AN ORDINANCE RELATING TO RESERVED HANDICAPPED RESIDENTIAL PARKING.
BE IT ORDAINED by the Common Council of the City of Richmond that the following ordinance be
adopted:
SECTION 1. Section 74.29(a) of the Richmond City Code shall be amended as follows:
The Board of Public Works and Safety of the City of Richmond, Indiana, shall
reserve parking spaces on municipally owned parking spaces of City streets for
the exclusive use of physically handicapped persons in accordance with the
requirements of Indiana Code Section 5-16-9-1, et. seq., and shall also reserve
parking spaces of City streets in residential areas for the exclusive use of a
designated physically handicapped person.
SECTION Il. Section 74.29(c) of the Richmond City Code shall be amended as follows:
Persons requesting handicapped parking spaces in residential areas shall meet
the following requirements:
1. Person requesting must not have off-street parking available at the
site of the proposed handicapped parking space.
2. Person requesting must either:
( a) be handicapped himself/herself, or
( b) reside with the handicapped person and be responsible for
his/her transportation, or
( c) not reside with the handicapped person, but be primarily
responsible for his/her transportation.
Requests meeting the criteria of (a) or (b) will generally be in
the nature of a handicapped parking space, as near as possible to
the residence, and limited to one space per residence.
Requests meeting the criteria of (c) may require supporting
evidence of frequency of transportation of the handicapped
person, and may be granted in the form of a 'loading zone" type
limited -time handicapped space where traffic flow would justify
such. The space is to be located at the residence of the
handicapped person.
3. The space cannot conflict with any parking restriction already in
place, or restrict the normal flow of traffic. Where existing parking
restrictions limit only the duration of parking (as in a two-hour
limit), a "loading zone" type limited -time handicapped space may be
issued. Where no parking is allowed at all, or is not allowed during
designated hours due to restriction of traffic flow, no handicapped
space will be designated.
4. Person requesting the handicapped space shall notify the Traffic
Division of the Richmond Police Department when the handicapped
plate or placard expires or when the person requesting or the
handicapped person moves, so that the sign designating a handicapped
parking space can be removed.
5. Requests for residential handicapped parking spaces will be granted
for a term of one (1) year, renewable annually by request in writing
to the Board of Public Works and Safety stating that the facts of the
original request remain true. The renewal request may be made by
letter to the Office of the City Clerk during the period from thirty
(30) days prior to thirty (30) days after date one (1) year from the
granting of the request. If no renewal has been received by the Clerk's
Office thirty (30) days after this one (1) year date, the handicapped
parking sign may be removed by the Traffic Division without notice to
the person requesting. The Traffic Division shall keep accurate
records of requests granted and dates granted.
6. Persons who are granted a residential handicapped parking space shall
pay an initial fee of $25.00. Persons whose handicapped spaces are
renewed shall pay a renewal fee of $5.00.
SECTION III. A new sub -section D shall be added to section 74.29 of the Richmond City Code
and shall read as follows:
Designation of a parking space is one for the exclusive use of the handicapped
person and shall not exempt the space nor the vehicle parked in that space from
any other applicable traffic or parking laws, statutes, ordinances or
regulations unless so determined by the Board of Public Works and Safety. The
owner of the vehicle parked in violation of this section shall be subject to a
Fifty Dollar ($50.00) fine payable in the office of the City Clerk in the City of
Richmond, Indiana.

Ordinance No. 49-1990 is proposed by Mr. Metzger to address the concerns voiced at the last Council
meeting. The Ordinance is totally different language and after speaking with Mr. Metzger, it was
decided to propose as new ordinance for the Reserved Residential Handicapped Parking rather than
amend Ordinance No. 36-1990 which Council tabled for rewording.
It is requested that Council bring Ordinance No. 36-1990 off the table and strike it from the agenda.

Indiana will hold a public hearing on Monday, August 6, 1990 at 7:30 P.M. in the
