AN ORDINANCE RELATING TO RESERVED RESIDENTIAL PARKING
BE IT ORDAINED by the Common Council of the City of Richmond that the following
ordinance be adopted:
I. DEFINITIONS
A. Residential District shall mean a contiguous or nearly contiguous area containing
public highways or parts thereof primarily abutted by residential property or
residential and non -business property (such as schools, parks, churches, hospitals
and nursing homes).
B. Curb Side Parking Space shall mean twenty (20) linear feet of curb, exclusive of
the portions of the curb where parking, apart from the provisions of this ordinance,
is not presently permitted.
C. Reserved Residential Parking shall mean a curb side parking space reserved
exclusively for the holder of a permit.
Il. APPLICATION FOR RESERVED RESIDENTIAL PARKING PERMIT
A. An application for reserved residential parking permit shall provide the following
information:
1. The name and residential address of the owner of the vehicle.
2. The name, residential address and driver's license number of the principal
operator of the vehicle.
3. The make, model, license plat number and registration number of the
vehicle, and the signature of the applicant for the reserved residential
parking permit.
B. The application for reserved residential parking permit shall be directed to the Board
of Public Works and Safety, who shall schedule a hearing on the permit within
thirty (30) days of receipt of the permit. The applicant shall send notice of the
hearing for the application for residential parking permit to all adjacent property
owners and their tenants at least ten (10) days before the date of the hearing.
Additionally, the applicant shall provide notice in accordance with Indiana Code
Section 5-3-1, and provide proof of publication to the Board of Public Works and
Safety.
1II. REQUIREMENTS FOR RESERVED RESIDENTIAL PARKING PERMIT
A. Reserved residential parking is permitted in residential districts only.
B. The total number of curb side parking spaces occupied by vehicles must equal or
exceed 90% of the number of curb side parking spaces on the public highway of
the one block area of the proposed reserved residential parking permit area.
C. The applicant must demonstrate an inability to park within 50 feet of the curb side
parking space closest to the applicant's residence at least 50% of the time in the
sixty (60) day period immediately preceding the date of application.
D. The applicant demonstrates a hardship, unique to the residents of the area, that
requires a curb side parking space close to the applicants residence.
E. The application shall be reviewed by the City Engineer and the Richmond Police
Department Traffic Division for satisfaction of the above requirements.
IV. APPROVAL OR DENIAL OF RESERVED RESIDENTIAL PARKING PERMIT
A. Within thirty (30) days of the close of the public hearing, the Board of Public
Works and Safety shall decide whether to designate a curb side parking space as a
reserved residential space for the applicant.
V. ISSUANCE OF RESERVED RESIDENTIAL PARKING PERMIT
Upon the applicant's payment of a $25.00 reserved residential parking permit fee,
the applicant shall receive one (1) reserved residential parking permit for the vehicle
described in the application. The permit shall be securely affixed to the inside
bottom left corner of the front windshield of the vehicle and shall display the
following information:
The license plate number and registration number of the vehicle.
2. The numerical designation of the reserved residential parking permit area.
3. The expiration date of the reserved residential parking permit shall be
December 31 of each year.
Upon issuance of a reserved residential parking permit, a reserved residential
parking area parking sign shalt be erected in the designated area. The sign shall be
of such character as to readily inform an ordinarily observant person of the reserved
parking area.
VI. VIOLATION OF ORDINANCE
A. It shall be a violation of this ordinance to park in a reserved residential parking
space without a permit to do so. The owner of a vehicle in violation of this section
shall be liable as well as the operator.
B. It shall be a violation of this ordinance for the holder of a permit to fail to surrender
it when directed to do so.
C. It shall be a violation of this ordinance for any person to represent that a vehicle is
entitled to a parking permit authorized by this ordinance when it is not so entitled.
The display of a parking permit on a vehicle not entitled to such a parking permit
shall constitute such a representation.
D. It shall be a violation of this ordinance for any person to duplicate or attempt to
duplicate, by any means, a parking permit authorized by this ordinance. It shall be
a violation of this ordinance for any person to display on vehicle such a duplicate
parking permit.
E. A person who violates this ordinance shall be subject to a $50.00 fine.
VII. RENEWAL OF PERMITS.
Parking permits under this ordinance may be renewed annually upon re -application by the
permit holder and upon approval by the Board of Public Works and Safety after the board
has determined that the holder continues to meet the requirements for reserved residential
parking. It shall not be necessary to comply with the notice requirements under this
ordinance upon application for renewals.
VM. WITHDRAWAL OF RESERVED RESIDENTIAL PARKING DESIGNATION
A designation of curb side parking space as a reserved residential parking space may be
withdrawn upon application by the permit holder, an adjacent property owner or tenant, or
by the Board of Public Works and Safety on its own initiative. The same procedure
employed in designating a reserved residential parking space shall be employed when
withdrawing the designation.
IX. This ordinance shall become effective upon publication in the Richmond City Code.

Reserved Residential Parking Ordinance

Council Member James Hankinson is sponsoring the
Reserved Residential Parking Ordinance. The Reserved
Residential Parking Ordinance provides a procedure under
which residents under certain conditions can obtain a
specifically reserved parking space in the street near
their residences. Under this process, a person desiring
a reserved parking space must first apply to the Board
of Public Works and Safety. The person must demonstrate
that he is normally unable to park near his residence,
and that he needs a space close to his residence because
of a particular hardship. Once the matter is approved
by the Board of Public Works and Safety, the space must
then be approved by a vote of Council.

Within forty-five (45) days following receipt of the report, the Common Council
shall vote whether to designate a curb side parking space adjacent to the applicant's
residence as a reserved residential curb side parking space.
V. ISSUANCE OF RESERVED RESIDENTIAL PARKING PERMIT
A. Upon the applicant's payment of a $25.00 reserved residential parking permit fee,
