MINUTES OF THE REGULAR MEETING OF COUNCIL HELD
THIS EVENING AT 7:00 P.M.

CONFIRMATION MOTION MADE BY TRUSTEE HOVEL, for confirmation of
10/16/90 the minutes of the regular meeting of the Board,
MINUTES dated 1990, October 16.
MOTION CARRIED
APPROVAL Accounts payable 1990, October 16 thru November 20
ACCOUNTS were reviewed. The School is to be billed for one-
PAYABLE half of the bill from Lesh Drilling for compressor
time, blowing out sprinkler lines, as well as one-
half of the maintenance man ' s hours. Police fuel
will be kept seperate in the future and monitored
closely. V.F.W. is to be billed for their portion
of paving cost $460.66. Insurance policy is to be
reviewed. MOTION WAS MADE BY TRUSTEE RAU, to pay
the accounts payable as presented,
MOTION CARRIED
SEALED BIDS One sealed bid was opened and read for the used
USED POLICE police car from Arnold Schwab for $100.00. MOTION
CAR WAS MADE BY TRUSTEE HOOVER, SECONDED BY TRUSTEE
HOFF, to accept bid from Arnold Schwab for $100.00
for the used police car.
MOTION CARRIED
LIQUOR MOTION WAS MADE BY TRUSTEE HOVEL, to renew the
LICENSE Liquor License for Dicks Tavern.
RENEWALS MOTION CARRIED
MOTION WAS MADE BY TRUSTEE MARSH, to renew the
Liquor License for the V.F.W.
RESOLUTION MOTION WAS MADE BY TRUSTEE MARSH, to rescind a
RESCIND previous motion to repeal the town ' s 2% food tax.
FOOD TAX After further research into this matter, including
REPEAL consulting the Colorado Department of Revenue and
the Colorado Municipal League, it was determined
that the Board acting alone cannot repeal the food
tax but it must be put to a vote of the people.

RETAINMENT MOTION WAS MADE BY TRUSTEE HOVEL, to resolve to
COLE AND CROSIER engage Cole and Crosier to perform the Town's
III audits for 1990, 1991 , and 1992 at a cost of
$5,200, $5,000, and $4,800 for each year respectively.
MOTION CARRIED
WATER MOTION WAS MADE BY TRUSTEE MARSH, to purchase
PURCHASE twelve shares of Colorado-Big Thompson water for
$1 ,500 per share, for a total of $18,000.
MOTION CARRIED
WELD COUNTY MOTION WAS MADE BY TRUSTEE HOFF, to consent to Weld
HEALTH DEPT. County Health Department to provide services and
SERVICES collect fees for environmental inspections pursuant
AND FEES to CRS section 25-1-507 (1 )(h) .

FORMATION RESOLUTION WAS MADE BY TRUSTEE HOFF, to form the Ault
AULT WATER Water Planning Authority, a committee of five members
PLANNING to be appointed by the Mayor. The purpose of the
AUTHORITY authority is to keep council appraised of the water
situation. One member is to be a Council member the
four other appointed citizens.
RESOLUTION CARRIED
CLERK'S MOTION WAS MADE BY TRUSTEE HOVEL, to adjust the Clerk's
SALARY salary to $20,000, retroactive to November 1 , 1990 and
to reimburse her for travel expenses retroactive to the
date she began serving as clerk.
MOTION CARRIED
APPOINTMENT MOTION WAS MADE BY TRUSTEE HOOVER, to appoint Trustee
TO PUBLIC Hoff to the Public Building Authority.

FIRST DRAFT The first draft of the 1991 proposed budget was sub-

29, 1990 at 7:00 P.M.

FINANCE The Treasurer reported a balance of $153, 184.00 in the

be closely monitored the end of the year, financial
requirements for January and February 1991 established
and a decision for purchase of additional water made by
the end of 1990.
PUBLIC The budget will be open for public inspection at the

SURCHARGE MOTION WAS MADE BY TRUSTEE RAU, to establish an
ON FINES ordinance imposing a surcharge on all fines im-
posed by the Municipal Court, the proceeds of
which are to be deposited into a special revenue
account to be used only for law enforcement training
for Town of Ault police officers.

EXECUTION The contract for police protection for Pierce has

PLANNING Trustee Hoff reported that Ray Larson is inquiring
COMMISSION about changing the zoning of industrial park to
Estate. The Graefe property west of Ault would
like to section two partials off and sell it.
WATER AND Trustee Rau expressed a desire to purchase more water
SEWER before the end of the year if funds are available.
STREET AND Trustee Hovel reported work had been completed for 1990.
ALLEY Trustee Hoover will contact a contractor to replace
sidewalk across alley on Graefe Street.
LIBRARY The Library owes the Town $1 ,200 for bookkeeping for
BOARD 1990. A check will be written.
TRUSTEE Mayor Gieck read the Letter of resignation of Phyllis
VIGIL'S Vigil from the Ault Town Board for personal reasons.
RESIGNATION
There being no further public business to come before
the board, the meeting was declared adjourned at 8:45
P.M. The council resumed in executive session
following adjournment.

Dear Sir:
This AGREEMENT, made and entered this 19th day of November, 1990 by and
between The TOWN OF AULT, a Colorado Municipal Corporation, hereinafter
called "Town" , and Tom Boyer, hereinafter called "Contractor".
WHEREAS, the Town has placed for bid tree work at various locations. The
first location is Liberty Park. On the northeast corner of the park is a
lightning struck Spruce tree which is to be removed completely, including
stump. The tree will be cut down and left until Christmas for townspeople
to retrieve boughs and firewood. The total price for the removal of the
Spruce tree is $190.00.
The second location is Eastside Park where a large Chinese Elm stump with
new growth will be sawed down, stump removed, materials disposed of for a
total price of $190.00.
The third location is the cemetery where one Ash tree and stump would be
removed. Additionally, four Ash trees, two Hackberry trees and twenty three
Chinese Elms would be pruned including removal of the dead wood, heavy tips,
low branches and shaping for a total price of $675.00 at the cemetery. An
addition to the contract will be at the Physical Plant at 1907 Graefe
Avenue. Five Ash trees will be completely pruned. All dead wood , heavy tips
and shaping of these trees is to be included in the estimate provided to the
Town before commencing the work at the Physical Plant. All usable firewood
is to be cut and dumped at a site indicated by the Town Board. Work on this
contract is to be completed on or before December 31 , 1990.
The Contractor shall obtain General Liability Insurance in the attached
amount and shall provide the Town of evidence thereof.

ENCLOSED IS A COPY OF THE EATON ORDINANCE CONCERNING A SURCHARGE ON
TRAFFIC AND CRIMINAL MATTERS WRITTEN INTO TOWN COURT. BY HAVING A
SURCHARGE ON TICKETS A DEPT. CAN BUDGET LESS FOR TRAINING AND THE
PERSONS POLICE ARE MOST IN CONTACT WITH ARE THE ONES WHO PAY FOR THE
TRAINING.

ORDINANCE NO. 409
AN ORDINANCE IMPOSING A SURCHARGE ON ALL FINES IMPOSED BY THE
MUNICIPAL COURT THE PROCEEDS OF WHICH ARE TO BE DEPOSITED INTO
A SPECIAL REVENUE ACCOUNT TO BE USED ONLY FOR LAW ENFORCEMENT
TRAINING FOR TOWN POLICE OFFICERS
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF EATON,
COLORADO:
Section 1 . Chapter V of the Eaton Municipal Code shall be
amended by the addition of a new Section 5-2-18 to read as follows:
5-2-18 Surcharge on Municipal Fines.
( a) After determining the appropriate fine for each person
who is convicted of violating an ordinanceofthe Townn of Eaton,
Colorado, the Municipal Judge shall add
