AMENDED ORDINANCE NO. 54-1990
AN ORDINANCE VACATING A CERTAIN UTILITY EASEMENT LOCATED BETWEEN
LOTS 17 AND 18 IN THE PARK RIDGE WOODS ADDITION SECTION 8.
WHEREAS, Anne C. and Arthur M. Vivian, have petitioned the Common
Council of the City of Richmond, Indiana requesting to vacate
the utility easement located between Lots 17 and 18 in the
Park Ridge Woods Addition Section 8; and,
WHEREAS, the Common Council, pursuant to the provisions of I.C. 36-7-3-
12, conducted a public hearing on said vacation petition on Md.

WHEREAS, a study of this Ordinance was conducted by the Richmond City
Plan Commission on the��%y of s pf.1990, at which time
remonstrances were heard from all parties interested in or
affected by this Ordinance; and,
WHEREAS, the vote of the Richmond City Plan Commission was_9 toO
in favor of/ir=optzs*o=n==o recommending passage of Amended
Ordinance No. 54-1990.
NOW THEREFORE BE IT ORDAINED by the Common Council of the City of
Richmond, Indiana as follows:
SECTION 1. That the utility easement described below is hereby vacated.
Being all of the five (5) foot utility easement strip beginning
at the northwest corner of Lot Numbered 17 in the Park Ridge
Woods Addition, Section 8 and. running 112.88 feet
southwesterly along the west line of said Lot Numbered 17 to
a ten (10) foot utility easement strip running along the south
line of said Lot Numbered 17, and all of the five (5) foot
utility easement strip beginning at the northeast corner of Lot
Numbered 18 in the Park Ridge Woods Addition, Section 8 and
running 112.88 feet southwesterly along the east line of said
Lot Numbered 18 to a ten (10) utility easement strip running
along the south line of said Lot Numbered 18.
SECTION 2. This Ordinance shall be in full force and effect from and after
the passage and approval as by law required.

Dear Mrs. Brookbank, Members of Common Council and
Mrs. Merchanthouse:
The Richmond City Plan Commission conducted a public hearing on
Tuesday, September 25, 1990, on the petition of Anne C. and Arthur M.
Vivian, owners, requesting to vacate a portion of two (2), 5 foot utility
easements located along the common property line of Lots 17 and 18 in
the Park Ridge Woods Addition Section 8. The vacation is requested to
enable the construction of a dwelling over the common lot line and
easements. The petitioners own all the property adjacent to the
easements requested to be vacated.
All utility companies have reviewed the petition as well as the Sanitary
District, Fire Department and Police Department. The only concern that
has been identified is that the description of the easements contained in
the petition also includes the10 foot easement located along the south
property line of both lots. The petitioners' intent is to leave the 10 foot
utility easement located along the south property line in place.
Four (4) notices of public hearing were sent to the residents surrounding
the site. All notices were returned to the Plan Department not oppossed
to the petition. During the public hearing no one spoke in opposition to
the petition.

The Plan Commission voted nine (9) to zero (0) to recommend to Council
that Ordinance No. 54-1990 be amended regarding the legal description
of the easements to be vacated, a copy of the proposed amended
Ordinance is attached, and that Amended Ordinance No. 54-1990 be
adopted.

PETITION FOR VACATION OF CERTAIN UTILITY EASEMENTS
The Petitioners, Anne C. Vivian and Arthur M. Vivian, 314 South 48th
Street in the City of Richmond, Indiana, pursuant to the provisions of I.C. 36-7-
3-12, petition the Common Council of the said City of Richmond, Indiana, as
follows:
(1) Petitioner seek to effect the vacation of the utility easement
described as follows:
Being all of the five (5) foot utility easement strip beginning
at the Southwest corner of Lot Numbered 17 in the Park Ridge
Woods Addition, Section Eight and running 122.88 feet Northeast-
erly along the West line of said Lot Numbered 17 to South 48th
Street, and all of the five (5) foot utility easement strip
beginning at the Southeast corner of Lot Numbered 18 in said
Addition and running 122.88 feet Northeasterly along the East
line of said Lot Numbered 18 to South 48th Street.
(2) The Petitioners own all land abutting the proposed easement to be
vacated. There are no other property owners who have an interest in the pro-
posed vacation.
(3) A list of those utility companies who have been contacted to
ascertain the effect of the proposed vacation upon the existing utilities is set
forth in the attached "Exhibit A" which is made a part hereof, and incorporated
herein.
WHEREFORE, the Petitioners, Anne C. Vivian and Arthur M. Vivian
respectfully request that a public hearing be conducted on their petition for
the vacation of the above described public ways in accordance with the pro-
visions of I.C. 36-7-3-12 and I.C. 5-3-1-1 et seq.

AN ORDINANCE DESIGNATING THE 100 BLOCK OF SOUTH WEST E STREET AS A
RESIDENTIAL PARKING PERMIT AREA AND AUTHORIZING THE CONDITIONAL
ISSUANCE OF PARKING PERMITS TO THE RESIDENTS OF SUCH AREA
WHEREAS, the Common Council of Richmond, Indiana has established a procedure for the
designation of residential parking permits areas known as Amended Ordinance No.
47-1984; and,
WHEREAS, the procedure contained In such ordinance has been carried out and a report
submitted to the Common Council by the Board of Public Works and Safety
pursuant to such procedure; and,
WHEREAS, the Common Council of Richmond, Indiana finds that the designation of the 100
Block of South West E Street satisfies the criteria of Amended Ordinance No. 47-
1984 and would serve the interests enumerated therein.
NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond,
Indiana, that the portion of South West E Street located in the 100 Black is hereby
designated a residential parking permit area within the purview of Amended
Ordinance No. 47-1984; and the issuance of parking permits to residents of such
area is hereby authorized subject to the conditions of Amended Ordinance No. 47-
1984.
