AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING
ORDINANCE NO.2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE
OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF
PROPERTY LOCATED IN THE 1300 BLOCK OF SOUTH 23RD STREET, ON THE
EAST SIDE, FROM R-1 SINGLE FAMILY RESIDENCE DISTRICT TO R-1 SU
SINGLE FAMILY RESIDENCE SPECIAL USE DISTRICT AND AUTHORIZING THE
SPECIAL USE OF SAID PROPERTY AS A NONCOMMERCIAL PHILANTHROPIC
USE, NAMELY THE YWCA.
WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968
designates and describes as R-1 Single Family Residence
District the property located in the 1300 block of South 23rd
Street, on the east side; and,
WHEREAS, it is the intent and purpose hereof, to change the zoning
classification of said property from R-1 Single Family
Residence District to R-1 SU Single Family Residence Special
Use District and to authorize the specal use of said property
as a noncommercial philanthropic use, namely the YWCA.; and,
WHEREAS, a study of this Ordinance was conducted by the Richmond City
Plan Commission the day of ,1990, at which
time remonstrances were heard from all parties interested in
or affected by this Ordinance; and,
WHEREAS, the vote of the Richmond City Plan Commission was to
in favor of/in opposition to recommending the passage
of Ordinance No. 71-1990.
NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of
Richmond, Indiana as follows:
SECTION 1. That the zoning classification of the property described
below, and the same is hereby changed to R-1 SU Single
Family Residence Special Use District and that said
property be regulated in accordance with the Zoning
Ordinance of the City of Richmond, Indiana and all
amendments thereto.
Located in the northwest quarter of section 10, Township 13
North, Range 1 West, Wayne Township, Wayne County, Indiana,
being part of the land conveyed to The United Pentecostal
Church of Richmond by deed recorded in Deed Book 436, page
124 of the Wayne County Deed Records and being more
particularly described as follows:
Beginning at an iron pin found at the northwest corner of said
Section 10, said pin being at the centerline intersection of
South 'L' Street and South 23rd Street; thence with the west
line of said Section 10 and the centerline of South 23rd
Street, Due South for 694.00 feet to a railroad spike found at
the true point of beginning of the tract hereinafter described;

thence Due East for 242.80 feet to an iron pin found, and
passing an iron pin found at 25.00 feet along this course;
thence Due South for 300.00 feet to a iron pin set; thence
Due West for 242.80 feet to an railroad spike set in the west
line of said Section 10 and in the centerline of South 23rd
Street, and passing an iron pin set at 217.80 feet along this
course; thence with the west line of said Section 10 and the
centerline of South 23rd Street, Due North for 300.00 feet to
the true point of beginning; containing 1.672 acres and
subject to all easements, restrictions, and legal highways of
record.
SECTION 2. That as provided in Articles 20 and 48 of Chapter 154 of the
Code of Ordinances, the following described use of the above
described property is allowed as a noncommercial
philanthropic use, namely the YWCA.
SECTION 3. That as a condition of being granted the special use and as an
additional restriction on said use, the following requirements
shall hereafter and at all times be met by the owner of said
real estate.
A. The Special Use site plan and petition shall be marked
Exhibit A and made a part of this Ordinance.
SECTION 4. This Ordinance shall be in full force and effect from and
after its passage and approval as by law aquired.
PASSED AND ADOPTED by the Common Council of the City of Richmond,
Indiana, this day of---, 1990.

Request: special use rezoning from R-1 Single Family Residence District
to R-1 SU Single Family Residence Special Use District and requesting
special use authorization for a noncommercial, philanthropic use, namely
the YWCA. The Council will recall that the YWCA received a special use
rezoning earlier this year for property located on the corner of South 19th
and South L Streets. That deal has fallen through resulting in the new
subject petition.

The Richmond City Plan Commission conducted a public hearing on
Tuesday, October 23, 1990, on the petition of the United Pentecostal
Church of Richmond, owner; Jeff Hanna, agent, requesting a rezoning
from R-1 Single Family Family Residence District to R-1SU Single
Family Residence Special Use District and also requesting special use
authorization for a noncommercial philanthropic use, namely the YWCA,
on property located in the 1300 block of South 23rd Street, on the east

The property in question is a vacant parcal consisting of approximately
1.62 acres that is proposed to be split off of a larger tract owned by the
United Pentecostal Church. The property is located within the Sanitary
District, but outside the Corporate Limits. Earlier this year the Council
adopted a rezoning ordinance that would have enabled the YWCA to locate
its facilities on the northeast corner of South 19th and South L Streets.
However, this project has not materialized. The property in question is
located immediately south of property rezoned by Council, in October, for
a day care center/pre-school.

Nineteen (19) notices of public hearing were sent to the residents
surrounding the site. Two (2) notices were returned to the Plan
Department oppossed to the petition. During the public hearing, two (2)
persons spoke in opposition to the petition citing concerns regarding
storm drainage and the impact the special use would have upon
neighboring property values.
The Plan Commission considered the following in making its
recommendation to Council: (1) the requested special use is located
immediately adjacent to a special use day care center, (2) the requested
special use would represent the second split of property off of the
United Pentecostal tract without a clear understanding of future plans
and requirements for developing the area, (3) the building proposed by
the YWCA is a metal building that may not be compatible with residential
land use, and (4) drainage information submitted with the special use
petition was not adequate to make preliminary judgements about
whether or not the special use would contribute to an existing drainage
problem at South 23rd and South L Streets. The Plan Commission voted
nine (9) to zero (0) to recommend to Council that Ordinance No. 71-1990
be denied.
