HomeMy Public PortalAbout063-1991 - GENERAL ORDINANCE AMENDING CHAP 91 OF THE RICHMOND CORDINANCE 63-1991 A GENERAL ORDINANCE AMENDING CHAPTER 91 OF THE RICHMOND CITY CODE CONCERNING THE REGISTRATION AND CONTROL OF ANIMALS Be enacted by the Common Council, the City of Richmond: Section 1 That Sections 91.01(G), 91.02, and 91.03 of the Richmond City Code be amended to change all references to "Dog" or "Dogs" to "Dog or Cat" and "Dogs or Cats", respectively. Section 2 That Section 91.02 (a) of the Richmond City Code be amended as follows: No person shall own, keep or harbor a dog or cat within the City limits unless such dog or cat is registered as herein provided. Application for such registration shall be made to any of the following: City Controller; veterinarians registered for this purpose with the City Controller; the animal shelter that has the sheltering contract with the City; pet shops registered for this purpose with the City Controller, or any animal sheltering facility registered for this purpose with the City Controller, and shall state the name, address, and telephone number of the owner, and the name, breed, color, age and sex of the dog or cat. The registration fee shall be paid at the time of making application, a numbered receipt given to the applicant, and a numbered tag shall be issued to the owner. Section 3 That Section 91.02 (b) be amended as follows: The yearly registration fee shall be $4.00. The registration entities other than the City Controller mentioned in the preceding section who collect registration fees may retain $1.00 for each registration to defray their costs. 1 Section 4 That Section 91.05 (A) be amended as follows: Dogs found at large shall be apprehended by the Animal Control Officer and impounded in the Animal Shelter, and there confined in a humane manner for a period of not less than five (5) days, and may thereafter be disposed of in a humane manner if not claimed by their owners. Dogs not claimed by their owners before the expiration of five (5) days shall become the property of the Animal Shelter and be disposed of at the discretion of the said authority, except as hereinafter provided in cases of certain dogs and other animals. The animal shelter shall not release any dog to its owner until the owner has provided proof of compliance with Section 91.02. The Animal Control Officer shall contact the owner of any tagged animal by telephone within 48 hours of picking up such animal or mail a letter to the registered owner, if unable to reach such owner by telephone, within 60 hours of picking up such animal. Section 5 That a new Section 91.18 of the Richmond City Code be added as follows: 91.18 (a) Establishment of Fund There is established an animal control fund, which is established as a non -reverting fund for the animal control program of the City. 91.18 (b) Sources Sources of revenue for the animal control fund shall be: 1. Funds received f om the ' —_—In' registration fees of dogs and cats, 2. Funds received as a result of fines imposed for the violation of Chapter 91 of the Richmond City Code, 3. Specific appropriations by the City. 91.18 (c) Purpose The purposes for which funds may be expended are limited to: 1. Funding of the salary of the animal control officer, 2 2. Purchase of materials, supplies, and services for the use and benefit of the City animal control program. 3. Funding of the animal shelter contract. 91.18 (d) Disbursement Procedures The City Controllers Office shall adopt accounting and disbursement procedures in accordance with regulations and guidelines of the State Board of Accounts to control and account for the receipt and disbursement of monies from this fund. Section b That Section 91.13 of the Richmond City Code be amended as follows: Any person violating any of the provisions of this ordinance shall be subject to a fine of $10.00 for the first offense and $25.00 for each subsequent offense. The fine shall be payable in the office of the City Clerk. Failure to remit the fine within ten days shall result in an issue of summons for the violation in court.
