NEW/OLD BUSINESS 4.BUDGET APPROPRIATION - PARCEL MAP FOR ATLANTIC HOUSING Lynwood Housing Authority - Page 1 of 11 DEVELOPMENT PROJECT Comments: The City of Lynwood Housing Authority Board will consider funding the preparation of a parcel map combining ten (10) contiguous properties into one (1) for the future development of a 67-unit multi-family affordable housing complex. The properties are currently owned by the City and located entirely on the west side of Atlantic Avenue across from the Yvonne Burke Ham Park. Background: The City Council and Lynwood Housing Authority (the "Authority") have entered into a Disposition and Development Agreement ("DDA") with Lynwood Family Apartments, LP, ("Developer") for the development of a 67-unit multi-family affordable housing complex (the "Atlantic Housing Development Project"). The project site is located at 12001 - 12035 South Atlantic Avenue and 4347 Lavinia Avenue and consist of ten properties (Assessor Parcel Numbers 6186-001-900, 6186-001-901, 6186-001-902, 6186-001-903, 6186-001-904, 6186-001-905, 6186-001-906, 6186-001-907, 6186-001-908, and 6186-001-909) that makeup 0.88 acres (38,332 square feet). The project site is currently vacant and owned by the City. As part of this project, a parcel map is required combining the ten (10) contiguous parcels into one (1) for the future development of the affordable housing complex. The development of the required parcel map is a City initiated application. As a result, the Fiscal Year 2019-20 approved budget now needs to be amended to allow for the cost of the parcel map. Discussion and Analysis: Lynwood Housing Authority - Page 3 of 11 On September 4, 2018, the Authority, acting in its capacity as Successor Agency to the former Lynwood Redevelopment Agency, issued 2018 Bonds to finance the construction and related costs required to produce the Atlantic Housing Development Project, which includes the cost to prepare a parcel map for the project site. The City sent a request to the five (5) firms (Transtech, SWA, dSantana Aquitectura, Infrastructure Engineers, Willdan) currently under contract with the City for on-call services to obtain quotes for the preparation of a parcel map for the project site. Two firms responded. The lowest qualified bid, at $21,483, was submitted by Infrastructure Engineers. Staff would like to move forward with the development of the needed parcel map, which would require a budget amendment allocating the needed funds for this purpose. If the amendment and appropriation is approved, Infrastructure Engineers would be engaged pursuant to a task order as authorized by Lynwood Municipal Code Section 6-3.16. Fiscal Impact: Funding for this project was not included in the Fiscal Year 2019-20 budget. Therefore, the attached resolution includes an appropriation of $21,483 within the General Fund, funded by the Housing Authority Fund through the Lynwood Housing Authority Taxable Revenue Bonds, Series 2018. This Project Site is the location of a future proposed affordable housing development. Unfortunately, the Project Site is experiencing an increase in homeless encampments, abandon vehicles, and illegal dumping. It is imperative that the Project Site is kept free of debris and overgrown vegetation, as that type of environment tends to attract transients and illegal dumping. The process of removing settled transient trespassers and illegal dumping debris is both time consuming and costly. Due to the current condition of the Project Site, expedited measures are being taken to clean it up immediately. However, funds were not budgeted in the Fiscal Year (FY) 2019-20 Budget for regular maintenance of the Project Site. Discussion and Analysis: The City desires to utilize the Lynwood Housing Authority’s (the "Authority’s") Low-Mod Income Housing Asset Funds (“LMIHAF”) to cover the cost of needed maintenance services at the Project Site to ensure the area is not compromised before the development of an affordable housing project. Lynwood Housing Authority - Page 7 of 11 In an effort to implement a maintenance plan at the Project Site, funds are needed, in the amount of $45,000, from the Authority’s unappropriated LMIHAF balance to provide the needed resources to engage a contractor for said services as it is necessary to protect the interest of the production of affordable housing at said location. Per Health and Safety Code, Section 34176.1(a)(1), “…a housing successor may expend per fiscal year up to an amount equal to 5 percent of the statutory value of real property owned by the housing successor and of loans and grants receivable, including real property and loans and grants transferred to the housing successor pursuant to Section 34176 and real property purchased and loans and grants made by the housing successor. If this amount is less than two hundred thousand dollars ($200,000) for any given fiscal year, the housing successor may expend up to two hundred thousand dollars ($200,000) in that fiscal year for these purposes. The amount requested does not exceed the usable amount and use is consistent with the intended use of said funds.” The maintenance of the Project Site is critical to minimize unnecessary costs associated with major cleanups and removal of potential squatters on land owned by the City for the future development of a proposed affordable housing project. Since funds were not included in the FY 2019-20 Budget, a budget allocation is needed to ensure that the Project Site is maintained on a regular basis while owned by the City. Fiscal Impact: Funding for the maintenance services related to the Project Site was not included in the Fiscal Year 2019-20 budget. Therefore, the attached resolution includes an appropriation of $45,000 from the Authority’s unappropriated LMIHAF balance, pursuant to H&SC Section 34176.1(a)(1).
