HomeMy Public PortalAbout069-1990- ZONING - 118 NORTH 7TH STORDINANCE NO. 69-1990 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO.2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 118 NORTH 7TH STREET, FROM R-4 MULTI -FAMILY RESIDENCE DISTRICT TO C-3 CENTRAL BUSINESS DISTRICT. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as R-4 Multi -Family Residence District the property located at 118 North 7th Street; and, WHEREAS, it is the intent and purpose hereof, to change the zoning classification of said property from R-4 Multi -Family Residence District to C-3 Central Business District; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the 23nd0day of Dc f. ,1990, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was i to 0 in favor am=Wrecommending the passage of Ordinance No. 69-1990. NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to C-3 Central Business District and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. A strip of ground 42.5 feet wide off of the south side of Lot 62 in Charles W. Starr's Addition to the City of Richmond, Indiana. SECTION 2. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. Request: rezoning from R-4 to C-3. At the present time, a 2 family dwelling is located on the property in question. Immediately south of the property is a 10 foot wide alley and Tire Center's Inc. If the rezoning is approved, Tire Center's, Inc. proposes to purchase the property, demolish the dwelling and expand a parking lot. Jaffe and James David Hernly, owners; Robert Bever, agent, requesting a rezoning from R- 4 Multi -Family Residence District to C-3 Central Business District, on property located at 118-120 North 7th Street. The petitioners have a sale of the subject property pending to Tire Centers, Inc. located on the northwest corner of North 7th and North A Streets. If the rezoning is approved, Tire Centers, Inc. plans to demolish the multi -family dwelling located on the property and expand a parking lot. The rezoning petition has been reviewed by the Police and Fire Departments for their input. No concerns have been identified. Seven (7) notices of public hearing were sent to the residents surrounding the site. One (1) notices was returned to the Plan Department not oppossed to the petition. During the public hearing no one spoke in opposition to the petition.
