HomeMy Public PortalAbout009-1990-ORDINANCE APPRIATE WITHIN THE CUMMULATIVE CAPITAL DEVEAN ORDINANCE TO APPROPRIATE WITHIN THE CUMULATIVE CAPITAL DEVELOPMENT FUND WHEREAS, Ordinance No. 21-1987 created a Cumulative Capital Development Fund pursuant to Public Law 44-1984; and WHEREAS, I.C.8-16-3 allows the construction, maintenance and repair of bridges, approaches and grade sections, and; WHEREAS, it has been determined that it is now necessary to appropriate more money than was appropriated in the annual budget: NOW THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF RICHMOND, WAYNE COUNTY, INDIANA: SECTION 1. That for the expenses of said municipal corporation the following additional sums of money are hereby appropriated and set apart out of the fund named and for the purposes specified. Said sum being subject to the laws governing the same. CUMULATIVE CAPITAL DEVELOPMENT FUND $70,000.00 $70,000,00 These funds are to be appropriated for the following: 3000-Other Services & Charges AI $70,000.00 SECTION 2. This Ordinance shall be in full force and effect from and after its passage and approval by the Mayor and is subject to the laws of the State of Indiana governing emergency appropriations. Councilmember Brookbank presided with the following members present: Councilmembers: Elstro, Lundy, Hankinson, McBride, Parker, Hutton, Morris, and Paust. Absent: None The following business was had to -wit: (OTHER BUSINESS HAD) The Clerk presented Proof of Publication of Notice to Taxpayers printed in the Richmond Palladium Item, a newspaper of general circulation in the City of Richmond, Indiana, on the date of 9th day of February 1990. Said notice stated that a public hearing would be held on the 20th day of February 1990, by the Common Council to consider additional appropriations in excess of the budget for the year 1990 within the City of Richmond, Indiana. The Proof of Publication was examined and found to be in order. Councilmember Hutton moved the Proof of Publication be received and filed, seconded by Councilmember Elstro and on unanimous voice vote the motion was carried. The Clerk read on second reading Ordinance No. 9-1990. President Brookbank announced Ordinance No. 9 -1990 was on public hearing. After hearing all persons present, Ordinance No. 9-1990 was placed on final passage or rejection and on a call of the roll the following was recorded: Ayes: Elstro, Lundy, Hankinson, McBride, Parker, Hutton, Morris, Paust and Brookbank Nays: None Absent: None The vote being 9 to 0 in favor of the passage of Ordinance No. 9-1990. WITNESSETH: WHEREAS, South "G" Street running east and west is a part of the official, thoroughfare plan of the City of Richmond and where it crosses the Whitewater River is entirely within the corporate limits of the City of Richmond; and, WHEREAS, under current Indiana law, Wayne County has the responsibility for the rehabilitation construction, repair and maintenance of the bridge; and, WHEREAS, the City of Richmond historicallin has assumed responsibility for the reconstruction, repair and maintenance of the roadway leading to and from and crossing the bridge; and, WHEREAS, the existing bridge 1701, including approaches, roadways and grade separations, carrying South "G"- Street over the Whitewater River located between South 5th Street on the east and Whitewater Boulevard on the west has been deemed structurally deficient and in need of extensive rehabilitation, (hereinafter sometimes referred to as "bridge rehabilitation project"); and, WHEREAS, Wayne County and the City of Richmond desire to confirm their respective participation in the rehabilitation of the bridge and reconstruction of the roadways, grade separations and approaches thereto;. and, WHEREAS, Wayne County and the City of Richmond desire to apportion between them responsibilities relating to the continued maintenance and repair of the bridge, roadways and approaches following completion of the bridge rehabilitation project. NOW*THEREFORE, in consideration of the mutual covenants and premises hereinafter contained, it is agreed between the parties as foll�ws: 1. The purpose of this agreement is to apportion between Wayne County and the City of Richmond certain responsibilities relating to the bridge rehabilitation project and, further, to apportion between them responsibility for the continued maintenance of the bridge, roadways, approaches and grade separations. 2. Wayne County shall be the lead agency on this federally funded project and therefore shall: a. Prepare or cause to -have prepared any or all of the following items pertinent to the bridge rehabilitation project: (1) Preliminary design studies and construction cost estimates; (2) Engineering design; (3) Engineering drawings; (4) Land acquisition documents (right-of-way plans, land plats and descriptions); (5) Construction plans and documents; (5) Engineers estimate of construction cost; b. Provide an amount equal to 100% of the bridge rehabilitation project cost less the amounts to be paid by Richmond pursuant to paragraph 3 hereof. (It is understood that 80% of the bridge rehabilitation project cost may be paid directly from federal funds.); C. Receive all federal aid reimbursements; d. Assume responsibility of the -duty to receive, disburse and account for all monies related to the bridge rehabilitation project. The Auditor of Wayne County is hereby delegated authority to fulfill this responsibility; e. Secure all necessary plan approvals of affected agencies; f. Arrange for the Indiana Department of Highways to receive project bids for construction and award of the construction contract; g. Furnish or cause to be furnished on -site project construction inspection and material testing; h. Following completion of the bridge rehabilitation project, provide and be responsible for the continuing maintenance and repair of the bridge structure; such bridge structure shall be deemed to include all portions of the structure from the western -most abutment to the eastern -most abutment. The bridge structure shall not be deemed to include rpadways leading to and from and crossing the bridge, or approaches beyond the bridge abutments. The City of Richmon� shall provide and be responsible for the continuing maintenance of such roadway and approaches following completion of the bridge rehabilitation project. 3� The City of Richmond shall: a. Review and, to the extent of its authority, approve all documents included in paragraph 2. above and assist in securing approvals of agencies; b. Assist in acquisition and accept the right-of-way acquired by this project, if any; C. Provide amounts equal to 100% of the local share of the bridge rehabilitation project cost to the extent that such project costs relate and are attributable to the bridge approaches including, but not limited to, costs relating to installation or construction of guardrails, curbs, gutters, traffic signals and traffic control devices, sidewalks, painting, pavement and base, seed, sod, and drainage structures. The County shall periodically invoice the City of Richmond for the above - described costs no more frequently than biannually; the City of Richmond shall reconcile and remit payment on such invoices no later than six months after the date of such invoices; d. Following completion of the bridge rehabilitation project, provide and be responsible for the continuing repair and maintenance of the bridge approaches as described in subparagraph 3. c. e. Following completion of the bridge rehabilitation project, be responsible for all snow removal, sweeping and cleaning as required to adequately maintain the roadways and approaches in a safe condition. 4. The provisions of this agreement pertaining to the bridge rehabilitation project shall terminate upon the completion of such project as evidenced by the approval of Indiana Department of Highways. The provisions of this agreement pertaining to the responsibilities of the parties relating to the continuing repair and maintenance of the bridge and approaches may be terminated at any time by providing one years advance notice of the party's intent to so terminate. 5. This agreement shall be approved by the Board of Commissioners of Wayne County, the Board of Public Works and Safety of the City of Richmond, Wayne County Council, the Common Council for the ity of Richmond, the Mayor of the City of Richmond.
