AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
LYNWOOD, COUNTY OF LOS ANGELES, STATE OF
CALIFORNIA AMENDING SECTION 6-3.10 OF THE
LYNWOOD MUNICIPAL CODE
WHEREAS, the City of Lynwood (the "City") is a general law city, incorporated
under the laws of the State of California; and
WHEREAS, the proposed amendment to Lynw000 Municipal Code Section 6-3.10
allows the City Manager to more efficiently and timely manage the purchasing and
contracting of vital purchases and services reasonably necessary for the operation and
administration of the City; and
WHEREAS, the City Council delegated authority to the City's Purchasing Officer
to issue task orders pursuant to a master services contract for individual projects valued
at less than $125,000 pursuant to Section 6-3.16 of the Lynwood Municipal Code;
WHEREAS, the City Manager is authorized to sign and contract for supplies,
services, and equipment which do not exceed $25,000 pursuant to Section 6-3.10 of the
Lynwood Municipal Code; and
WHEREAS, the City Council desires to clarify Sections 6-3.10 and 6-3.16 by
clearly distinguishing the Purchasing Officer's authority to authorize task orders under an
existing master service contracts under Section 6-3.16 from the Purchasing Officer's
purchasing authority generally under Section 6-3.10 and clarify competitive bidding
exceptions.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. The City Council does hereby find the above recitals correct and
incorporate them herein as part of the findings.
Section 2. Section 6-3.10 of Chapter 6 of the Lynwood Municipal Code is hereby
amended to read as follows:
6-3.10 City Manager Authority:
The city manager or his/her duly authorized designee shall be authorized to
sign on behalf of the city all purchase orders or contracts for procuring
supplies, equipment, and routine services, and professional/special
servicesthat do not include any legal or consulting services, which do not
exceed a total contract or purchase order amount of twenty-five thousand
dollars ($25,000) in any one-year period. This section shall not be
construed to limit or otherwise restrict the authority delegated by the city

council to the city manager, as Purchasing Officer, pursuant to section 6-
3.16 of this chapter.
Section 3. This Ordinance shall supersede Ordinance No. 1711 and any
subsequent ordinance relating to Section 6-3.10 of the Lynwood Municipal Code in effect
as of the Effective Date of this Ordinance. Consistent with the Lynwood Municipal Code
and State law, future amendments to Section 6-3.10 of Chapter 6 of the Lynwood
Municipal Code shall require a majority vote of the City Council.
Section 4. CEQA. The City Council on the basis of the whole record and
exercising independent judgment finds that the proposed action is considered to be
exempt from the provisions of the California Environmental Quality Act ("CEQA"),
pursuant to Section 15061(b)(3) of the CEQA Guidelines, in that the proposed action does
not have the potential for causing a significant effect on the environment.
Section 5. Severability. If any section, subsection, sentence clause or phrase or
word of this Ordinance is for any reason held to be invalid or unconstitutional by a decision
of any court of competent jurisdiction or preempted by state legislation such decision or
legislation shall not affect the validity of the remaining portions of this Ordinance. The
City Council declares that it would have passed this Ordinance and each and every
section, subsection, sentence clause or phrase or word not declared invalid or
unconstitutional without regard to any such decision or preemptive legislation.
Section 6. Adoption; Effective Date. The City Clerk shall certify to the adoption
of this Ordinance and cause the same to be published or posted according to law. This
Ordinance shall become effective thirty (30) days after its adoption.
