PRESENT: MAYOR R. EDGAR GIECK TRUSTEE RAU TRUSTEE MARSH (arrived 7 : 15 ) TRUSTEE WHITE TRUSTEE HOFF TRUSTEE HOVEL (arrived 8: 00 ) TRUSTEE VIGIL ALSO PRESENT: TOWN ATTORNEY, ROBERT BURROUGHS TOWN CLERK-TREASURER, PAT LESH Approximately 16 audience members . MAYOR GIECK PRESIDED CONFIRMATION MOTION MADE BY TRUSTEE RAU, that the 7/17/90 minutes of the regular meeting of the MINUTES Board , dated 1990 July 17 , be confirmed . MOTION CARRIED CONFIRMATION MOTION MADE BY TRUSTEE HOFF, that the 7/31/90 minutes of the special meeting of the MINUTES Board , dated 1990 July 31 , be confirmed . MOTION CARRIED APPROVAL Accounts payable 7/18/90 thru 8/18/90 ACCOUNTS were discussed and questions answered. PAYABLE MOTION MADE BY TRUSTEE HOFF, to approve accounts payable . MOTION CARRIED WELD MENTAL MOTION MADE BY TRUSTEE HOFF, TO ALOT $600 . 00 HEALTH in the 1991 Budget with donations to be 91 DONATION paid in January 1991 . Trustee Rau asked to ammend motion to the $600 . 00 donation to be paid on the anniversary date of the last donation . Trustee Hoff consented. MOTION CARRIED COLORADO RURAL Jim Gustafson , representing Ray Larson HOUSING requested lot 1 , 3 . 886 acres zoning be DEVELOPMENT changed from commercial to multi-family CORPORATION residentual zoning. The project would be low income housing for people who earn a portion of their income from farming. Funding will be from Farmers Administration. The project would consist of six building with six three bedroom units in each building. Mayor Gieck advised this request for zoning change would have to go to the Planning Commission and then recommendation will be presented to the Board. PAGE 1 , 1990 AUGUST 21 PUBLIC Mr. Fred Hoover addressed the Board concerning COMMENTS cement sidewalk replacement behind school administration building. Trustee White advised him this matter has been addressed . PROPOSAL One proposal for accounting services was ACCOUNTING received and reviewed . The proposed fees SERVICES for accounting services would be based on actual time spent working at the following rate : Manager $85 .00 Senior Accountant 65 . 00 Staff Accountant 50 . 00 Paraprofessional 35 . 00 Computer Specialists 35 . 00 Clerical 25 . 00 MOTION WAS MADE BY TRUSTEE WHITE , to accept the proposal from Schultz and Co. for accounting services at the above rates . MOTION CARRIED CONCRETE Proposals for the concrete ditch at sewer DITCH lagoon were received and reviewed . The PROPOSALS bids are as follows : Pete & D. L. Concrete Co . 7 . 25 per foot Alvin ' s Ditch Line Co . 10 . 86 per foot Aden & Keever 12 .00 per foot MOTION WAS MADE BY Trustee White to award the bid to Pete & D. L. Concrete Co . for $7 . 25 per foot . MOTION CARRIED OFFICER MOTION WAS MADE BY TRUSTEE MARSH , to set CHIODA Greg Chiddas starting salary as a full SALARY time officer at $1500 .00 per month, retroactive to August 1 , 1990 . MOTION CARRIED ENVIRONMENTAL MOTION WAS MADE BY TRUSTEE WHITE, to HEALTH table the action to authorize consent SERVICES to the provision of environmental health services within our jurisdiction until further research and information can be gathered . MOTION CARRIED BUDGET MOTION WAS MADE BY TRUSTEE HOFF, to appoint OFFICER Patricia J . Lesh, Budget Officer for the APPOINTMENT 1991 Budget . MOTION CARRIED PAGE 2 , 1990 AUGUST 21 RESOLUTION Resolution 6-90 was read. A Resolution 6-90 concerning Highway 14 pavement signing and marking--school zone. MOTION MADE BY TRUSTEE WHITE, to adopt Resolution 6-90 . MOTION CARRIED ORDINANCE Proposed Ordinanc No . 336 , an ordinance NO. 336 vacating a portion of a utility and drainage easement in the Ault West Subdivision was read by the Town Clerk. Corrections were made and the revised ordinance was read . Lifestyle Homes , Dave Clarkson agreed to pay for all expenses incurred in passage of Ordinane No. 336 . MOTION MADE BY TRUSTEE RAU, to set the Second Reading and Public Hearing for September 18 , 1990 , with Lifestyle Homes to pay for all expenses incurred in publication and passage . MOTION CARRIED PARK The portable toilets in Liberty Park and COMMITTEE East Park will be removed the end of August . Trustees Marsh and Hoff reported their findings on a drinking fountain and restrooms proposed for Liberty Park. Trustee White will contact the School concerning using their utility services . Trustee Hoff reported that the Evergreen tree killed by lightening will be taken down December 1 , 1990 and the boughes will be offered to the citizens for the Holidays . The dead trees will be removed from the Cemetery and five new trees will be planted next spring. Trustee Rau noted the $2000 in the 1990 Budget for playground equipment will be carried over to next spring. FINANCE AND Trustee Hovel read a letter from Prudential BUDGET Bache stating the deposits of CenTrust COMMITTEE Federal Savings Bank were assumed by Great Western Bank and that we were entitled to withdraw our funds without penalty. $67 , 589 . 50 has been trasferred into a Time Certificate for the Sewer Fund at the interest rate of 8% . A Time Certificate for The General Fund in the amount of $24 , 318 . 50 has also been taken at The Eaton Bank earning 8% interest . PAGE 3 , 1990 AUGUST 21 STREET AND Trustee White announced that M and A ALLEY construction will rinish concrete work COMMITTEE and Western Mobil will then do the patching. The Committee will meet and determine what patch work needs to be done . Trustee Hovel reported that the parking lot will be cleared . Next meeting bids will be received for paving the lot . The access permit has been applied for. M and A Construction will do the concrete work on the access .Trustee White reported that he had contacted the State Highway Department concerning resurfacing Main Street . They recommended that we contact our representative County Commissioners and stress the importance of resufacing Main Street . A meeting will be set with them. Trustee Marsh reported that he is contacting contractors for bids to mark parking spaces on Main Street . WELD COUNTY Trustee Hovel has contacted the County SANITARY and obtained The Certificate of Designation LANDFILL and The Use By Special Review Resolution, which lists the standards to be followed . A Transcript of the Hearing tape can be obtained for $60 . 00 . MOTION WAS MADE BY TRUSTEE HOVEL, to have the County Commissioners tape the hearing to have in our possession . VOTE WAS AS FOLLOWS : YEAS : Trustees Rau, Marsh, Hoff, Hovel Vigil , and Mayor Gieck 6 NAYS : Trustee White 1 MOTION CARRIED AULT CENTER Developer, David G. Clarkson presented GROCERY MARKET a proposal as the basis upon which a PROPOSAL grocery supermarket can be developed to serve Ault and the Highland community. He related that the establishment of a supermarket to serve the needs of the population of the Highland area is an economic development issue . He stated that the needs of the community are not being met and that the area residents do spend most of their food dollars in Greeley and Fort Collins . 111 He expressed his opinion that the future of the school system and the development of Ault is dependent on what the Town Board does to encourage growth and development . PAGE 4 , 1990 AUGUST 21 He stated that a demographic study showed approximately 6 , 700 people live within a five mile radius of the intersection of Main Street and Highway 85 . According to Clarkson , if 1 , 600 of those people would spend $25 . 00 per week at the new supermarket and the Town collected a 20 food tax, the Town would make back its investment in 4-5 years and over a 10 year period could see a return of over $500 , 000 . Groundbreaking would be September 1 , 1990 with opening of this 10 , 100 square foot` building, December 1 , 1990 . Steffens ' Market would provide 40 new jobs , 20 of them full-time . The Steffens ' family would make an investment of approxi- mately $500 , 000 in fixtures and equipment . Also proposed in the Steffens ' Market/ Ault Center were these possible additional future services : • Pharmacy adjacent to the grocery market . • Doctor ( financed by a Greeley or Fort Collins Hospital) • Hardware store Dry cleaner pick-up station Steffens ' Super Market , Inc . would be willing and able to put a new supermarket in Ault at the proposed West location if all the proposed commitments are met . These commitments are as follows : Financing: SOURCE OF FUNDS: State of Colorado Grant $150 , 000 .00 Town of Ault Incentive $200 , 000 . 00 Bank and Equity Financing $350 , 000 . 00 Total $700 , 000 . 00 PUBLIC PUBLIC OPINION PERIOD: OPIONS Approximately 20 residents were present and voiced their opions . Cecil Jackson: Considerations asked- What does Ault get out of this? Where does the $200, 0100 come from? Recommends public debate with respected financial annalist present . He suggested the proposed time frame was to short to make a decision . He advised some public economic development seminars . Freddie Hoover: Stated that the promoters should finance the grocery market , not the taxpayers . Page 5 , 1990 August 21 Charlie Kindsfather: Stated that we can ' t put up partial financing for one business coming in , without financing other businesses coming in the future. Larry Goettsch: Questioned why the proposed West location was more expensive than the proposed downtown location? Betty Loewen: Stated she would like to see this proposal brought to the vote of the people . Ed Wilson: Stated Steffens ' is the highest priced grocery store in the area. Ken Hahn: Stated he was in opposition of financing a new grocery market to put him out of business . J .T. Thompson: Questioned where the figures came from. Past survey showed fair to poor for the downtown location and poor at the west location . He also stated that the use tax dollars should not be used to subsidize new businesses . Harvey Nelson: A poll was taken at the Senior Center. All 75 were in opposition to the proposal. Peter Thompson: Requested Dave Clarkson enlighten us on the circumstances of the sale of Steffens ' in Windsor. Harvey Nelson: Ask Dave Clarkson about what additional services were planned in the new center. Freddie Hoover: Questioned how much sales tax is received from groceries , how much was received from Onion Growers on wholesale products sold? Dora Berry: Why didn' t Steffens ' build in Evans? TOWN BOARD OPION PERIOD: BOARD DISCUSSION Trustee White : Spoke in favor of the grocery market center. A new market would greatly improve Ault ' s economics . The Town as a whole would gain over the next twenty years . Trustee Hoff: To follow up on Larry Goettsch' s question , the originally proposed downtown center was going to cost the Town $320 , 00 to purchase and demolish the buildings . Page 6 , 1990 August 21 The Town was going to sell the land to the developer for $70 , 000 . 00 . His question is , why would it cost approximately the same amount for the West Ault location for one-half the facilities compared to the downtown location? Dave Clarkson answered that the downtown proposed market was larger, at that time other investers were available , interest was at a lower rate . Trustee Hoff calculated that at $200 , 000iavested by the Town that it would be a good investment ; at $350 , 000 the Town would do better investing in C.D. 's . Trustee Marsh: Stated the results of ' iris canvas of residences , showed that downtown location would be more favorable. lie stated that more time would be required and more information gathered to make a decision . Attorney Robert Burroughs was questioned as to the allowable amount of expenditure the Town Board was allowed to make without putting it to a vote of the people? The attorney advised that the expenditure has to be budgeted . If they are not revenue bonds the indebtedness has to be put to a vote of the people. Revenue bonds do not have to be put to a vote of the people . The original proposal provided that the parking lot would be deeded to the Town . Trustee Hovel: Questioned if this project is a public purpose issue? Is public access off of Highway 14 feasible? He stated if someone wants to establish a grocery market with their own funding, he would welcome them, but that taxpayers money should not be used for the funding. Trustee Rau: Received all negative responses from his canvasing . The Town shouldn ' t subsidize free enterprise . Tax dollars shouldn ' t go to a project of this type. MOTION WAS MADE BY TRUSTEE RAU, that the Town of Ault will not provide the source of funds in the amount of $200 , 000 toward financing Steffens ' Market to build at the West Ault location , however would welcome Steffens ' Market in Ault , providing that the store or its developer provide their own financing. • PAGE 7 , 1990 AUGUST 21 h - VOTE WAS AS FOLLOWS : YEAS: Trustees Rau, Marsh, Hoff , Hovel, Vigil and Mayor Gieck NAYS: Trustee White MOTION CARRIED There being no further business to come before the board , the meeting was declared adjourned at 10 : 45 P.
