The regular meeting of Town Council was held today at 3 P.M. in the Council Room in the Town Hall and was attended by Mayor Brown, who presided, and Councilmen Powers,, Waters, Lovell, Meddin, Hosti, Town Atty. Solms, Jr., Supt. Reed, Chief McCutchen, Mr. J. A. McArthur, Jack Knaux, Mrs. Huggins, Mr. Sidney Raskin, E.C. Bobo and A.P. Solomon, III. Mr. McArthur requested that the Town's sanitary sewer mains be extended down Campbell Street to Horse Pen Hammock and he stated that although he was speaking for himself others in the area would like to have their homes connected to the sewerage system also, he.was informed that the sewer main does not have sufficient fa17 at his place. Mayor Brown informed him that he would check on the matter and if the Town could help it would do soy Mr. McArthur was excused. The matter was referred to Councilman Hosti and Supt. Reed to check on and report back. Mr. Raskin protested against paving of Tenth Street stating that a petition had been previously presented to the Town by property owners on th's street protesting its paving and that a number of them were disturbed as they feel that it is not desirable that Tenth Street be paved as they were happy with the street as it was. He also stated that he understood some of the streets were to be p•w.ved and that some were not and he felt that if one street is to be paved then all of them should be paved. He also requested that a definite statement be made as to whether it wanld be paved or not, he voted for bonds in the last election and was very happy to do so. The Mayor informed him that others had also voted for the bonds and wanted the streets paved. He also asked Mr. Raskin if he was assured that Eighth Street will be paved would he be satisfied, Mr. Raskin made no reply to this but requested a letter from the re- sults of this meeting, Mr. Raskin was excused. Mr. Bobo informed Council that in the construction of the new Post Office Building that on the Inlet Avenue side the canopy of the building encroaches on the street approximately 19 to 32 inches. He stated that he built according to some survey marks which were already in place and that the recent survey discloses a difference in the location and he is requesting that the encroachment be permitted to remain. Mr. Solms stated that the Town could not give him permission that would bind the Town, but that the Town could grant him permissive use of the area which Mr. Bobo agreed to accept. Mr. Bobo was excused. It was the agreement of Council that he be granted permissive use of the land in question and that he execute an agreement covering this. Mr. A. P. Solomon, III recomended that the Town remove the hose rack and tank on one of the fire engines to make room to carry approximately 600 additional feet of fire hose and stated that the Town needed more 22 inch fire hose and several other items for the Fire Departtent. He was excused. The Mayor informed Council that Mr. Johnson of the State Hwy. Dept. informed him that the plat on Butler Avenue must be moved. The question was asked what was to be done with the trees? Ad's. Huggins informed Council that the Savannah Beach Chambsr of Commerce has requested her to continue on with the clean up campaign for the coming year and she has not de- cided as yet whether she will but if she decides to do it she wants Council to back her up "if property owners do not clean up they should be fined ". The Mayor in— . formed Mrs. Huggins that if the property owners do not clean up their property the Town can put them on the docket. Mrs. Huggins suggested sending a notice to the property owners when the tax notices are mailed out. If the Town does not enforce the Ordinance she does not want the job. She was excused. 1 1 47 Superintendent Reed reported that Mr. Johnson, Assistant Warded of the County Prison Camps, was down today and he informed Mr. Reed that he will try and maintain 32 men at the camp. Superintendent Reed also stated that a new type of cottage, under the trade name of "Crusader" cottages had requested permission to erect some of these buildings on the island but that °they do not come up to the Town's building code. It was decided that these buildings could not be erected'in the Town limits unless they complied with the building code. Chief McCutchen requested permission to paint the ambulance to preserve it and also that a new stretcher and rack is needed. It was asked if the ambulance could be painted for not over $50.00. The Mayor appointed a Committee of Mr. Solms,. Councilman Hosti and Chief McCutchen to handle the matter. Councilman Meddin stated that he had noticed a number of bills for furnishing gasoline and oil to members of the Marine Rescue Squadron and wanted to know why the Town was doing this. Chief McCutchen stated that several emergency calls were answered by the M.R.S. but that the Phillips "66" Service Station has agreed to furnish gasoline and oil to the M.R.S. on future calls. Mayor Brown asked Chief MeCutchen what had ;een done regarding the breaking into soumany homes during the Christmas holidays, the Chief stated that it was done by a group of small boys and that he had picked up several and were questioning them. He stated that ten buildings were broken into and some were very badly damaged. The Mayor suggested that a truant school be setup to send these violators to it over a period of time and suggested too that a meeting be called for all interested parties to see if something cannot be worked out to solve this situation. The Mayor requested that the cottage of H. E. Whitten on Lot 53 A, Ward 3, be con- demned as in its present condition it is unsafe, unsanitary and constitutes a fire hazard. It was moved, seconded and passed that this be done and that Mr. Solms give the proper notice and report at the next meeting. The Chief stated that some signs were needed in the school zones and also what should he do regarding horses running loose on the island. He was informed that there was a Town Ordinance that does not permit horses to run at large on the island. Bills for the month of December for General Government amounting to $6,953.11, and for the Water Department amounting to $451.36 and that a fee of Oliver, Davie and Manor for handling the Bond Issue amounting to $3,133.00 were on motion made, seconded and passed to be paid. Councilman Waters stated that the library needs a clock. The matter of changing the operation of the parking lots was brought up and the Mayor suggested that we use what we have. Councilman Powers informed Council that the hose reel and tank be removed from the fire engine so that additi nal hose can be carried. The Mayor appointed. Councilmen Powers and Lovell to handle the matter. A petition to transfer the 1960 whiskey licenses from George's Place, by George Brown, located at Butler Avenue and Second Street, to George's Place, by Willis Mullis, was presented. It was moved, seconded and passed that the petition be granted provided the new occupant complied with all necessary laws and also pays the $25.00 transfer fee to the Town. Hubert K. Ellzey requested permission to operate a package shop in a portion of his store located on the Corner of First Street and Naer Avenue. It was moved, seconded and passed that permission be granted and also that he comply with all necessary laws and requirements and also that he pay one half year's license amount- ing to $375.00 to the Town. It was moved, seconded and passed that the following Ordinance requiring the cleaning of lots, etc be passed: AN ORDINANCE AN ORDINANCE TO PROTECT THE PUBLIC HEALTH AND PREVENT THE SPREAD OF DISEASE BY REQUIRING THE OWNERS OR REAL PROPERTY IN THE TOWN OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, TO CUT ALL WEEDS, GRASS, OR OTHER VEGETABTE GROWTH ON SAID PROPERTY, INCLUDING BUSHES AND SCRUB TREES: TO PROVIDE FOR THE CTTTTING OF SUCH GROWTH BY SAID MUNICIPALITY AND MAKING A CHARGE THEREFOR IN 'HE EVENT OF FAILURE BY THE OWNER TO CUT THE SAME: TO PROVIDE, IN THE EVENT OF THE FAILURE OF SUCH PROPERTY OWNER TO PAY SAID CHARGES, THAT AN EXECUTION ISSUE AND BE LEVIED ON THE PROPERTY IN THE SAME MANNER AS PROVIDED FOR TAX EXECUTIONS ON PROPERTY IN THE MUNICIPALITY: AND FOR OTHER PURPOSES. BE IT ORDAINED by the Mayor and Councilmen of Savannah Beach, Tybee Island, Georgia, in Council assembled, and it is hereby ordained by the authority of the same as follows: Section 1: Whenever there exists on any lot, tract or parcel of land in Savannah Beach, Tybee Island, any weeds, grass, or other vegetable growth on said property, including bushes and scrub trees, which, in the opinion of the Health Officer, might endanger the public' -health or welfare, the 0lerk of Cornci_l shall notify the owner or occupant of such pronerty to cut or remove such growth. Section 2: If the property owner or occrrant receiving notice under the preceding section fa;ls to have such growth cut or removed from said pronerty, within 15 days after such notice, the Mayor of said municipality shall be authorized to order the cutting and removal of such growth and charge the expense thereof to the owner or occupant, not to exceed the sum of $100.00 for each lot, tract or parcel of land with a frontage not exceeding 50 feet and an additi nal charge of 2.00 for each foot of frontage in excess of 50 feet. Section 3: If such charges are due and remain unpaid for a period of 30 days after such work is completed, the City treasurer shall issue an execution against the owner or occupant of such property from which such growth has been cut and removed, or such other persons as may be liable therefor, which execution shall be a lien upon the premises and, when recorded in the general execution docket of the county, shall be a lien on all of the property of the defendant in execution from the date of such record. Section 4: Such execution 5iha11 be levied and the property sold in the manner now provided for the levy and collection of executions issued by the City Treasurer for taxes, and the proceedings and provisions for the filing of an affidavit of illegality by the defendant in execution, ad well as the proceedings for the filing of a claim to the property levied upon by a third person, shall in all respects be similar to the proceedings and provisions of the law applicable to the levy of execu- tions for taxes. 1 49 There being no further business, Council adjourned, subject to the call of the Mayor. Mayor Savannah Beach, Tybee Island, Ga. February 8, 1961 The regular meeting of Town Council was held today at 3 P.M. in the Council Room in the Town Hall and was attended by Mayor Brown, who presided, and Councilmen Peters, Hosti, Powers, Waters, Lovell, Meddin, Town Attorney Solms, Jr.,Superintendent Reed, Chief McCutchen and H.K. Ellzey. Mr. Ellzey presented a petition containing 104 names who are agreeable to his operating a package shop in connection with his grocery store. He stated that this was an answer to a petition gotten up by a small group of people who are opposed to his opening a package shop at this location. The Mayor asked if he intended to open a package shop and Mr. Ellzey stated that he did and also he intended to operate a bar but he objected to paying $375.00 as a half year's whiskey license for such a short time. Mr. Ellzey was informed that he could not operate a package shop until the license had been paid. Mr. Ellzey was excused. Chief McCutchen reported that the ambulance was back in operation after having a paint job but that the stretchers had not yet been received. Councilman Waters reminded the Chief that it would be well to start making plans for parking in the vicinity of the new Post Office for next summer. The minutes of the meeting of January 11, 1960 were read and adopted. The Mayor stated that,in relocating water mains and sewer lines on Butl'r Avenue, when the State gets bids from contractor's t� build the road it does not include outside of right -of -way and that the Town should try and get the S.E. & P. Co., and the S. B. T. Ec. T. Co.,to locate their poles on one side and the Town it's mains on the other side. The Mayor stated that he did not want to tear up the streets until he was sure when the work would start and he stated that if it was agreeable with Council he would try to work out something . (While the meeting was in progress Mr. Solms phoned Mr. Gillis of the State Highway Department in Atlanta and asked when he would be ready to award the contract and Mr. Gillis stated that he could as soon ad he received the necessary details completed). He stated that Mr. Solms and him- self would see Mr. McClurkin of the Savannah Electric & Power Co.,and also an orfic;al of the S.B.T. &.T. Co., A letter from the S.B.T. &.T. Co.,requesting permission to lay lines underground on several of the streets in the Town was referred to Mayor Brown.
