HomeMy Public PortalAbout066-1990- ZONING - 112 NORTH 11TH STORDINANCE NO. 66-1990 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO.2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 112 NORTH 11TH STREET, FROM R-4 MULTI -FAMILY RESIDENCE DISTRICT TO R-4SU MULTI -FAMILY RESIDENCE SPECIAL USE DISTRICT AND AUTHORIZING THE SPECIAL USE OF SAID PROPERTY AS A BUSINESS OFFICE. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as R-4 Multi -Family Residence District the property located at 112 North 11th Street; and, WHEREAS, it is the intent and purpose hereof, to change the zoning classification of said property from R-4 Multi -Family Residence District to R-4SU Multi -Family Residence Special Use District and to authorize the specal use of said property as a business office; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the 2,L4day of acl. ,1990, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was-2—to _ D in favor of/ recommending the passage of Ordinance No. 66-1990. NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to R-4SU Multi - Family Residence Special Use District and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. Lot 218 in the Elizabeth Starr Addition to the City of Richmond, Indiana. SECTION 2. That as provided in Articles 23 and 48 of Chapter 154 of the Code of Ordinances, the following described use of the above described property is allowed as a business office. SECTION 3. That as a condition of being granted the special use and as an additional restriction on said use, the following requirements shall hereafter and at all times be met by the owner of said real estate. A. The Special Use site plan and petition shall be marked Exhibit A and made a part of this Ordinance. Ordinance No. 66-1990 Page 2 SECTION 4. Request: rezoning from R-4 to R-4SU and special use authorization for a business office. The property presently is being used as a multi -family dwelling containing 20 sleeping rooms. Also located in the building is an on -site management office for the building. The petitioner desires to expand the scope of the present office to include his home improvement business and a management office for other rental property. Location: 112 North 11th Street CITY PLAN COMMISSION RICHMOND, INDIANA October 30, 1990 Mrs. Jane Brookbank, President Members of Common Council and Mrs. Mary Merchanthouse, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 66-1990 Plan Commission Case PC-90-16 Dear Mrs. Brookbank, Members of Common Council and Mrs. Merchanthouse: The Richmond City Plan Commission conducted a public hearing on Tuesday, October 23, 1990, on the petition of Scott D. Gibson, owner, requesting a rezoning from R-4 Multi -Family Residence District to R-4SU Multi -Family Residence Special Use District and also requesting special use authorization for a business office, on property located at 112 North 11 th Street. The property presently contains two buildings used as a multi -family dwellings. A carrage house located at the rear of the property contains 5 sleeping rooms. The main building on the property contains 13 sleeping rooms, a one bedroom apartment and an office for the management and maintenance of the buildings. The petition is requesting a rezoning to the special use district to enable the scope of the office to be expanded to include activities associated with the petitioner's home improvement business and also the management of other rental property. The office is proposed to be located all in one room of the building. The office is proposed to function in an administrative and clerical capacity with no public traffic and no over the counter sales. The office is proposed to be Ordinance No. 66-1990 Page 2 staffed by the petitioner with no employees. No building material or contractor's equipment will be stored on the premises. The special use petition has been reviewed by the Police and Fire Departments for their input regarding the design of the project, traffic congestion and access to the property. No concerns have been identified. Eleven (11) notices of public hearing were sent to the residents surrounding the site. Two (2) notices were returned to the Plan Department oppossed to the petition. During the public hearing no one spoke in opposition to the petition. The Plan Commission voted nine (9) to zero (0) to recommend to Council that Ordinance No. 66-1990 be adopted.
