SPECIAL ORDINANCE NO. 20-1990
AN ORDINANCE TO ANNEX TO THE CITY OF RICHMOND, INDIANA CERTAIN
CONTIGUOUS TERRITORY ADJACENT AND ABUTTING THERETO, DESCRIBING
THE SAME, PROVIDING FOR THE PUBLICATION THEREOF, FIXING THE TIME
WHEN THE SAME SHALL TAKE EFFECT AND ASSIGNING SAID TERRITORY TO A
COUNCILMANIC DISTRICT IN THE CITY OF RICHMOND, INDIANA.
WHEREAS, Charles C. Miles, Inc., and Bartlemay Realty, Inc., being the
owner's of record of certain parcels of land, all being within
the hereinafter described area, have petitioned the Common
Council of the City of Richmond, for the voluntary annexation
of said hereinafter described area as set out, and in
accordance with IC-36-4-3-5; and,
WHEREAS, the petitioners own one hundred percent (100%) of the land
sought to be annexed; and,
WHEREAS, the land to be annexed is contiguous and adjacent to the
present boundary of the City of Richmond, Indiana; and,
WHEREAS, a study of this Ordinance was conducted by the Common
Council the, at which time, comments where heard from
parties interested in or affected by this Ordinance.
NOW THEREFORE BE IT ORDAINED by the Common Council of the City of
Richmond, Indiana as follows:
SECTION 1. That the following described territory, adjacent to the
corporate boundaries of the City of Richmond, Indiana, be
annexed to and hereby is declared to be a part of the said City
of Richmond, Indiana; said territory being located in Wayne
Township, Wayne County, Indiana and being more particularly
described as follows:
TRACT 1:
Situate in the southwest quarter of section 21 and the
northwest quarter of section 28, township 14 north, range 1
west, Wayne Township, Wayne County, Indiana and being more
particularly described as follows:
Beginning at the southeast corner of the southwest quarter of
said section 21; thence with the south line of said section 21
and the north line of said section 28, north 89 degrees 44
minutes 25 seconds west for 46.25 feet to a point; thence
south 0 degress 15 minutes 20 seconds east for 539.04 feet;
thence due west for 563.81 feet to a point at the southeast
corner of Oak Park, Section Six, as recorded in Plat Book 12,
Page 95 of the Wayne County Plat Records; thence with the
east line of said Oak Park, Section Six, north 3 degrees 18
minutes 22 seconds east for 290.12 feet to a point; thence
continuing with the east line of said Oak Park, Section Six,

north 16 degrees 32 minutes 38 seconds west for 263.10 feet
to a point in the north line of said section 28 and the south
line of said section 21; thence continuing with the east line
of said Oak Park, Section Six, north 35 degrees 29 minutes 48
seconds west for 763.46 feet to the northeast corner of said
Oak Park, Section Six; thence north 89 degrees 47 minutes 02
seconds east for 53.51 feet to a point; thence north 6
degrees 08 minutes 52 seconds east for 155.31 feet to a
point; thence north 14 degrees 37 minutes 45 seconds west
for 315.58 feet to a point; thence south 89 degrees 59
minutes 00 seconds east for 1,106.07 feet to a point in the
east line of the southwest quarter of said section 21; thence
with the east line of the southwest quarter of said section
21, south 0 degrees 40 minutes 05 seconds east for 1,084.31
feet to the point of beginning; containing 30.848 acres.

Situated in the Southwest Quarter of Section Twenty -One (21),
Township Fourteen (14) North, Range One (1) West, Wayne
Township, in the City of Richmond, Wayne County, Indiana,
including parts of two (2) tracts owned by Charles C. Miles,
Inc., described in Deed Records Volume 381, Page 477, and
Volume 395, Page 336, in the office of the Wayne County
Recorder, and being more particularly described as follows:
Commencing at a W found cut in the concrete median of
Chester Boulevard (State Route 27), at the northwest corner of
said quarter; thence South 00 00' 00" West along the west line
of said quarter and along said street, 2047.48 feet to a point
at the southwest corner of Cox's south 4 acre tract, described
in Deed Records Volume 354, Page 585, thence North 8911 50'
13" East along the south line of said Cox's south tract a
distance of 1319.95 feet to a point at the southeast corner of
said tract, being also on the north line of Oak Park, Section VI,
described in Plat Book 12, Page 95, witness an iron pin found

approximately 35 feet west of the center of an existing gravel
lane, being also approximately 1 foot east of an existing fence
which lies west of said lane; thence North 121 49' 49" West
315.58 feet to an iron pin set on the south line of a 2.00 acre
tract owned by Charles Hartman, described in Deed Records
Volume 408, Page 83; thence North 89' 50' 00" west along
said south line 172.00 feet to an iron pin found at the

463.98 feet to the point of beginning, containing 2.31 acres,
more or less, being subject to legal easements of record.
SECTION 2. That this Ordinance shall be in full force and effect from and
after its passage, approval and publication as by law required.
SECTION 3. That upon the effective date of the annexation of the territory
described above, said territory shall be assigned to and
become a part of Council District 5 in the City of Richmond,
Indiana.

PETITION FOR ANNEXATION
The undersigned, Bartlemay Realty, Inc., hereby petitions the Common Council of the City of
Richmond, Indiana, for the annexation of certain real estate presently situated outside and
adjacent to the corporate boundaries of the City of Richmond, Indiana, as follows:
(1 .) The real estate consists of a total of two and thirty-one hundreths (2.31) acres
and is adjacent to the corporate boundaries of the said City of Richmond, Indiana.
The description of said real estate is more fully described in Exhibit "A" attached
hereto and made a part hereof.
(2.) The petitioner owns one hundred per cent (100%) of the land sought to be
annexed and requests the adoption and passage of a Special Annexation Ordinance
in accordance with the statutes of the State of Indiana, particularly IC 36-4-3-
5.
