M 91-05 PRESENT: MAYOR R. EDGAR GIECK TRUSTEE HOFF TRUSTEE MARSH TRUSTEE HOVEL TRUSTEE RAU TRUSTEE SHEETS TRUSTEE HOOVER CLERK LESH Five audience members were present. MAYOR GIECK PRESIDED CONFIRMATION 03/19/1991 MINUTES 91-03 The minutes of the March, 19, 1981 regular meeting were reviewed by the Board. MOTION WAS MADE BY TRUSTEE HOVEL, to approve the minutes as corrected. All members voting YES. MOTION CARRIED CONFIRMATION MINUTES 3/26/91 91-04 MOTION WAS MADE BY TRUSTEE HOVEL, for approval of the special meeting of March 26, 1991. All members voting YES MOTION CARRIED APPROVAL Accounts payable 1991 April were ACCOUNTS reviewed. MOTION WAS MADE BY TRUSTEE PAYABLE MARSH, to approve the bills as presented. All members voting YES MOTION CARRIED LOLA MAAG' S RETIREMENT Consideration for a retirement gift or party was granted. Ideas are to be brought to the next meeting. 11/ Page - 1 EDAP MEMBERSHIP MOTION WAS MADE BY TRUSTEE HOVEL, to contribute $250. 00 to Greeley/Weld Economic Development Action Partnership (for membership in EDAP) . All members voting YES MOTION CARRIED 11/ DRINKING FOUNTAIN MOTION WAS MADE BY TRUSTEE MARSH, to table decision on placement of the Liberty Park drinking fountain until more information can be gathered. All members voting YES MOTION CARRIED HRA Trustee Hovel, Ault' s representative on the HRA board, reported that he and Trustees Hoff and Rau attended the HRA board meeting last Tuesday. Trustee Hovel reported that he had been asked to resign from representing Ault on the HRA Board because they did not feel he was supporting the organization. He said that for the most part, for the past two years, he had put on the Sertoma pork bar-b-que to raise money for HRA. He did volunteer to serve on the Board. After careful consideration he did resign as Ault' s representative to HRA. Trustees Hoff and Rau reviewed the HRA proposed budget and asked many questions which were sufficiently answered by the HRA Board, although Trustee Hoff still does not understand HRA budgets process. Gary White, an Ault citizen, expressed his opinion concerning the Town of Ault' s donation to HRA. He favored a cash donation. MOTION WAS MADE BY TRUSTEE HOOVER, to table any donation to HRA until the VISTA contract can be reviewed. All members voting YES MOTION CARRIED REPRESENTATIVE HRA The Board unanimously approved that Mayor Gieck talk with Ken Hahn about serving as the Town' s HRA representative. Page - 2 RECOMMENDATIONS PLANNING COMMISSION Trustee Hoff, chairman of the Ault Planning Commission, reported the following recommendations to the Ault Town Board: A. Approve plans for construction of a patio at the residence of Brian Grevenow, 305 First Avenue. B. Permit the zoning modification, to divide an existing single family residence and the 2. 00 acre tract it is situated on, from a larger parcel of land presently annexed to the Town of Ault. Upon development of the surrounding area, this property will be rezoned to confirm. City water and sewer will not be available to this afore mentioned property until utilities are within 100 feet of said property. The address of the property is 16627 Highway 14. C. Approve the plans for a pattern making business with sand casting on an as needed basis for Jim Conklin, Conklin Pattern and Casting, 221 East Third Street. D. Deny locating mobile home on vacant lot on Frye Street. E. Advise Christ J. and Margaret A. Schmidt to contact the Town Attorney to give his interpretation of Section 17. 28. 020, C. Approval was given for Christ Schmidt' s daughter to reside in the building as per Section 17. 28. 020. MOTION WAS MADE BY TRUSTEE RAU, to accept items I. , II. , III. , IV. , and V. of the Planning Commissions report. All members voting YES MOTION CARRIED 111 Page - 3 MOTION WAS MADE BY TRUSTEE HOVEL, to accept Item I. , approval of permit application for construction of a new patio at 305 First Avenue, owner, Brian Grevenow. All members voting YES MOTION CARRIED MOTION WAS MADE BY TRUSTEE HOVEL, to accept Item II, zoning modification for property at 16627 Highway 14, Ault, Colorado, to divide existing single family residence, and the 2. 00 acre tract it is situated on, from a larger parcel of land presently annexed to the Town of Ault. Owner of business is Jim Conklin, Conklin Pattern and Casting. The primary activity is pattern making with sand casting on an as needed basis. In the event Mr. Conklin purchases this property, he will be required to furnish sewer and water to the property on the condition only Lots 11 and 12, the west building is purchased. There are no water and sewer utilities into this building at present, there are utilities in the building to the east owned by Wilford Prange. All members voting YES MOTION CARRIED MOTION WAS MADE BY TRUSTEE HOOVER, to deny the application, as suggested, from Payant Real Estate to place a mobile home on a vacant lot on Frye Street. All members voting YES MOTION CARRIED Page — 4 In regards to Item V. , Christ J. and Margaret Schmidt' s request for a zoning change at the property located at the corner of Third Street and Highway 85, from commercial zoning to R-1 zoning, Mr. Schmidt was asked again what the building was going to be used for? He stated that for now it will be used for his daughter to live in. The Planning Commission' s report stated that approval was given for Christ Schmidt' s daughter to reside in the building as per Section 17. 28. 020. , which states residence for proprietor and family of a permitted commercial use shall be allowed, subject to approval by the planning commission and town board. The Town Attorney, Robert Burroughs, gave his interpretation of Section 17. 28. 020, C. He stated because there is no mention of a requirement that a proprietor' s residence by physically attached to a commercial building on commercially zoned property, that such would not be required unless the Ordinance is amended, and thus a residence of the proprietor in a separate building on the commercially zoned property would meet the requirements of the Ordinance if approved by the Board of Trustees. The Planning Commission stipulated that only members of the immediate family could occupy the residence. In the event the building is rented a zoning change will be required. It was pointed out that the electrical work was not done by a state licensed electrician, which is in violation of the state code. There is not a final inspection or a certificate of occupancy on the building. Schmidt' s daughter is presently living in the building. Strides must be taken to get siding on building, open sewer drains need to be addressed. Another concern of the Planning Commission, and Fire Department, is the lack of a landing on second floor door. MOTION WAS MADE BY TRUSTEE RAU, to approve the Planning Commissions recommendations with the above stipulations entered into the record. Work must be completed by July 4, 1991 ; all violations brought up to code, proper permitting obtained, a final inspection passed, and a Page - 5 certificate of occupancy issued prior to July 4, 1991. All members voting YES MOTION CARRIED WATER AUTHORITY The Ault Water Planning Authority submitted the following recommendations to the Town Board in regards to Stewart Mobile Home Park installing meters to individual units : 1. Roger Prenzlow, owner of Stewart Mobile Home Park will provide and install the meters to each individual mobile home. 2. The Towns' maintenance man will read the master meter. The mobile homes' manager will read the individual meters that are installed. 3. Stewart Mobile Home Park will pay any difference between the master meter reading and the total of the individual meter readings. 4. The Town of Ault will bill individual units on a monthly basis. S. Stewart Mobile Home Park will be responsible for all meter maintenance. 6. Stewart Mobile Home Park will be responsible for maintenance of the master meter and all water lines in the trailer court. Trustee Hovel suggested that the following be added to this report : a. The manager of the mobile home park would submit the meter readings to the Town Clerk on the twenty-second of each month. b. Any water and sewer bills not paid by the individual mobile home occupants within 60 days of billing, will be paid by the owner of the park immediately upon notice. c. Pay quarterly any money due the Town because of shrinkage beyond the master meter. This amount will be determined by comparing the master meter readings Page - 6 to the amount collected by the individual water bills. Discussion was held as to whether this should be done monthly. d. Question was asked by Trustee Hoff regarding item c, as to what rate structure will be used will be used for any overage on the master meter reading. e. Mobile Home Park must continue to provide the current supply system for lawn watering. f. Pay a surcharge of $5. 00 per 1000 gallons on excess water usage of fifteen ( 15) acre foot per year. Surcharge can be changed at the discretion of the Town, depending on the current cost of water. In place of the surcharge an acre foot of water would have to be purchased for each acre foot of water used over the maximum fifteen acre foot, by Roger Prenzlow, and given to the Town. The manager of the mobile home park stated that they would continue to use pond water for lawn irrigation. The mobile home park owns a share of Hayden Ditch Water that they split with Highland Feeders and Keifer. In the event there is a new owner of the mobile home park, it will be stated in the agreement that the pond must be maintained, and that North Weld Water will not be used for lawn irrigation. g. The signed contract shall be recorded by the county. MOTION WAS MADE BY TRUSTEE HOVEL, to draft an agreement incorporating the Ault Water Authorities recommendation and the Town Boards stipulations. The rough draft will be reviewed April 24th. The contract will be presented for approval consideration at the next regular meeting, May 21, 1991. All members voting YES MOTION CARRIED RECESS Meeting resumed at 8:45 P. M. Page - 7 PUBLIC HEARD Milton Birt, landowner of property adjacent to town sewer lagoon addressed the Board with his concern of weed burning. The latest weed burning was not done by the Town, but rather by a farmer to south of Mr. Bird. He stated that the property north of him has been burned every year since 1974 and he has observed sparks going 150 feet over his trees and onto the roof of his garage. He is asking that controlled burning is done in the future. He also requested that the bindweed be controlled. Board will look into these concerns. NEW VACUUM MOTION WAS MADE BY TRUSTEE HOVEL, to purchase a new vacuum at the discretion of the Town Clerk and Mayor. It was advised to purchase one that bypasses the propellors. All members voting YES MOTION CARRIED WATER ALLOTMENT The allotment for 1991 is 60%. All equal there should be a carry over of 31 acre feet for 1991 plus the nine shares of North Poudre. There will be a meeting with North Weld Water April 24, 1991. WATER FUND MOTION WAS MADE BY TRUSTEE HOVEL, to invest the matured water fund certificate of deposit for $22, 776. 77 with JEFFTRUST. All members voting YES MOTION CARRIED CEMETERY Citizen, Charles Kindsfather, spoke on his concern of the condition of the cemetery. The following are his concerns : a. Graves have settled, sod has been added instead of dirt. b. Sprinklers need to be lowered and adjusted. c. Trash that has been dumped south of cemetery needs to be removed. d. New trees need to be relocated. e. Gravestones need to be raised. f. Shed needs to be painted. g. Pine needles need to be cleaned up at Wayside Park and from the driveway at the Power Plant. Page — 8 LIBRARY BOARD Trustee Hoff reported on the Library Board. The correct address for the Library is 105 West First Street. According to a letter dated 11-18-88, the Town will not charge and collect rental fees for the use of the downstairs. The Library Board may use and collect any rentals on the building it sees fit. If the Library Board desires, the Town will handle the scheduling of the downstairs as before, but any rents collected will go into the Library Fund. WATER/SEWER Trustee Hovel will obtain a contractor installing a 10" PVC pipe to drain wastewater off the Wykert farm. Discussion was held on having another water leak survey done as soon as possible. All the fire hydrants need to be flushed a minimum of once a year, preferable twice per year. STREET/ALLEY Greeley Technician shall be contacted to sweep the streets. POLICE/FIRE The 1988 Grand Fury Police Car will be advertised for sealed bids to be received by May 20, 1991, to be opened at the next regular meeting, May 21, 1991, with an option to reject any or all bids. MOTION WAS MADE BY TRUSTEE MARSH, to advertise the used police car for sealed bids. All members voting YES ' MOTION CARRIED False arrest insurance is to be looked into. A letter from Chester I. Miller concerning police action against him was reviewed. The violation happend on school property. The letter will be kept on file. Page - 9 TREE BOARD Trustee Hoff announced that Friday April 19, 1991 is Arbor Day. A Colorado Blue Spruce will be planted in Liberty Park.
