SPECIAL ORDINANCE NO. 29-1990
AN ORDINANCE TO ANNEX TO THE CITY OF RICHMOND, INDIANA CERTAIN
CONTIGUOUS TERRITORY ADJACENT AND ABUTTING THERETO, DESCRIBING
THE SAME, PROVIDING FOR THE PUBLICATION THEREOF, FIXING THE TIME
WHEN THE SAME SHALL TAKE EFFECT AND ASSIGNING SAID TERRITORY TO A
COUNCILMANIC DISTRICT IN THE CITY OF RICHMOND, INDIANA.
WHEREAS, Frank L. Otto, being the owner of a certain parcel of land, all
being within the hereinafter described area, has petitioned the
Common Council of the City of Richmond, for the voluntary
annexation of said hereinafter described area as set out, and
in accordance with IC-36-4-3-5; and,
WHEREAS, the petitioner owns one hundred percent (100%) of the land
sought to be annexed; and,
WHEREAS, the land to be annexed is contiguous and adjacent to the
present boundary of the City of Richmond, Indiana; and,
WHEREAS, a study of this Ordinance was conducted by the Common
Council, at which time, comments where heard from parties
interested in or affected by this Ordinance.
NOW THEREFORE BE IT ORDAINED by the Common'Council of the City of
Richmond, Indiana as follows:
SECTION 1. That the following described territory, adjacent to the
corporate boundaries of the City of Richmond, Indiana, be
annexed to and hereby is declared to be a part of the said City
of Richmond, Indiana; said territory being located in Wayne
Township, Wayne County, Indiana and being more particularly
described as follows:
Situate in the northeast quarter of Section 10, Township 13
North, Range 1 West, Wayne Township, Wayne County, Indiana,
and being more particularly described as follows:
Beginning at the southwest corner of Hunter's Pointe, Section
Three as recorded in Plat Book 15, page 189 of the Wayne
County Plat Records; thence South 0 degrees 30 minutes 03
seconds west for 780.00 feet to an iron pin set at the true
place of beginning of the tract hereinafter described; thence
South 89 degrees 29 minutes 57 seconds east for 190.00 to an
iron pin set; thence South 44 degrees 45 minutes 24 seconds
west for 272.26 feet to an iron pin set; thence North 0
degrees 30 minutes 03 seconds east for 195.00 feet to the
true place of beginning; containing 0.425 acres.
SECTION 2. That this Ordinance shall be in full force and effect from and
after its passage, approval and publication as by law required.

SECTION & That upon the effective date of the annexation of the territory
described above, said territory shall be assigned to and
become a part of Council District 4 in the City of Richmond,
Indiana.

PETITION FOR ANNEXATION
The undersigned, Frank L. Otto, hereby petitions the
Common Council of the City of Richmond, Indiana, for the
annexation of certain real estate presently situated outside
and adjacent to the corporate boundaries of the City of Richmond,
Indiana as follows:
(1) The real estate consists of a total of four hundred
twenty five thousandths (.425) acres and is adjacent
to the corporate boundaries of the said City of
Richmond, Indiana. The description of said real
estate and the terms and conditions requested
to be applicable to said annexation are all as more
fully described in the proposed Annexation. Ordinance
attached hereto and made part thereof.
(2) The petitioners own one hundred per cent (100%) of
the land sought to be annexed and request the adoption
and passage of said Special Ordinance in accordance
with the statutes of the State of Indiana, particularly
IC 36-4-3-1 et seq.
