June 15, 1960.
The regular meeting,which was not held on June 8, due to lack of a quorum was held
today at 8 P.M. in the Council Room in the Town Hall and was attended by Ileyor Brown,
who presided, and councilmen Peters, Powers, Hosti, Waters, Lovell, Meddin, Town
Attorney Solms,'Superintehdent Reed, Chief McCutchen, James E Tent and John J.Fogarty.
Mr. Tant protested against the stand in Memorial Park being leased to another party.
Mr. Reed reported that Mr. Tent was not very cooperative in the operation of the
stand after which Mr. Tent was excused.
Ni. Fogar* protested against the treatment he stated was accorded his son, James
when he was arrested on June 5th on a drunk driving charge. His son was not
permitted to use the telephone at the jail to call'his home and was fined $54.00 in
court. He also stated that there were two witnesses for his son at the hearing who
were not permitted to testify in his behalf. Mr. Fogarty was excused.
Mr.'Reed reported that he was handicapped by being unable to hire labor and that the
steps on center street had been placed there, all drinking fountains and showers ate
up and work on the water main to Estill-Station had been started. Councilman Lovell
asked when work would be started on the First Street Groin. Ni. Reed stated that he
could not say at this time due to a shortage of labor. The Mayor suggested that
the town furnish the material and-have the work done under contract. Mr. Reed in-
formed Council that another garb ge truck is needed. The Mayor asked how long would
it take to complete the water system to Estill Station and Mr. Reed stated it would not
take long if he had the men.
Councilman Lovell wanted to know what had been done about clearing lots. After some
discussion it was moved and seconded that property owners be given 30 days to have
lots cleared. Those voting yes were Peters, Powers, Hosti, Waters and Lovell and
voting no was Councilman Meddin.
Councilman Powers asked what was done about removing debris from the Kaminsky cottage
on the Inlet which burned some time ago. Chun8il was informed that Mr. Julius '
Kaminsky has been endeavoring to employ someone to clear the property.
Councilman Lovell stated that at one time the water tapping fee was $25.00 and the
Town allowed 60 feet of pipe to connect the property owner to the water main, any pipe
used over 60 feet the property owner had to pay so much per foot. He'stated that now
the Town charges $50.00 for the stubbing fee for the sewerage installation and he feels
that the Town should charge additional when any extra pipe is required for the sewerage
installation.
The Mayor asked Chief McCutchen why he purchased a floor polishing machine for the jail
without the proper authority. The Mayor stated that he had a polishing machine and
would have been glad to let them use it when needed. °
Bills for General Government for the month of May amounting to ,040.89 and for the
Water Department amounting to $906.07 were on motion made and seconded approved for
payment.
Chief McCutchen asked Council1s opinion on how the Police Department is operating, and
if there was any criticism of the Police Department to tell him so he could correct it.
Councilman Hoati stated that the Police' Department is wrong in not allowing responsible
people to telephone when they are detained.
The Mayor called attention to the heavy expenditures which have been made and stated
that several departments must cut down on their purchases.

Chief McCutchen stated that if a person is arrested for drunk driving that he should •
be required to take a blood test to ascertain if he is drunk, he also stated that two
of his police officers are in need of talking to by him.
Ni, Solms informed Council that Mr. Curtis of the State Highway Department had agreed
to accept the certification of the Clerk regarding the slope easements. The Mayor
stated that Mr. O'Dell would get the appraisers started on appraising the property on
First Street.
Councilman Waters moved that the two guards on duty at the prison camp be paid $5.00 each
per month to check on the prisoners in the Town's new jail. It was moved, seconded and
passed that this be authorized.
The Mayor instructed hereafter when purchased are made by the several departments that
they be approved by the Chairman of the Committee and that a purchase order be issued.
Councilman Waters made a motion regarding the request of Hubert Ellzey, Sr.,to transfer
the beer license of Byrd's Beach Market to him, that if the name remains as is then the
$25.00 transfer fee will not be charged but if he changes from Byrd's Beach Market to
Mr. Ellzey's operations then the charge of $25.00 will apply. It was seconded and the
motion passed.

Social Security for the Police Department was set up. The Mayor asked if the town
could deduct the 3`per cent from the Police Officers, Mr. Soles stated he would check on it.
Councilman Hosti moved that the new truck for the Garbage Department costing $2,089.32 for
a 1960 Ford, 1 Ton, Model F -500, Dump Truck be purchased, which was seconded and passed.
Ehe Mayor called attention to Mr. R. E. Howard being ill and asked what should be done
about it. Councilman Lovell suggested that if they work less than a year they should
not be paid sick leave and if they work five years or more they should be granted one
month's sick leave. Councilman Hosti stated that he did not agree with this. The
Mayor suggested that the Town pay Mr. Howard to the end of this month and that would be
all. If he gets well later on then put him back to work if he requests it.
The Mayor informed Council that Mr. Dixon who operated the filling station at the Auto-
mobile Road and Campbell Street requested permission to sell used cars. It was decided
to permit him to do this for a license fee of $100.00 provided the place is kept in a
clean condition.
The Mayor informed Council that the opertors of the Go Kart Track had requested that two
of the vapor type street lights be placed in their area. The annual cost of these two
lights is $66.00 for both. The Town had charged a license fee of $50.00 to operate the
track and they were agreeable to making the fee $150.00 if the Town would absorb the cost
of the two lights. It was moved, seconded and passed that the two lights be installed
and the additional fee collected.

Mrs. Johnnie Haughty who operates a concession of renting chairs on the beach, reported that
the Chief of Police had ordered her to maintain a life guard and when she requested per-
mission from Council previously to rent the chairs she was informed that she would not bey
compelled to have a life guard. Council informed her that she is correct and is not re-
quired to have a life guard.
letter was read from 1 . Jack Rabey protesting against the operation of the Go-Kart
Track in the vicinity of his home.
The Mayor informed Council that the proposed bronze plaque which is to be placed in the
new jail and court room would cost $145.00 and suggested that the purchase of it be
withheld at this time.

It was moved, seconded and passed that a service contract for the servicing of
office typewriters and calculating machine for one year with the Remington Rand
Company be approved.
It was moved, seconded and passed that the following Resolution on the death of
Judge James P. Houlihan'be adopted.
