HomeMy Public PortalAboutOrd. 1727 ORDINANCE NO.1727 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA AMENDING SECTION 6-3.16 OF THE LYNWOOD MUNICIPAL CODE WHEREAS, the City of Lynwood (the "City") is a general law city, incorporated under the laws of the State of California; and WHEREAS, the City Council delegated authority to the City's Purchasing Officer to issue Task Orders pursuant to a Master Services Contract for individual projects valued at less than $125,000 pursuant to Section 6-3.16 of the Lynwood Municipal Code; WHEREAS, the City Council desires to amend Section 6-3.16 of the City's Purchasing Officer's authority pursuantto a Master Service Contracts to issue Task Orders for individual projects valued at less than $50,000. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. The City Council does hereby find the above recitals correct and incorporate them herein as part of the findings. Section 2. Section 6-3.16 of Chapter 6 of the Lynwood Municipal Code is hereby amended to read as follows: 6-3.16 Master Services Contracts and Task Orders: Task Orders shall be issued pursuant to a Master Services Contract with a specific scope of work and the Purchasing Officer shall have authority to execute such Task Order for individual projects for one hundred twenty five thousand dollars ($ 125,000.00) fifty thousand dollars ($50,000) or less. Any Task Order in an amount exceeding one hundred twenty five thousand dollars 125,000.00} fifty thousand dollars ($50.000) shall require City Councils approval. Task Orders shall not be issued for an amount exceeding two hundred thousand dollars ($ 200, 000. 00). An individual Request for Qualification process and a new contract awarded by the City Council shall be required for amounts exceeding two hundred thousand dollars ($ 200, 000). The City Manager shall prepare and submit a report detailing all Task Orders authorized by the City Manager to the City Council on a monthly basis 1 1711 and any Section 3. This Ordinance shall supersede Ordinance No. subsequent ordinance relating to Section 6-3.16 of the Lynwood Municipal Code in effect as of the Effective Date of this Ordinance. Consistent with the Lynwood Municipal Code and State law, future amendments to Section 6-3.16 of Chapter 6 of the Lynwood Municipal Code shall require a majority vote of the City Council. Section 4. CEQA. The City Council on the basis of the whole record and exercising independent judgment finds that the proposed action is considered to be exempt from the provisions of the California Environmental Quality Act ("CEQA"), pursuant to Section 15061(b)(3) of the CEQA Guidelines, in that the proposed action does not have the potential for causing a significant effect on the environment. Section 5. Severability. If any section, subsection, sentence clause or phrase or word of this Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction or preempted by state legislation such decision or legislation shall not affect the validity of the remaining portions of this Ordinance. The City Council declares that it would have passed this Ordinance and each and every section, subsection, sentence clause or phrase or word not declared invalid or unconstitutional without regard to any such decision or preemptive legislation. Section 6. Adoption; Effective Date. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be published or posted according to law. This Ordinance shall become effective thirty (30) days after its adoption.
