HomeMy Public PortalAbout024-1990- ORDINANCE TO CONTINUE THE CUMMULATIVE CAPITAL DEVELOPORDINANCE NO. 24-1990 AN ORDINANCE TO CONTINUE THE CUMULATIVE CAPITAL DEVELOPMENT FUND FOR THE CITY OF RICHMOND, INDIANA WHEREAS, P.L. 44-1984 allows municipalities to establish a municipal Cumulative Capital Development Fund; and, WHEREAS, the City of Richmond, Indiana finds that such a fund is necessary and prudent for the financial well being of the municipality; and, WHEREAS, Ordinance No. 72-1984 originally created a Cumulative Capital Development Fund and Ordinance No. 21-1987 continued the fund for the City of Richmond, Indiana; and, WHEREAS, the City of Richmond, Indiana again desires to continue said Cumulative Capital Development Fund. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Wayne County, Indiana as follows: SECTION 1. That there is hereby established and continued a Cumulative Capital Development Fund. SECTION 2. That an ad valorem property tax levy will be imposed and the revenues from the levy will be retained in the Cumulative Capital Development Fund. SECTION 3. That the maximum rate of levy under Section 2 will not exceed: a. .15 cents per $100. Assessed Valuation for 1991 and thereafter. SECTION4. That the funds accumulated in the Cumulative Capital Development Fund will be used for: I.C. 8-16-3 The construction, maintenance and repair of bridges, approaches and grades sections; I.C. 36-8-14 The purchase, construction, renovation or addition to buildings used by the fire department and for the purchase or rental with option to purchase fire -fighting equipment and the purchase of police radio equipment; I.C. 8-22-3-25 The acquisition of real property and the construction, enlarging, improving, remodeling, repairing or equipping of buildings, structures, runways or other facilities for use in connection with the airport operated by the City of Richmond; I.C. 36-9-48 The acquisition of buses and the planning, establishment and maintenance of routes and schedules; I.C. 36-9-16-2 The purchase, construction, equipping and maintenance of buildings for municipal purposes, including the acquisition of land and improvements thereon, the demolition of such improvements and preparation of such land and the acquisition, improvement or construction of land or rights - of -way to be used as a public way or other means of ingress or egress to land acquired for the construction of a municipal building; I.C. 36-9-16-3 and I.C. 36-9-16-5 The acquisition of land or rights -of -way to be used for public ways or sidewalks and the construction and maintenance of public ways or sidewalks; Ordinance No. 24-1990 Page 2 I.C. 36-9-16-3 The purchase or lease of land, buildings or rights -of -way for the use of any utility acquired or operated by the City of Richmond. The purchase or lease of motor vehicles for the use of the police or fire department, including ambulances and fire -fighting vehicles with the necessary equipment, ladders and hoses. The purchase or lease of any equipment needed by the City of Richmond for any public transportation use; I.C. 36-10-3-21 The purchase or acquisition of land, with or without buildings, for park or recreation purposes and the building, remodeling and repair of park and recreation facilities; I.C. 36-8-17 The construction, repair or improvement of streets, alleys, sidewalks, curbs and gutters. SECTION 5. Notwithstanding Section 4, funds accumulated in the Cumulative Capital Development Fund may be spent for purposes other than the purposes stated in Section 4, if the purpose is to protect the public health, welfare or safety in an emergency situation which demands immediate action. Money can be spent under the authority of this section only after the Mayor issues a declaration that the public health, welfare or safety is in immediate danger that requires the expenditure of money in the fund. SECTION 6. This fund takes effect upon approval of the State Board of Tax Commissioners. PASSED AND ADOPTED by the Common Council of the City of Richmond, Indiana, this a day of 1990. Councilmember Brookbank presided with the following members present: Councilmembers: Elstro, Lundy, Hankinson, McBride, Parker, Hutton, Morris, and Paust. Absent: None The following business was had to -wit: (OTHER BUSINESS HAD) The Clerk presented Proof of Publication of Notice to Taxpayers printed in the Richmond Palladium Item, a newspaper of general circulation in the City of Richmond, Indiana, on the dates of the 1 tth day of May and the 18th day of May,1990, said notice stated that a public hearing would be held on the day of June 4, 1990 by the Common Council to consider continuation of the Cumulative Capital Development Fund within the City of Richmond, Indiana. The Proof of Publication was examined and found to be in order. Councilmember Morris moved the Proof of Publication be received and filed, seconded by Councilmember Paust and on unanimous voice vote the motion was carried. The Clerk read on second reading Ordinance No. 24-1990. President Brookbank announced Ordinance No. 24 -1990 was on public hearing. After hearing all persons present, Ordinance No. 24-1990 was placed on final passage or rejection and on a call of the roll the following was recorded: Ayes: Elstro, Lundy, Hankinson, McBride, Parker, Hutton, Morris, Paust and Brookbank Nays: None Absent: None The vote being 9 to 0 in favor of the passage of Ordinance No. 24-1990.
