HomeMy Public PortalAbout079-1990- ORDINANCE AMENDING ORDINANCE 1-1988ORDINANCE _NO. _79-1990 AN ORDINANCE AMENDING ORDINANCE NO. 1-1988 AUTHORIZING THE RICHMOND SANITARY BOARD TO REVISE CERTAIN LANDFILL FEE COLLECTION. WHEREAS, the Board of Sanitary Commissioners of the Sanitary District of Richmond, Indiana (hereinafter called the "Board") operates and maintains the Sanitary Landfill; WHEREAS, the Board established certain rates and service charges to collect and dispose of refuse at the Sanitary Landfill in accordance with the provisions of former Indiana Code I.C. 19-2-6-1 and I.C. 19-2-6-2, now Indiana Code I.C. 36-9-30- 21; and WHEREAS, said rates were established by Resolution No. 2-1977 and later revised by Resolution No. 11-1981, Resolution No. 17-1985 and Resolution No. 3-1987, Resolution No. 11-1987, Resolution No. 14-1988 and Resolution No. 10- 1989; and; WHEREAS, the Board of Sanitary Commissioners has deemed it necessary to revise the method and rates in light of increased costs in operating the Richmond Sanitary Landfill; and WHEREAS, the Board has conducted a public hearing on the method and rates for a disposal of refuse; and WHEREAS, construction materials and refuse does not have to be disposed of at an approved landfill. If a contractor or subcontractor does bring such material to RSD's landfill, they will be charged the standard charge even if it is from inside the district, and; WHEREAS, tires present a special problem for landfills, the revised rates pertaining to tires are to aply to everyone that resides within the Richmond Sanitary District. Richmond Sanitary District will not accept tires from outside Richmond Sanitary District. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, that: Resolution No. 10-1990 (copy attached) of the Board of Directors of the Richmond Sanitary District, as adopted by the Board on October 9, 1990, is hereby approved by the Common Council. Furthermore, Chapter 58 (Landfill) of the City Code is hereby amended as follows: SECTION 58.02 - (a) Pursuant to Resolution Number 10-1989 of the Board of Directors of the Richmond Sanitary District, method and rates for service charges to collect and dispose of refuse at the Sanitary Landfill as applied to all users residing outside the Richmond Sanitary District shall be as follows: Minimum charge - $6.00 Anything over $6.00 will be charged the exact sum at $22.00 per ton Per ton - $22.00 Tires from within Richmond Sanitary District will be charged at the following rates: 1) Tires weighing 25 Ibs each and under $125 per ton 2) Tires weighing over 25 Ibs each and up to 75 lbs. $100 per ton 3) Tires weighing over 75 Ibs each up to $ 75 per ton PASSED AND ADOPTED by the Common Council of the City of Richmond, Indiana, this L day of (vc,&- , 1990. Be it further resolved that the Board hereby revises its method and rates for service charges to collect and dispose of refuse at the Sanitary Landfill as applied to all users residing outside the Richmond Sanitary District. The revised rates shall be as follows: Minimum charge - $6.00 Anything over $6.00 will be charged the exact sum at $22.00 per ton Per ton - $22.00 Tires from within Richmond Sanitary District will be charged at the following rates: 1) Tires weighing 25 lbs each and under $125 per ton 2) Tires weighing over 25 lbs each and up to 75 lbs. $100 per ton 3) Tires weighing over 75 lbs each and up $ 75 per ton All charges are due when billed by Richmond Sanitary District.
