AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING
ORDINANCE NO.2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE
OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF
PROPERTY GENERALLY BOUND BY INTERSTATE 70, SALISBURY ROAD, GAAR
JACKSON ROAD AND ROUND BARN ROAD NORTH, FROM A-1 AGRICULTURAL
DISTRICT TO M-2 GENERAL INDUSTRIAL DISTRICT.
WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968
designates and describes as A-1 Agricultural District the
property generally bound by Interstate 70, Salisbury Road,
Gaar Jackson Road and Round Barn Road North; and,
WHEREAS, it is the intent and purpose hereof, to change the zoning
classification of said property from A-1 Agricultural
District to M-2 General Industrial District; and,
WHEREAS, a study of this Ordinance was conducted by the Richmond
Advisory Plan Commission the day of ,1991, at
which time remonstrances were heard from all parties
interested in or affected by this Ordinance; and,
WHEREAS, the vote of the Richmond Advisory Plan Commission was
to in favor of/in opposition to recommending the
passage of Ordinance No. 62-1991.
NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of
Richmond, Indiana as follows:
SECTION 1. That the zoning classification of the property described
below, and the same is hereby changed to M-2 General
Industrial District and that said property be regulated in
accordance with the Zoning Ordinance of the City of
Richmond, Indiana and all amendments thereto.
Tract 1:
The following described real estate in Wayne County, Indiana
being part of the Northwest Quarter of Section 10, Township
16, Range 14 East and the Southwest Quarter of Section 3,
Township 16, Range 14 East and the Southeast Quarter of
Section 3, Township 16, Range 14 East and being more
particularily described as follows:
Commencing at the intersection of the east line of the
Northwest Quarter of Section 10, Township 16, Range 14 East
with the centerline of Gaar Jackson Road; and running west
along the centerline of Gaar Jackson Road to its intersection
with the centerline of Round Barn Road North; and running
thence north along the centerline of Round Barn Road North to
its intersection with the south right-of-way line of Interstate
70; and running thence northeastwardly along the south right
-of-way line of Interstate 70 to its intersection with the
centerline of Salisbury Road; and running thence south along

the centerline of Salisbury Road to its intersection with the
south line of the Southeast Quarter of Section 3, Township 16,
Range 14 East; and running thence west along the south line of
the Southeast Quarter of Section 3, Township 16, Range 14
East to the northeast corner of the Northwest Quarter of
Section 10, Township 16, Range 14 East; and running thence
south along the east line of the Northwest Quarter of Section
10, Township 16, Range 14 East to the point of beginning.

Being a part of the Northeast Quarter of Section 10, Township
16 North, Range 14 East in Center Township, Wayne county,
Indiana, and being more particularly described as follows:
Beginning at the northeast corner of the Northeast Quarter of
Section 10, Township 16, Range 14 East; thence south 75.39
rods to an iron pin (witnessed by a walnut 12 in. in diameter, N.
23 deg. 40' east 35 links); thence west 106.06 rods; thence
north 75.39 rods; thence east 106.44 rods to the beginning,
containing 50.175 acres, more or less.
TRACT 3:
Being a part of the Northeast Quarter of Section 10, Township
16 North, Range 14 East in Center Township, Wayne county,
Indiana, and being more particularly described as follows:
Beginning at an iron rod on the east line of the Northeast
Quarter of said Section 10, said point being 796.30 feet north
of a Copperweld Monument at the southeast corner of the
Northeast Quarter of said Section 10, (assuming said east line
runs north and south), and running thence, from said beginning
point, north 89 degrees and 50 minutes west, 1164.84 feet to
an iron pipe found; thence north 0 degrees and 34 minutes
east, 610.76 feet to a fence corner post; thence south 89
degrees and 50 minutes east, 729.06 feet to an iron pipe set;
thence south 0 degrees and 36 minutes east, along an existing
fence, 209.20 feet to an iron pipe set in an existing fence;
thence north 89 degrees, 38 minutes and 45 seconds east,
along an existing fence, 427.56 feet to an iron rod on the east
line of said Northeast Quarter; thence south, along said east
line, 405.46 feet to the place of beginning, containing an area
of 14.251 acres.
TRACT 4:
Being a part of the Northeast Quarter of Section 10, Township
16 North, Range 14 East in Center Township, Wayne County,
Indiana, and being more particularly described as follows:
Beginning at an iron rod set in the east line of the Northeast
Quarter of said Section 10, said point being 1201.86 feet north

of a Copperweld monument at the southeast corner of said
Northeast Quarter, (assuming the said east line runs north and
south), and running thence, from said beginning point, south 89
degrees, 38 minutes and 45 seconds west, along an existing
fence; 427.56 feet to a wood fence post in an existing fence;
thence north 0 degrees, 36 minutes and 00 seconds west, along
an existing fence, 209.20 feet to an iron pipe set; thence south
89 degrees, 50 minutes and 00 seconds east, 429.74 feet to an
iron rod found in the east line of said Northeast Quarter;
thence south, along the said east line 205.29 feet to the place
of beginning, containing an area of 2.039 acres.
TRACT 5:
Also a part of the Northeast Quarter of Section Ten (10),
Township Sixteen (16) North, Range Fourteen (14) East and
bounded as follows. Beginning at the northwest corner of said
quarter section running thence south one hundred and twenty
rods, thence east fifty-three and one third (53 1/3) rods,
thence north one hundred and twenty (120) rods to the north
line of said quarter thence west fifty-three and one third
(531/3) rods to the place of beginning containing forty (40)
acres more or less.
TRACT 6:
A part of the Northeast Quarter of Section Ten (10) Township
Sixteen (16) Range Fourteen (14) east. Beginning at the
southwest corner of said quarter section, thence east eighty
and six tenths (80.06) rods; thence north thirty nine and seven
tenths (39.7) rods; thence west eighty and three tenths (80.3)
rods to the place of beginning.

Part of the Northeast Quarter of Section 10, Township 16,
Range 14 East, bounded as follows, to -wit: Beginning at a
point thirty nine and seventy four (39.74) rods north of the
south line of said quarter section and One Hundred and six and
ninety six (106.96) hundredths rods west of the east line of
said section, running thence north 0 degrees and 35 minutes
east four and sixty five (4.65) rods to a stake in the south line
of the right of way of the P.C.C. & St. L. Railroad; thence south
63 degrees 24 minutes east along the south line of said right
of way ten and forty eight (10.48) rods to a stake; thence west
nine and sixty seven (9.067) thousandths rods to the place of
beginning, containing 0.13 of an acre.
ALSO Beginning at a point eighty five and thirty five (85.35)
Hundredths rods north of the south line of said quarter section
and One Hundred and six and eighty five (106.85) Hundredths
rods west of the east line of said section, running thence East
thirty six and fifty seven (36.57) Hundredths rods to a piece of

iron gas pipe; thence south 0 degrees 35 minutes west Fifty
five and fifty two (55.52) Hundredths rods to the north line of
said right of way, to a piece of iron gas pipe; thence north 63
degrees 24 minutes west along the north line of said right of
way eleven and twenty seven (11.27) Hundredths rods to a
stake; thence north 0 degrees 35 minutes east four and nine
Hundred and thirty three (4.933) thousandths rods to a stake;
thence west nine and thirty Nine (9.39) Hundredths rods to a
stake on the northline of said right of way; thence north 63
degrees 24 minutes west along the north line of said right of
way nineteen and twenty se (19.27) Hundreths rods to a piece
of iron gas pipe, thence north along the east line of Kempton's
land Thirty six and eighty five (36.85) Hundredths rods to the
place of beginning, containing 10.41 acres.
SECTION 2. This Ordinance shall be in full force and effect from and
after its passage and approval as by law aquired.
PASSED AND ADOPTED by the Common Council of the City of Richmond,

COPY TO:
Petitioner: Richmond Advisory Plan Commission.
Request: a rezoning from A-1 to M-2 for property located in the 2-mile
fringe area and owned by the State of Indiana and 3 other private
individuals. The area in question is needed for industrial development and
is considered to be one of the prime areas available for future industrial
growth. The area has frontage on 1-70 and is served by rail. The Land Use
component of the Comprehensive Plan indicates the area should be
industrial.
Location: the property generally bound by Interstate 70, Salisbury Road,
Gaar Jackson Road and Round Barn Road North.
