HomeMy Public PortalAbout043-1990-DEFEATED-ZONING- 2000 BLK OF HAWKINS RD ON THE NORTHSIORDINANCE NO. 43-1990 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO.2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY LOCATED IN THE 2000 BLOCK OF HAWKINS ROAD ON THE NORTH SIDE, FROM R-3 ONE TO EIGHT FAMILY RESIDENCE DISTRICT TO M-2 GENERAL INDUSTRIAL DISTRICT. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as R-3 One to Eight Family Residence District the property located in the 2000 block of Hawkins Road, on the north side; and, WHEREAS, it is the intent and purpose hereof, to change the zoning classification of said property from R-3 One to Eight Family Residence District to M-2 General Industrial District; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the day of ,1990, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was to_ in favor of/in opposition to recommending the passage of Ordinance No. 43-1990. NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to M-2 General Industrial District and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. Lots 235, 236, 237, 238, 239, 240 and 241 in the Morton, Lake & Park Second Addition to the City of Richmond. SECTION 2. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. Mayor ATTEST: City Clerk CITY PLAN COMMISSION RICHMOND, INDIANA August 2, 1990 Mrs. Jane Brookbank, President Members of Common Council and Mrs. Mary Merchanthouse, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 43-1990 Plan Commission Case PC-90-11 Dear Mrs. Brookbank, Members of Common Council and Mrs. Merchanthouse: The Richmond City Plan Commission conducted a public hearing on Tuesday, July 24, 1990, on the petition of Ashland Oil Company, owner; Louis Schutte, agent requesting a rezoning from R-3 One to Eight Family Residence District to M-2 General Industrial District on property located at the northeast corner of North 20th Street and Hawkins Road. The property in question is presently being used by Ashland Oil as a part of their asphalt emolsion operation for equipment storage and vehicle parking. The storage and parking use of this property would be considered non conforming under the terms of the Zoning Ordinance. Ashland Oil Company is requesting that the non conforming property be rezoned to the M-2 District so that the zoning classification reflects the actual useage of the property. Eleven (11) notices of public hearing were sent to the residents surrounding the site. One (1) notice was returned to the Plan Department not oppossed to the petition and one (1) notice was returned oppossed to Ordinance No. 43-1990 Page 2 the petition. During the public hearing Mr. Dan Stamper spoke in opposition to the petition. Mr. Stamper cited concerns about decreasing neighborhood property values. The Plan Commission voted seven (7) to three (3) to recommend to Council that Ordinance No. 43-1990 be denied. Respectfully submitted, Daniel S.
