A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD,
COUNTY OF LOS ANGELES, STATE OF CALIFORNIA AUTHORIZING
THE EXECUTION OF A PROFESSIONAL SERVICE AGREEMENT WITH
MARK GROH FOR THE PURPOSE OF PROVIDING ADMINISTRATIVE
HEARING SERVICES AS REQUIRED UNDER LYNWOOD MUNICIPAL
CODE CHAPTER 20-9 (HEARING OFFICER)
WHEREAS, The City of Lynwood is a general law city under California law with a
recognized mandate to preserve, protect, and enhance the general health and welfare of
its residents.
WHEREAS, the Lynwood Municipal Code Chapter 20-3 "Issuance of
Administrative Citations, Fines" provides the authority to issue administrative citations for
violations of the City municipal code; and
WHEREAS, the Lynwood Municipal Code Chapter 7-20 "Stopping, Standing and
Parking" provides the authority to issue citations for violations of the City municipal code
and the State of California Vehicle Code; and
WHEREAS, the Lynwood Municipal Code contains certain administrative fines,
which are established by the City Council; and
WHEREAS, any citation issued or vehicle towed by the City of Lynwood is provide
an opportunity to appeal the violation and offered an administrative hearing; and
WHEREAS, all administrative hearings are conducted by a neutral third party not
associated with or employed by the City of Lynwood; and
WHEREAS, the City Council has the authority of selecting a panel of hearing
officers that the City Manager or his designee may then select from to provide hearing
services; and
WHEREAS, the Lynwood Municipal Code Section 6-3.13(a)(3) "Exceptions"
provides that the City Council may bypass a Request For Proposal (RFP) process when
the service could only be obtained from one source; and
WHEREAS, the City of Lynwood has an immediate need for a new hearing officer
and found that there is a lack of hearing officers within the area; and
WHEREAS, the City of Lynwood desires to utilize the services of Mark Groh
("Consultant"), as an independent consultant, to provide hearing services for the City as set
forth in the Scope of Work (Exhibit 'A') to the attached proposed Agreement; and
WHEREAS, Mr. Groh represents that he is fully qualified to perform such services
by virtue of his education, training, and experience; and

WHEREAS, it is in the best interest of the City, due to the lack of hearing officers
within the area, to contract with Mark Groh for hearing services while the City goes
through the Request for Proposal process.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBY FIND, PROCLAIM, ORDER, AND RESOLVE AS FOLLOWS:
Section 1. Pursuant Section 6-3.13(a)(3) "Exceptions" of the Lynwood
Municipal Code, the City Council may bypass a Request For Proposal (RFP) process
when the service could only be obtained from one source.
Section 2. The City Council finds that there is an immediate need for a new
hearing officer and found that there is a lack of hearing officers within the area.
Section 3. The City Council herby authorizes the Mayor to execute a
Professional Service Agreement (in a form approved by the City Attorney) with Mark Groh
for hearing services for the term November 1, 2019 — June 30, 2020, at an amount not to
exceed $5,000.
Section 4. This resolution shall be effective immediately upon adoption.
Section 5. The City Clerk shall certify to the adoption of this resolution and
hereafter the same shall be in full force and effect.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the City Council of the
City of Lynwood, California, this 5th day of November 2019.
