HomeMy Public PortalAbout087-1990- ZONING - 165 INDUSTRIAL PARKWAYORDINANCE NO. 87-1990 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO.2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 165 INDUSTRIAL PARKWAY FROM M-1 LIGHT INDUSTRIAL DISTRICT TO M-1 SU LIGHT INDUSTRIAL SPECIAL USE DISTRICT AND AUTHORIZING THE SPECIAL USE OF SAID PROPERTY AS AN ARCHITECTURAL OFFICE. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as M-1 Light Industrial District the property located at 165 Industrial Parkway; and, WHEREAS, it is the intent and purpose hereof, to change the zoning classification of said property from M-1 Light Industrial District to M-1 SU Light Industrial Special Use District and to authorize the specal use of said property as an architectural office; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the 2Z��-day of 2U,0,2 1990, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was_�e to __n_ in favor of/in —eie- recommending the passage of Ordinance No, 87-1990. NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to M-1 SU Light Industrial Special Use District and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. Being a part of the Southwest Quarter and a part of the Southeast Quarter of Section 36, Township 14 North, Range 1 West in the City of Richmond, Wayne County, Indiana, and being more particularly described as follows: Beginning at an iron rod in the centerline of Old national road, said point being 152.46 feet north of the southeast corner of the Southwest Quarter of said Section 36, and running thence, from said beginning point, north 73 degrees and 59 minutes west, along said centerline, 15.12 feet to an iron rod on the point of a curve in the east right-of-way line of a proposed 50.00 foot wide roadway; thence along the right-of-way and along a 365.00 foot radius curve to the left, whose chord bears north 25 degrees, 56 minutes and 07 seconds west, a chord distance of 161.91 feet to an iron pipe at the point of tangency of said curve; thence north 38 degrees, 45 minutes Ordinance No. 87-1990 Page 2 and 00 seconds west, along the east right-of-way of said roadway, 384.29 feet; thence north 68 degrees, 56 minutes and 50 seconds east, 389.40 feet to an iron pipe at the point on a curve in the west right-of-way of the Norfolk & Western Railroad; thence, along the right-of-way of the west line of said railroad and and along a 5694.65 foot radius curve to the right whose chord bears south 21 degrees, 03 minutes and 08 seconds east, a chord distance of 722.93 feet to an iron rod at the point of intersection of said line with the centerline of Old National Road: thence north 73 degrees and 59 minutes west, along said centerline, 309.22 feet to the place of beginning, containing an area of 4.449 acres, there being 2.027 acres in the Southwest Quarter and 2.422 acres in the Southeast Quarter of said Section 36. SECTION 2. That as provided in Articles 34 and 48 of Chapter 154 of the Code of Ordinances, the following described use of the above described property is allowed as as an architectural office. SECTION 3. That as a condition of being granted the special use and as an additional restriction on said use, the following requirements shall hereafter and at all times be met by the owner of said real estate. A. The Special Use site plan and petition shall be marked Exhibit A and made a part of this Ordinance. SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. R.W. Clinton & Associates, Inc. has an offer to purchase the property in question pending obtaining the necessary zoning approval. The M-1 District regulations indicate that retail, service or office uses may be located in an industrial zoning district only through special use rezoning when it is demonstrated that the proposed special use is necessary to serve an industrial need. The rationale for this provision is that the infrastructure in an industrial area is generally developed at large capacities to serve industrial uses. Allowing commercial uses in industrial areas would constitute underutilization of the infrastructure and a waste of community resources. The special use petition has been reviewed by the Police and Fire Departments and Sanitary District. No concerns have been identified. Eleven (11) notices of public hearing were sent to the owners surrounding the site. Two (2) notices were returned to the Plan Department not oppossed to the petition. During the public hearing no one spoke in opposition to the petition. Therefore, the Commission voted six (6) to zero (0) to recommend to Council that Ordinance No. 87-1990 be adopted. Respectfull submitted, Daniel S.
