RESOLUTION NO. 2002-58
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE
OPPOSING MEASURE D, THE PROPERTY CLAIMS REIMBURSEMENT PROCESS
INITIATIVE
WHEREAS, the voters of the Town of Truckee will vote on Measure D at the
November 2002 election; and
WHEREAS, Measure D may have an impact on the planning and land use
regulations applied to property adjacent to and near the Town of Truckee which could
negatively impact the Town and its residents and property owners, and
WHEREAS, in the course of fully informing themselves concerning Measure D,
the voters should be aware of the position(s) of their locally elected officials; and
WHEREAS, on September 19, 2002 the Town Council conducted a public
discussion on Measure D and heard the views of all speakers both in favor and
opposed to Measure D; and
WHEREAS, after deliberation and discussion the Town Council has decided to
take a position with regard to Measure D;
NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF TRUCKEE finds that:
1. The proposed Measure D contains ambiguous language such that it is not
possible to determine its potential effect on adopted planning policies and land use
regulations or the potential fiscal impact of implementing the measure.
2. Current law contains procedures, checks and balances designed to safeguard
property rights.
In recognition of the foregoing findings, the Town Council hereby expresses its
opposition to Measure D and encourages the voters to fully inform themselves prior to
casting their ballot.
The foregoing Resolution was introduced at a Regular Meeting of the Truckee
Town Council, held on the 17th day of October, 2002 and adopted by the following vote:
AYES:Councilmembers Susman, Owens, McCormack, and Mayor Florian.
NOES: Councilmember Schneider.
