HomeMy Public PortalAbout070-1990- ZONING - REAR OF 3600 EAST MAIN ST ON THE SOUTHSIDE.pAMENDED ORDINANCE NO. 70-1990 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANC. OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT THE REAR OF 3600 EAST MAIN STREET, ON THE SOUTH SIDE, FROM R-2 SINGLE FAMILY RESIDENCE DISTRICT AND R-4 MULTI -FAMILY RESIDENCE DISTRICT TO C-2 COMMERCIAL DISTRICT. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as R-2 Single Family Residence District and R-4 Multi -Family Residence District the property located at the rear of 3600 East Main Street, on the south side; and, WHEREAS, it is the intent and purpose hereof, to change the zoning classification of said property from R-2 Single Family Residence District and R-4 Multi -Family Residence District to C-2 Commercial District; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the �J"day of O � ,1990, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was��to 3_ in favor of/in=mppaaftbxEEta recommending the passage of Amended Ordinance No. 70-1990. NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to C-2 Commercial District and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. Being a part of the Northwest Quarter of Section 2, Township 13 North, Range 1 West in Wayne Township, Wyane County, Indiana and a part of the Northeast Quarter of Section 3, Township 13 North, Range 1 West in the City of Richmond, Wayne County, Indiana and being more particularly described a follows: Beginning at a copperweld monument found at the northwest corner of the Northwest Quarter of said Section 2 and running thence North 89 degrees, 51 minutes, and 00 seconds East along the north line of said Northwest Quarter 81.52 feet to an iron pipe found at the southeast corner of the Southeast Quarter of Section 34, Township 14 North, Range 1 West; thence south, on the extension of the east line of the Southeast Quarter of said Section 34, (assuming that the east line of said Amended Ordinance No. 70-1990 Page 2 Section 34 runs north & south) 533.00 feet; thence South 89 degrees 51 minutes, and 00 seconds West, parallel to the south line of the Southeast Quarter of Section 34, 675.00 feet; thence North 533.00 feet to a point in the south line of said Southeast Quarter; thence North 89 degrees, 51 minutes, and 00 seconds East along the south line of said Southeast Quarter, 593.48 feet to the place of beginning containing a total area of 8.259 acres (359774 square feet), there being 0.982 acre (42807 square feet) in the Northwest Quarter of said Section 2 in said Wayne Township and 7.277 acres (316967 square feet) in the Northeast Quarter of said Section 3 in said City of Richmond. SECTION 2. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. The petition is requesting a change in zoning of the rear property to the C-2 District to enable the project to go forward. The Plan Department, City Engineer's Office, the Richmond Sanitary District, the Traffic Division of the Police Department and the Fire Department have reviewed the proposed site plan for the project. The only concern that has been identified pertains to the question of preserving the appropriate right-of-way for the future Elks Road extension project. The east property line of the proposed development is also the center -line of the proposed right-of-way for Elks Road extended. The developer is proposing to gift to the City 55' for the right-of-way of Elks Road along the project's entire east property line. The developer is willing to enter into an agreement with the City to guarantee the dedication of the right- of-way. The City's consulting engineers involved in the original preliminary design for Elks Road extended have indicated that 55' of right- of-way off of the proposed Wal-Mart development is sufficient to construct the road. Additional right-of-way for proposed Elks Road extended is also required to be obtained from the owners of the Kroger complex. These owners have also indicated a willingness to provide right -of-way. (A copy of the Wal-Mart site plan will be available to Council members at the Council meeting.) Twenty-four (24) notices of public hearing were sent to the residents surrounding the site. Four (4) notices were returned to the Plan Department not oppossed to the petition. During the public hearing no one spoke in opposition to the petition. The Plan Commission discovered that Ordinance No. 70-1990, pending before Council, needs to be amended in its title and in its whereas clauses regarding the present zoning classification of the property in question. The Ordinance currently indicates the property is zoned R-2 Single Family Residence District. The Ordinance should be amended to indicate a portion of the property is also zoned R-4 Multi -Family Residence District. A copy of the proposed amended Ordinance is attached.
