HomeMy Public PortalAbout051-1991 - ORDINANCE AMENDING CHAP 154 OF THE MUNICIPAL CODE REORDINANCE NO. 51-1991 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO.2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY LOCATED IN THE 1300 AND 1400 BLOCKS OF SOUTH 9TH STREET, ON THE EAST SIDE, FROM C-2 COMMERCIAL DISTRICT TO C-4 GENERAL BUSINESS DISTRICT. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as C-2 Commercial District the property located in the 1300 and 1400 blocks of South 9th Street, on the east side; and, WHEREAS, it is the intent and purpose hereof, to change the zoning classification of said property from C-2 Commercial District to C-4 General Business District; and, WHEREAS, a study of this Ordinance was conducted by the Richmond Advisory Plan Commission the day of ,1991, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond Advisory Plan Commission was to in favor of/in opposition to recommending the passage of Ordinance No. 51-1991. NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to C-4 General Business District and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. Lots Numbers, 2, 3, 4 and 5 in Edgar F. Doren's Addition to the City of Richmond. Also; a part of Lot Number Thirty -Five (35) in the plat of Greenwood as laid out by James W. Salter, now a part of the City of Richmond, Indiana and being a part of the Northwest Quarter of Section Nine (9), Township Thirteen (13), Range One (1) West, and more particularily described as follows: Beginning at the northeast corner of the Boston Pike (also known as South 9th Street) and South O Street , formerly known as South Avenue; thence north 119.78 feet along the east line of South 9th Street; thence east 284.50 feet to South 10th Street; thence south 119.78 feet to South O Street; thence west 284.50 feet to the place of beginning. Also; a part of Lot Number Thirty -Five (35) in the plat of Greenwood as laid out by James W. Salter, now a part of the City of Richmond, Indiana and being a part of the Northwest Ordinance No. 51-1991 Page 2 Quarter of Section Nine (9), Township Thirteen (13), Range One (1) West, and more particularily described as follows: a parcel measuring 89.5' x 149.5' and a parcel measuring 44.7' x 149.5' . Also; a part of Lot Number Nineteen (19) in the plat of Greenwood as laid out by James W. Salter, now a part of the City of Richmond, Indiana and being a part of the Northwest Quarter of Section Nine (9), Township Thirteen (13), Range One (1) West, and more particularity described as follows: a parcel consisting of .288 acre; a parcel consisting of a .333 acre and a parcel consisting of .51 acre. SECTION 2. This Ordinance shall be in full force and effect from and after its passage and approval as by law aquired. When the public hearing was conveined, neither the owners or agent were present to represent the petition. The Plan Commission voted six (6) to two (2) to strike the petition from its Agenda for lack of prosecution and to recommend to Common Council that Ordinance No. 51-1991 be stricken.
