HomeMy Public PortalAbout042-1990- ZONING - 1500 BLK OF HIGHLAND RD ON THE NORTHSIDEAMENDED ORDINANCE NO.42-1990 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO.2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY LOCATED IN THE 1500 BLOCK OF HIGHLAND ROAD, ON THE NORTH SIDE, FROM A-1 AGRICULTURAL DISTRICT TO A-1 SU AGRICULTURAL SPECIAL USE DISTRICT AND AUTHORIZING THE SPECIAL USE OF SAID PROPERTY AS A PSYCHIATRIC HOSPITAL. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as A-1 Agricultural District the property located in the 1500 block of Highland Road, on the north side; and, WHEREAS, it is the intent and purpose hereof, to change the zoning classification of said property from A-1 Agricultural District to A-1 SU Agricultural Special Use District and to authorize the specal use of said property as a psychiatric hospital; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the YV'7day of QuZj4,1990, at which time remonstrances were heard froM all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was L6 to _,Q in favor of/i recommending the passage of Amended Ordinance No. 42-1990. NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to A-1 SU Agricultural Special Use District and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. Being part of the south half of the Southwest Quarter of Section Sixteen (16), Township Fourteen (14) , Range One (1) containing 7 acres more or less, in Wayne Township, Wayne County, Indiana, and being more particularly described as follows: Beginning at the southeast corner of Southwest Quarter of Section Sixteen (16); thence along the south line of said Southwest Quarter of Section Sixteen (16), Due West for four hundred and 00/100 (400.00) feet; thence parallel to the east line of said Southwest Quarter of Section Sixteen (16), North no degrees five minutes no seconds (00-05'00") East for seven hundred sixty-two and 30/100 (762.30) feet; Amended Ordinance No. 42-1990 Page 2 thence parallel to the south line of said Southwest Quarter of Section Sixteen (16), Due East for four hundred and 00/100 (400.00) feet to a point in the east line of said Southwest Quarter of section Sixteen; thence along the east line of said Southwest Quarter of Section Sixteen (16), South no degrees five minutes no seconds (00-05'00") West for seven hundred sixty-two and 30/100 (762.30) feet to the point of beginning containing seven and 000/1000 (7.000) acres, more or less, subject however to all covenants, conditins, restrictions, reservations, and easements contained in any instrument of record pertaining to the above described tract of land. SECTION 2. That as provided in Articles 25 and 48 of Chapter 154 of the Code of Ordinances, the following described use of the above described property is allowed as a psychiatric hospital. SECTION 3. That as a condition of being granted the special use and as an additional restriction on said use, the following requirements shall hereafter and at all times be met by the owner of said real estate. A. The Special Use site plan and petition shall be marked Exhibit A and made a part of this Ordinance. SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval as by law aquired. Mayor ATTEST: City Clerk CITY PLAN COMMISSION RICHMOND, INDIANA August 2, 1990 Mrs. Jane Brookbank, President Members of Common Council and Mrs. Mary Merchanthouse, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 42-1990 Plan Commission Case PC-90-12 Dear Mrs. Brookbank, Members of Common Council and Mrs. Merchanthouse: The Richmond City Plan Commission conducted a public hearing on Tuesday, July 24, 1990, on the petition of Nicholas and Mary Delucio, owners, Robert Bever, agent requesting a rezoning from A-1 Agricultural District to A-1 SU Agricultural Special Use District and also requesting special use authorization for a psychiatric hospital on property located in the 1500 block of Highland Road on the north side. The property in question is presently zoned A-1 Agricultural District. United Psychiatric Group is proposing to purchase 7 acres from Nick and Mary Delucio and construct a 55 bed, for profit, psychiatric hospital. The Traffic Division of the Police Department, the Fire Department, the City Engineer's Office, the Wayne County Highway Engineer, the North Richmond Regional Sewer District and the Richmond Sanitary District have reviewed the petition and have not identified any concerns. Thirteen (13) notices of public hearing were sent to the residents surrounding the site. One (1) notice was returned to the Plan Department not oppossed to the petition and one (1) notice was returned oppossed to Ordinance No. 42-1990 Page 2 the petition. During the public hearing Mrs. Beth Hillenmeyer spoke in favor of the petition, indicating the need for such health care services in the community. Mr. Jim Kinnett, Economic Development Director, informed the Commission that he had worked with the petitioner to assist efforts to locate in Richmond. Mr. Tom Atkinson, Board President of the North Richmond Regional Sewer Distict, informed the Commission that the regional sewer had capacity to serve the proposed project. Two (2) persons spoke in opposition to the petition. Dr. D. Semko cited concerns about sewer capacity to handle the project. Mr. Jeff Nordstrom cited conerns about decreasing neighborhood property values and additional traffic. The Plan Commission determined that the petition complies with the requirements of the Zoning Ordinance. The legal description presently written in the Ordinance is in error and needs to be amended. Therefore, the Commission voted ten (10) to zero (0) to recommend to Council that Ordinance No. 42-1990 be amended to incorporate the correct legal description and that the amended Ordinance be adopted.
