AN ORDINANCE AMENDING ORDINANCE NO.7-1984 AND GRANTING
PRELIMINARY APPROVAL TO A RESIDENTIAL DEVELOPMENT UNIT PROJECT
IN A C-2SU COMMERCIAL SPECIAL USE DISTRICT AND A R-2 SINGLE FAMILY
RESIDENCE DISTRICT ON PROPERTY LOCATED EAST OF ENGLE DRIVE,
PURSUANT TO ARTICLES 45 AND 48 OF CHAPTER 154 OF THE CODE OF
ORDINANCES, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY
OF RICHMOND, INDIANA.
WHEREAS, Ordinance No. 7-1984 rezoned property located east of Engle
Drive to C-2SU and provided for the special use of said
property as a commercial development unit project; and,
WHEREAS, it is the intent and purpose hereof to amend Ordinance No. 7-
1984 by granting preliminary approval to a residential
development unit project on a portion of the property
described in Ordinance No. 7-1984 and as legally described
herein; and,
WHEREAS, a study of this Ordinance was conducted by the Richmond City
Plan Commission the day of ,1990, at which
time remonstrances were heard from all parties interested in
or affected by this Ordinance; and,
WHEREAS, the vote of the Richmond City Plan Commission was to_
_in favor of/in opposition to recommending the passage
of Ordinance No. 3-1990.
NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of
Richmond, Indiana as follows:
SECTION 1. That Ordinance No. 7-1984 is hereby amended by voiding a
portion of the previously granted final approval for a
commercial development unit project and by granting
preliminary approval to a residential development unit
project, pursuant to Article 45 and 48 of the Zoning
Ordinance, on the property described below.
Situated in the southwest quarter of Section 21, township 14
north, range 1 west in the City of Richmond, Indiana and in
Wayne County, Indiana, and being more particularly described
as follows:
Beginning at the southeast corner of the southwest quarter of
said section 21; thence with the east line of the southwest
quarter of said section 21, north 0 degrees 31 minutes 05
seconds west for 1,084.31 feet to a point; thence north 89
degrees 50 minutes 00 seconds west for 1,106.07 feet to the
true point of beginning of the tract hereinafter described;
thence south 12 degrees 49 minutes 49 seconds east for
315.58 feet to a point; thence south 2 degrees 53 minutes 12
seconds west for 155.31 feet to a point in the eastwardly
extension of the north line of Oak Park, Section Six as

recorded in Plat Book 12, Page 95 of the Wayne County Plat
Records; thence with the eastwardly extension of the north
line of said Oak Park, Section Six, the north line of said Oak
Park, Section Six, and the westwardly extension of the north
line of said Oak Park, Section Six, south 89 degrees 50
minutes 13 seconds west for 848.95 feet to a point; thence
due north for 739.61 feet to a point in the north line of
Chester Boulevard Development, Section One as recorded in
the Plat Book 14, Page 329 of the Wayne County Plat Records;
thence with the north line of said Chester Boulevard
Development, Section One, north 89 degrees 50 minutes 13
seconds east for 614.54 feet to a point; thence south 0
degrees 01 minutes 55 seconds east for 275.63 feet to a
point; thence south 89 degrees 50 minutes 00 seconds east
for 172.00 feet to the true point of beginning; containing
14.750 acres.
SECTION 2. That Ordinance No. 7-1984 shall remain in full force and
effect except as amended herein.
SECTION 3. That as a condition of being granted preliminary approval for
a residential development unit project the owner shall at all
times comply with the following conditions:
A. The Development Unit Project site plan and petition shall
be marked exhibit A and made a part of this Ordinance.
B. The owner shall amend and revise the development unit
project site plan as required by the Richmond City Plan
Commission.
C. The owner shall grant to the City of Richmond an easement
for the construction of a future public street. Said easement
shall be fifty (50) feet in width and adjacent to the west
boundary line of the development unit project.
SECTION 4. This Ordinance shall be in full force and effect from and
after its passage and approval as by law required.
