Home My Public Portal About053-1990-ZONING - 1200BLK OF SOUTH 23RD ON THE EASTSIDEORDINANCE NO. 53-1990 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO.2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY LOCATED IN THE 1200 BLOCK OF SOUTH 23RD STREET, ON THE EAST SIDE, FROM R-1 SINGLE FAMILY RESIDENCE DISTRICT TO R-1SU SINGLE FAMILY RESIDENCE SPECIAL USE DISTRICT AND AUTHORIZING THE SPECIAL USE OF SAID PROPERTY AS A DAY CARE CENTER/PRE-SCHOOL. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as R-1 Single Family Residence District the property located in the 1200 block of South 23rd Street, on the east side; and, WHEREAS, it is the intent and purpose hereof, to change the zoning classification of said property from R-1 Single Family Residence District to R-1SU Single Family Residence Special Use District and to authorize the specal use of said property as a day care center/pre-school; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the aS a day of Z,,t_,1990, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was_Zto in favor of/in recommending the passage of Ordinance No. 53-1990. NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to R-1 SU Single Family Residence Special Use District and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. Located in the northwest quarter of section 10, Township 13 North, Range 1 West, Wayne Township, Wayne County, Indiana, being part of the land conveyed to The United Pentecostal Church of Richmond by deed record in Deed book 436, page 124 of the Wayne County Deed Records and being more particularly described as follows: Beginning at in iron pin found at the norhhwest corner of said Section 10, said pin being at the centerline intersection of South 'L' Street and South 23rd Street; thence with the west line of said Section 10 and the centerline of South 23rd Street, Due South for 494.00 feet to a railroad spike set at the true point of beginning; thence Due East for 242.80 feet Ordinance No. 53-1990 Page 2 to an iron pin set, and passing an iron pin set at 25.00 feet along this course; thence Due South for 200.00 feet to an iron pin set; thence Due West for 242.80 feet to a railroad spike set in the west line of said Section 10 and in the centerline of South 23rd Street, and passing an iron pin set at 217.80 feet along this course; thence with the west line of said Section 10 and the centerline of South 23rd Street, Due North for 200.00 feet to the true point of beginning; containing 1.115 acres and subject to all easements, restrictions, and legal highways of record. SECTION 2. That as provided in Articles 20 and 48 of Chapter 154 of the Code of Ordinances, the following described use of the above described property is allowed as a day care center/pre -school. SECTION 3. That as a condition of being granted the special use and as an additional restriction on said use, the following requirements shall hereafter and at all times be met by the owner of said real estate. A. The Special Use site plan and petition shall be marked Exhibit A and made a part of this Ordinance. SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval as by law aquired. Puckett and Carlton C. Wilson, agents, requesting a rezoning from R-1 Single Family Residence District to R-1 SU Single Family Residence Special Use District and also requesting special use authorization for a day care center and pre-school on property located in the 1200 block of South 23rd Street on the east side. The proposed day care center and pre-school would be constructed on a vacant 1.115 acre parcel located 494 feet south of the intersection of South L Street and South 23rd Street. The nursery school is proposed to be owned and operated by Ginger Smith and Linda Graham and to accomidate approximately 100 children between the ages of 2 112 to 5 years aid. Ten (10) notices of public hearing were sent to the surrounding residents with one (1) returned in opposition to the petition.
