HomeMy Public PortalAbout007-1990- ORDINANCE AMENDING CHAP 154-ZONING- EAST AND NORTH OF16111111lrJ-Wy:1111►US • • l AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO.2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY LOCATED EAST AND NORTH OF THE OAK PARK SUBDIVISION, FROM R-1 SINGLE FAMILY RESIDENCE DISTRICT TO R-2 SINGLE FAMILY RESIDENCE DISTRICT. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as R-1 Single Family Residence District the property located east and north of the Oak Park Subdivision; and, WHEREAS, it is the intent and purpose hereof, to change the zoning classification of said property from R-1 Single Family Residence District to R-2 Single Family Residence District; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the -�-3,idday of ,1990, at which time remonstrances were heard froA all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was (Jo Z in favor of/ifl—epp^_recommending the passage of Ordinance No. 7-1990. NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to R-2 Single Family Residence District and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. TRACT 1: Situate in the southwest quarter of section 21 and the northwest quarter of section 28, township 14 north, range 1 west, Wayne Township, Wayne County, Indiana and being more particularly described as follows: Beginning at the southeast corner of the southwest quarter of said section 21; thence with the south line of said section 21 and the north line of said section 28, north 89 degrees 44 minutes 25 seconds west for 46.25 feet to a point; thence south 0 degress 15 minutes 20 seconds east for 539.04 feet; thence due west for 563.81 feet to a point at the southeast corner of Oak Park, Section Six, as recorded in Plat Book 12, Page 95 of the Wayne County Plat Records; thence with the east line of said Oak Park, Section Six, north 3 degrees 18 minutes 22 seconds east for 290.12 feet to a point; thence continuing with the east line of said Oak Park, Section Six, Ordinance No. 7-1990 Page 2 north 16 degrees 32 minutes 38 seconds west for 263.10 feet to a point in the north line of said section 28 and the south line of said section 21; thence continuing with the east line of said Oak Park, Section Six, north 35 degrees 29 minutes 48 seconds west for 763.46 feet to the northeast corner of said Oak Park, Section Six; thence north 89 degrees 47 minutes 02 seconds east for 53.51 feet to a point; thence north 6 degrees 08 minutes 52 seconds east for 155.31 feet to a point; thence north 14 degrees 37 minutes 45 seconds west for 315.58 feet to a point; thence south 89 degrees 59 minutes 00 seconds east for 1,106.07 feet to a point in the east line of the southwest quarter of said section 21; thence with the east line of the southwest quarter of said section 21, south 0 degrees 40 minutes 05 seconds east for 1,084.31 feet to the point of beginning; containing 30.848 acres. AND ALSO: TRACT 2 Part of the southwest quarter of section 21, township 14 north, range 1 west, being part of the real estate heretofore conveyed to the First National Bank of Richmond, Trustee, by deed recorded in Deed Record 355, Page 395 in the office of the Recorder of Wayne County, Indiana, and being more particularly described as follows: Beginning at an iron pin on the east line of the southwest quarter of said section 21, said pin being located north 0 degrees 40 minutes 05 seconds west a distance of 1,084.31 feet from an iron pin at the southeast corner of the southwest quarter of said section 21; thence north 89 degrees 59 minutes 00 seconds west for 1,060.97 feet; thence due north for 12.21 feet to an iron pin; thence north 9 degrees 20 minutes 29 seconds west for 358.62 feet to an iron pin; thence north 80 degrees 40 minutes 25 seconds east for 242.62 feet to an iron pin; thence south 9 degrees 18 minutes 54 seconds eas for 358.71 feet to an iron pin; thence south 80 degrees 41 minutes 38 seconds west for 242.46 feet to an iron pin; thence due south for 12.21 feet; thence north 89 degrees 59 minutes 00 seconds west for 217.10 feet to an iron pin; thence north 0 degrees 08 minutes 00 seconds west for 1,586.54 feet to an iron pin in the north line of the southwest quarter of said section 21, and passing iron pipes at 603.32 feet, 1,013.17 feet, and 1,246.82 feet along this course; thence with the north line of the southwest quarter of said section 21, north 89 degrees 41 minutes 50 seconds east for 1,263.20 feet to a rock at the northeast corner of the southwest quarter of said section 21; thence with the east line of the southwest quarter of said section 21, south 0 degrees 40 minutes 05 seconds east for 1,593.69 feet to the point of beginning; containing 44.385 acres. Miles, Inc., and James Harlan, owners; Thomas Winemiller and Associates, agent requesting a rezoning from R-1 Single Family Residence District to R-2 Single Family Residence District on property located east of Chester Boulevard, south of IU East and north of the existing Oak Park Subdivision. The property in question consists of approximately 75 acres located outside the Corporate Limits in the two (2) mile jurisdictional area. (Attached is a city map depicting the area.) Mr. AI Dillion has pending, an offer to purchase approximately 30 of the subject acres with the intention of developing a subdivision. The subdivision would be an addition to Oak Park involving the extension of University Boulevard, Parkdale Dive and Oak Park Drive. Jim Harlan owns the balance of the acerage requested to be rezoned, being approximately 45 acers. He has no immediate plans for this acerage, but is considering a future subdivision. Twenty-eight (28) notices of public hearing were sent to the surrounding residents with one (1) returned not oppossed to the petition and three (3) returned in opposition to the petition. During the public hearing six persons spoke in opposition to the petition. These persons sited their concerns regarding traffic congestion, storm water drainage and the value of homes proposed to be constructed in the area. The Plan Commission determined that the area surrounding the property in question is presently zoned R-2 Single Family Residence District. The Commission also determined that the existing subdivisions in the area, being Oak Park, Crestdale and Saddlebrook, are zoned R-2 and have been developed using R-2 requirements. Therefore, the Commission voted six (6) to two (2) to recommend that Ordinance No. 7-1990 be adopted. Respectfully submitted, Daniel S.
