HomeMy Public PortalAbout074-1991 - ORDINANCE AMENDING CHAP 120 OF THE RICHMOND CITY CODAN ORDINANCE AMENDING CHAPTER 120 OF THE RICHMOND CITY CODE, BURGLAR AND ROBBERY ALARM SYSTEMS, TO INCLUDE NEW SECTIONS ON FIRE ALARM SYSTEMS BE IT ORDAINED by the Common Council of the City of Richmond: Section 1. That the title of Chapter 120 of the Richmond City Code be amended to read as follows: Burglar, robbery and fire alarm systems. ,qRglion 2: That Sections 120.01 through 120.19 of the Richmond City Code be denoted with the subtitle "Burglary and Robbery Alarm Systems." Section 3: That new Sections under the title Excessive False Fire Alarm Signals be added to Chapter 120 of the Richmond City Code as follows: Section 120.20 No person shall allow, cause or fail to prevent the transmission by automatic fire detection system used by him or any system serving a premises occupied and controlled by him of more than three false alarm signals within any twelve month period. An alarm triggered by electrical thunderstorms or other inclimate weather shall not be considered a false alarm. Section 120.21 The Administrative Office of the Richmond Fire Department or the Fire Prevention Chief shall keep current records of all violations. Section 120.22 P,gnalty For a response to excessive false alarm signals of the Fire Department, the following fines shall be assessed: a. One Hundred Dollars ($100.00) for the first false alarm fire signal in excess of three false alarm signals in any twelve month period. b. Two Hundred Dollars ($200.00) for the second false alarm signal in excess of three false alarm signals in any twelve month period. C. Three Hundred Dollars ($300.00) for the third and each successive false alarm signal in excess of three in any twelve month period. The provisions of this Section shall not apply for a period of three months from the date an automatic fire detection system is initially installed. STICCO, FIRE CHIEF FRANK H. WALTERMANN MAVOP JAMES A. STICCO CHIEF SUBJECT: REASONS A FALSE ALARM ORDINANCE IS NEEDED DATE: NOVEMBER 25, 1991 1. It's mandatory in the Uniform Fire Code a) Section 14.105; Maintenance 1) Section 14.105(a)--All fire detection systems and alarm systems shall be maintained in working order. b) Certain occupancies in the Richmond Fire Departments run district are required to have automatic fire detection systems installed and continuously maintained in reliable operating condition at all times in accordance with the above codes. 2. A reasonable regulation of alarms should result in a significant decrease in false alarms with a resultant saving in public resources. a) Certain occupancies within our protection area have developed a history of transmitting false fire alarm signals which we must respond to. 1) Apparatus response is a minimum of 3 Engines, 1 Truck and 1 Rescue. b) The frequent response of emergency fire equipment and personnel to false fire alarms creates an unnecessary expenditure of public funds. 3. The response of Fire Department apparatus to false fire alarms effectively removes the apparatus from the service of protecting life and other properties from the danger of fire or other incidents during the response period required. 4. Apparatus on emergency response situations are "at risk" while on the streets. We have addressed accident prevention with an SOP on Driving Safety. a) The emergency response of Fire Department apparatus to false fire alarms upon the streets of our protection area exposes the general public and the Fire Department personnel and equipment to the possibility of accidental injury or death and property damage. 5. It is feared that the occupants of a building who have been frequently forced to evacuate a building because of a false alarm may become complacent and fail to evacuate in a real incident, which could lead to personal bodily injury or death.
