The Council of the City of Medina met in regular session on Tuesday February 20, 1979
162 at 7:40 P. M.
Members present: Mayor, Thomas Anderson; Council members, Thomas Crosby, Sarah Lutz,
Bill Reiser, Assistant Clerk, Sylvia Rudolph; planning & Zoning
Administrator, Robert Derus; public Works Director, Ron Duran;
police Chief, Charles Hoover; Attorney, Richard Schieffer;
Engineer, Lyle Swanson.
Member absent: Nancy Laurent- until 8:10 P. M.
1. MINUTES OF JAN. 23, and FEB. 6, 1979:
Motion by Thomas Crosby, seconded by Bill Reiser, to accept the minutes with the
following deletions and additions to be made on the January 23, 1979 minutes, page 155.
To Delete: First paragraph, and Add: The Council discussed salaries, overtime pay and
paid holidays for all City employees. The employees stated generally that they believed
their salaries to be behind comparable salaries in like municipalities. Comparisons of
salaries for like positions were offered by the employees.
Thomas Anderson indicated that he had calculated that it would take in excess of 10% to
keep up with inflation and that he favored an increse in that area.
Thomas Crosby stated that he felt that it was appropriate to stay within the federal
guidelines of 7%. He cited several examples of organizations that had stayed within the
guidelines including the Orono School System in its negotiations to date and the Cities
of Orono and Minnetonka. He also referenced a newspaper article in the Minneapolis
Tribune to the effect that 800 municipalities had agreed to the federal guidelines.
Mr. Crosby noted that his desire to limit the increases to 7/ was not a lack of confid-
ence in the City employees but reflected his desire to see City attempt to curb inflat-
ion by observing the guidelines. With increases of approximately 15% last year, he
believes that the City is doing its best to ”catch up” with other municipalities.
Several employees noted that either 7,l or 10% was insufficient and that they would be
forced to consider collective bargaining or looking for employment elsewhere. Mr.
Crosby indicated that the Council was faced with a difficult decision but that it did
have a certain responsibility to its constituents.
Mr. Crosby indicated that he would be amendable to opening the salary discussions in
the middle of the year or earlier if the general guidelines of 7% did not “sticku because
of events on the national scene.
2. PENNY ELSENPETER - PARK COMMITTEI,M
penny Elsenpeter, representing the park Committee requested direction from the Council
as to the funding that is available for park improvements. How much they can spend
and over how many year period. She also stated that Medina Morningside would like to
have a sewer stub put in the park area for future use when the sewers are installed in
that area. The park Committee would also like a Council member to sit in on park and
Recreation meetings, the next one being March 21st, 1979.
3. POLICE DEPT. - OPEN BURNING ORDINANCE
Tabled the Open Burning Ordinance until the March 6, 1979 meeting. The attorney
needs more time to prepare.
Motion By Tom Crosby, seconded by Bill Reiser to send Bob Anderson to Emergency
Medical Technican School from March 20th to May 17th, 1979 at a cost of $95.00
Motion carried.
4. PUBLIC WORKS - NORTHWESTERN BELL TELEPHONE CO.
Motion by Sarah Lutz, seconded by Tom Anderson to adopt Resolution 79-3, allowing
Northwestern Bell Telephone Co. to bury cable on 1525 Hunter Drive So.
Motion carried

Motion by Bill Reiser, seconded by Sarah Lutz to accept the fuel bid of Donald Mayer,
Inc. for a blend of fuel as follows;
3,000 gallons #2 Deisel @47.9 - $1,437.00
1,000 gallons #1 Deisel @50.9 - 509.00
Total - $1,946.00

5. PUBLIC HEARING - MEDINA MORNINGSIDE SEWER - 8:05 p. M.
Lyle Swanson explained the estimated costs of installing sewers in Medina Morning-1 (yi
side, the by pass line through Long Lake, and also the street improvements in
Medina Morningside, a 28 ft. wide street with 6“ gravel, 1211 crushed rock and 3"
blacktop, also the alternate storm sewer to allow residents to drain basements into
another pipe in the street.

He also explained the assessment per lot based on 85 lots.
Federal Grants will not be available until 1981-82.
Ray Odie was present to explain the role of the pCA and Metro Waste Control and the
possibility of obtaining construction grants. Their consultant has looked over
conditions in the Medina Morningside area and ruled out upgrading on -site systems in
that area.
phil Chenowith explained the Financing of the 1979 Sewer Improvements, with assess-
ments per lot spread over 20-25-30 years with and without the added storm sewer.

Is it possible to do the work in the streets, storm & sanitary
sewers now and wait for the Federal Funding to hook up.
Yes, it is possible to continue using on -site systems, but you
still would have to come back and tear up property to hook-up.
Doesn't state law require road to be 38 ft. wide? Are you familar
with 3 drain tiles in the area and will you hook-up tile to sewer?
I will check into the law on width of road.
28 ft. wide road would save money.
What is the possibility of the City buying the water system from
Bergerson-Caswell? What if the Contractor does damage to the water line?
The contractor has to put a performance bond.
They look at -replacing the system at todays rate versus what it is
worth to us.
Do a Feasibility Study and take over the water system.
Asked that the water system be looked into.
What portion of the $711,000.00 is for work in Medina Morningside?
All but $140,000.00.
Any consideration for go -Tech?
No room for Vo-Tech, 83 Lots are all that will ever be hooked up.
None of the lots in Medina Morningside are susceptable to be divided.
The 4 houses to the north will derive benefit, Should they share in
the cost.
No consideration given to those sharing costs.
Would the City bring the streets to original condition if project is
not accepted.
We will fix the best we can, not the way they should be.
Would city pay for repairing to original condition of 2-3 years ago.
Compare this to Holy Name Drive
The Council hasn't decided if improvements of this type should be
paid for by people living on these roads. If you don't solve surface
water problems, you are wasting money.
We paid for them once, why again.
The people in Independence Beach paid for theirs also and paid again
with the sewer project.
The city would consider splitting costs if sewer project is not done.
We have a good sewer, but need good roads to get in and out.
Roads have to be repaired and sewers should be put in at the same
time because of the sanitary problems.
We haven't forgotten about the road problem. We prefer to find out
about sewer project.
3 years ago Vo-Tech inquired about the possibility to bring Sanitary
Sewer to the area. Road problems peaked last year.
Will the Storm Sewer lower the water table?
Foolish to build streets and not do sewers, but it is better to have
Sanitary than Storm Sewer.

Alternate system is designed for that. They will have to tile basements.
The $60,000.00 Alternate Sewer in streets will be used to drain basements.
When the Sanitary Sewer goes in, you will have a certain time to hook-up
and your present septic tank filled.
How many people have a tile system to drain basements? 17 do, 5 don't.
How many would consider to use the alternate system to drain basements?
7 have wet basements, 10 feel it is not necessary.
Will the DNR tell us that it is not legal to use septic systems for
draining basements.
Do we pay SAC charges?
Sac charges will continue.
Is there any other hook-up charge?

Asked for a show of hands favoring Sewer project. 22 in favor, 1 opposed.
How soon do we react to Sewer project?
Do immediately and not wait for funding. Let road settle and final
paving done in 1980.

6. BILL CLELLAND - CEASE & DESIST ORDER
Bill Clelland explained the Cease and Desist Order and recommended that the City not
contest this order. But re -write to say +I All Sworn Certified police Officers, excluding
all Clerical, Dispatchers, Janitors, etc.n He will advise the Law Enforcement Labor
Services, Inc. of this decision and report back to the council.
7. LOREN KOHNEN
Loren Kohnen was interview by the council and gave his references for approval. He
proposed some alternatives for payment. Council directed Bob Derus to check the costs
of these alternatives and report back to council.
8. BILL SINE - JIM BURDICK
Bill Sime and Jim Burdick appeared before the Council to get clarification about the
rights involved with the purchase of 5 acres from Jim Burdick. The following questions
were asked of the council (1) Is it permissible to purchase 5 acres (2) Can he use Citys
easement to his property (3) Can he use the 4 ton roads, Hamel Road and pinto Drive, for
access seeing that some deliveries will be overweight. After discussion the Council
gave the following recommendations. (1) The 5 acres could be purchased providing that
there is no land locked parcels created (2) gave permission to use citys easement. (3)
Have Lyle Swanson find out what it would cost to upgrade pinto Drive and Hamel Road to
Hickory Drive to 7 ton roads.
9. STEVE MUTH
Steve Muth appeared before the Council to present a plan of his proposed road. After
considerable discussion the council recommended that they would not guarantee that the
city would accept the road because of the 500 ft cul-de-sac and the maintenance cost of
serving only 1 or 2 homes would be too great.

11. PLANNING COMMISSION APPOINTMENTS
Motion by Sarah Lutz, seconded by Bill Reiser to accept the reappointments of Anne
Theis, Jack wahlfors, Ronald Fortin, to expire March 1, 1982
Motion carried.
12. SAC CHARGE REFUND
There will be ;80,000.00 refund to the city from the Metropolitan waste Control
Commission after it is approved by District Court. After much discussion the Council
authorized the attorney to study who has the rights to the refunds.
13. TREASURER
Richard Schieffer will prepare an Ordinance combining the Clerk -Treasurer position and
have ready for the March 6, 1979 meeting.
14. BILLS
Motion by Thomas Crosby, seconded by Sarah Lutz to pay bills, payroll checks
#5264-5270 in the amount of 52,895.08
