HomeMy Public PortalAbout057-1991 - ORDINANCE AMENDING CHAP 154 OF THE MUNICIPAL CODE FOORDINANCE NO. 57-1991 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO.2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 1751 SHERIDAN STREET, FROM M-2 GENERAL INDUSTRIAL DISTRICT TO M-2SU GENERAL INDUSTRIAL SPECIAL USE DISTRICT AND AUTHORIZING THE SPECIAL USE OF SAID PROPERTY FOR THE ESTABLISHMENT OF A PHYSICAL FITNESS FACILITY. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as M-2 General Industrial District the property located at 1751 Sheridan Street; and, WHEREAS, it is the intent and purpose hereof, to change the zoning classification of said property from M-2 General Industrial District to M-2SU General Industrial Special Use District and to authorize the specal use of said property for the establishment of a physical fitness facility; and, WHEREAS, a study of this Ordinance was conducted by the Richmond Advisory Plan Commission the ;� ;� day of (� 6 ,1991, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond Advisory Plan Commission was_9 to o in favor of/i recommending the passage of Ordinance No. 57-1991. NOW THEREFORE BE IT ORDAINED BY the Common Council of the. City of Richmond, Indiana as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to M-2SU General Industrial Special Use District and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. Part of the Northwest and Southwest Quarters of Section 29- 14-1. SECTION 2. That as provided in Articles 35 and 48 of Chapter 154 of the Code of Ordinances, the following described use of the above described property is allowed for the establishment of a phyyical fitness facility. SECTION 3. That as a condition of being granted the special use and as an additional restriction on said use, the following requirements shall hereafter and at all times be met by the owner of said real estate. A. The Special Use site plan and petition shall be marked Exhibit A and made a part of this Ordinance. Ordinance No. 57-1991 Page 2 SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval as by law aquired. Mayor ATTEST:2494 City Clerk RICHMOND ADVISORY PLAN COMMISSION RICHMOND, INDIANA October 31, 1991 Mrs. Sally Hutton, President Members of Common Council and Mrs. Mary Merchanthouse, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 57-1991 Plan Commission Case PC-91-25 Dear Mrs. Hutton, Members of Common Council and Mrs. Merchanthouse: The Richmond Avisory Plan Commission conducted a public hearing on Tuesday, October 22, 1991, on the petition of Sanyo Industries, owner; Carla Maurer, agent; requesting a rezoning from M-2 General Industrial District to M-2SU General Industrial Special Use District and also requesting special use autthorization for a physical fitness facility on property located at 1751 Sheridan Street. The property in question consists of Sanyo's east manufacturing and warehouse building located at 1751 Sheridan Street and zoned M-2 General Industrial District. The M-2 District regulations provide that retail, service or office uses may be located in an industrial zoning district only through special use rezoning when it is demonstrated that the proposed special use is necessary to serve an industrial need. The rationale for this provision is that the infrastructure in an industrial area is generally developed at large capacities to serve industrial uses. Therefore, allowing commercial uses in industrial areas would constitute an under - utilization of the infrastructure and a waste of community resources. The petition is requesting a rezoning to the special use district to allow a physical fitness facility that would be for the benefit of Sanyo employees, employees of other industrial firms in the area, as well as the general public. Ordinance No. 57-1991 Page 2 Five (5) notices of public hearing were sent to the property owners surrounding the site. No notices were returned to the Plan Department. During the public hearing, no one spoke in opposition to the petition. The Plan Commission determined that the petition complies with the requirements of the Zoning Ordinance and voted nine (9) to zero (©) to recommend to Council that Ordinance No. 57-1991 be adopted.
