Twenty-seven (27) notices of public hearing were sent to the residents
surrounding the site. One notice was returned to the Plan Department in
favor of the petition. During the public hearing the property owner
adjoining the site to the north spoke in favor of the petition.
The Plan Commission determined that the petition complies with the
requirements of the Zoning Ordinance. The Commission also determined
that the proposed day care center would not be expected to harm
neighboring property values or prevent the use and enjoyment of adjacent
property. An error was discovered in the legal description of the
property as written in Ordinance No. 23-1990. Therefore, the
Commission voted eight (8) to zero (0) to recommend to Council that the
legal description in Ordinance No. 23-1990 be corrected and that the
Ordinance be adopted.
