PRESENT: MAYOR R. EDGAR GIECK TRUSTEE MARSH TRUSTEE HOVEL TRUSTEE RAU ABSENT: TRUSTEE VIGIL TRUSTEE HOFF ALSO PRESENT: TOWN ATTORNEY, ROBERT BURROUGHS TOWN CLERK/TREASURER, PAT LESH MAYOR GIECK PRESIDED CONFIRMATION MOTION MADE BY TRUSTEE HOVEL , for confirmation 9/18/90 of the minutes of the regular meeting of the MINUTES Board, dated 1990, September 18. MOTION CARRIED APPROVAL Accounts payable 1990, September 18 thru ACCOUNTS October 16 were reviewed. MOTION WAS MADE BY PAYABLE TRUSTEE RAU, to pay the accounts payable as presented. MOTION CARRIED APPOINTMENT MOTION WAS MADE BY TRUSTEE HOVEL, to appoint TRUSTEE Fred Hoover to fill the vacancy on the board. MOTION CARRIED OATH OF Robert Burroughs, Town Attorney administered OFFICE the Oath of Office to Fred Hoover., a newly appointed Trustee. His term will expire April 1992. FOOD TAX Anne White addressed Council concerning the REPEAL the Food Tax Repeal . Attorney, Robert Buro stated two weeks ago he contacted the SalesTaxs Division and Colorado Municipal League. He was advised that the tax could be repealed by a Local Ordinance. Mr. Burroughs was contacted today by the Colorado Municipal League Lobbyist and Statue writer. He questioned Wheather it would require an election to repeal the Food Tax. The Statue states that any amendment of the Sales Tax Ordinance shall be in the same form as the Ordinance which created the sales tax. To create Sales Tax does require an election. Our Ordinance passed in 1976 indicates the Tax Ordinance can be amended except PAGE 1 , 1990 OCTOBER 16 for the rate of the tax of two percent. Attorney Burroughs is to contact the Department of Review concerning this issue. Anne White expressed that the Board determine more accurately the impact on the Town's revenue and that is should state where that difference will be made up. She also expressed the concern that the revenue burden not be shifted from the food sales tax to the property tax, stating that it would not be fair for property owners to take on an additional burden for an action that would only benefit two businesses. Mrs. White also suggested the Board repeal other sales tax to help other businesses. Trustee Hovel responded that is is difficult to determine exactly what the decrease in revenue would be as Johnson's Food Market and Ken's Convenience do not break down their sales tax reports. He also stated that the repeal of the sales tax was inteded more to help Local Shoppers than to help the two Local Food Stores. Action on the proposed Food Sales Tax repeal was tabled until the next regular meeting. The Ordinance to repeal the Sales Tax has not been adopted, therfore the Motion to Repeal the Food Tax does not need to be withdrawn. HORSESHOE The Parks Committee met with the members of the Ault PIT IMPROVEMENTS Horseshoe Club. Danny Martinez advised the total expense would be $2600 to $2700. Plans were reviewed by Trustees. MOTION WAS MADE BY TRUSTEE MARSH, to approve $2700 for the Ault Horseshoe pit improvements. MOTION CARRIED LIQUOR MOTION WAS MADE BY TRUSTEE HOVEL, to grant renewal f the Retal Liquor License for Ault Discount Liquors,oJess Hernandez, President. Inc. , MOTION CAR MOTION WAS MADE BY TRUSTEE HOVEL, to approve theRIED transfer of ownership Liquor License of the Merry Go Round to Daniel Frank Morman. Trustee Marsh abstained from voting. MOTION CARRIED READING Resolution 7-90, a resolution regarding ratification OF RESOLUTION of appointment of Hazel J. Chick to the board of 7-90 trustees for the Weld Library District was re ad. LAW MOTION WAS MADE BY TRUSTEE HOVEL, to enter a Law • ENFORCEMENT enforcement agreement with the Town of Pierce AGREEMENT whereby Ault will provide 25 hours of patrol atrol time per week for the sum of $2000 a month, $24,000a year. Police Committees will meet Quarterly, fuel prices will be reviewed. Sixty day termination notice must be given by either Town. Upon acceptance by The Town of Pierce, Robert Burroughs will write a resolution and the Board will adopt the contract. MOTION CARRIED PAGE 2, 1990 OCTOBER 16 SEALED BIDS MOTION WAS MADE BY TRUSTEE MARSH, to advertise for USED PATROL and recieve sealed bids until 7:00 P.M. November CARS 20, 1990 for the used 1986 Chevrolet Patrol Car. Bids will be opened and read at the next regular Board meeting. MOTION CARRIED UNIFORM The Uniform Policy for the Police Department was reviewed. MOTION WAS MADE BY TRUSTEE RAU, to allow officers $75.00 per quarter in 1991 for each officer for the purchase of uniforms. MOTION CARRIED STEEL Trustee Hovel gave a report regarding the possible BUILDING options concerning the removal of the town ' s steel REMOVAL building from the East Side Park, The Parks and Cemetery Committee will review these options. CEMETERY Discussion was held as to obtaining a written EXPANSION document from Thorton for the expansion of the cemetery to the road that comes from the Towne The document is to State that Thorton will keep the property and permit until the Town is ready for the expansion. Mayor Gieck will arrange for this document execution. WATER AND Trustee Rau will contact D and L Concrete to SEWER meet with the Water and Sewer Board to commence BOARD work on the Sewer Lagoon ditch. STREET Trustee Hovel announced that Bestway Paving will COMMITTEE commence work on the parking lot and alleys. M and A Construction will complete the concrete work. FINANCE Three new C.D. 's were opened at Farmers National Bank. COMMITTEE The Cemetery C.D. with Prudential Bache, out of state investment institution, matured and was put into C.D. No. 13908 at 7.50 Interest Rate, for one year in the amount of $10,857.06 The Drainage and Cemetery Seasoned C.D. 's reached maturity and were opened as follows: No. 13906 Drainage, 7 .50 - interest, Maturity 9/21/91 $4,693.80. No. 13907 Cemetery, 7.50 interest, maturity 9/21/91 $19,447.35 BUDGET A budget work session has been scheduled 10/24/90 WORK SESSION at 7:00 P.M. PAGE 3, 1990 OCTOBER 16 WORK The monthly work session has been scheduled for SESSION November 12 at 7:00 P.M. 111 There being no further business, the meeting adjourned.
