoah subdivision. Mr. Jenkins indicated his fence would be placed 15 or 20 feet inside of the fence line at Shenandoah subdivision; described the fence to the directly to the south as a 4 foot picket fence; explained this proposed fence would connect to the picket fence to the south. Some Commissioners agreed with the use of the vinyl coated fence as there were several vinyl coated fences already in the subdivision. Several Commissioners felt the black vinyl coated chain link fence would not be noticeable with the extensive landscaping and berm. Commissioner Green asked if the fence would create any sight line issues. Commissioner Seggebruch agreed this was a unique lot; asked if the applicant looked at different materials. Mr. Jenkins stated other fence materials could cost $20,000 more. Commissioner Renzi made a motion to adopt the findings of fact of staff as the findings of fact of the Zoning Board of Appeals recommend approval of a variance to permit a fence within the corner side yard for the property located at 12709 S Shelly Lane. Seconded by Commissioner Paris. Vote by roll call: Seggebruch, yes; Heinen, yes; Green, yes; Paris, yes; Renzi, yes; Sobkoviak, yes. Motion carried 6-0.
